STAFF REPORT
Subiect:
Ordinance of the City of San Bernardino amending Chapter 2.19 to Title 2 of the San Bernardino
Municipal Code establishing a Youth Advisory Commission.
Backe:round:
In August of 2007, the Mayor and Common Council voted unanimously to create a Youth
Advisory Commission. The primary purpose of the Commission is to provide a forum that
allows young people to participate in local governance. The model adopted in 2007 was a hybrid
of successful Youth Commissions in other California cities, including Oakland, Fremont and
Huntington Beach.
Since its inception, the Commission has been staffed by the Parks and Recreation Department.
During the first year of this program, staff identified issues that have inhibited the Commission
from operating to its fullest potential and has recommended that certain provisions of the
Ordinance be changed. In addition, Councilman Brinker requested that staff look into expanding
the Commission to include college age students.
Staff met with Youth Commission leaders and a representative from CSUSB Associated
Students, Incorporated (ASI) to discuss possible ways to increase the performance of the
Commission, as well as to include college age students in the make up of the Commission. Staff
is recommending that the structure of the Commission be modified as follows:
. The Commission will consist of 19 members; two (2) members appointed by each
Council member to serve for the term of their office, and five (5) from the Mayor to serve
for the term of the Mayor. This change will result in the committee no longer relying on
schools/organizations for participation, which proved to be a time consuming and
ineffective process.
. An adjustment to the required ages from 13-19 to 15-23. Staff observed that there was
very little participation from the 13-14 year old Commissioners. As a result, Parks staff
recommended that the minimum age of Commissioner be increased. This adjustment is
also intended to allow for college age appointees. Consistent with the requirements for
City volunteers, a "Live Scan" fingerprint screening will be required, at the City's
expense, for any Commissioners over the age of 18.
. Currently, Commissioners are appointed to a one year term. The proposed
recommendation will allow the appointees to serve for the term of the Council person by
which they were appointed. In addition, Commissioners may be appointed up to, but no
more than, two consecutive terms. Staff is expecting approximately six Commissioners to
continue their current terms.
. Any appointed Commissioner under the age of 18 shall serve as an Apprentice
Commissioner. Any appointed commissioner who is over the age of 18 shall serve as an
Advisory Commissioner. In the event that an Apprentice Commissioner turns 18 during
their appointment he/she shall be promoted to Advisory Commissioner on the day of their
birthday, pending a Live Scan. The progression from Apprentice to Advisory
Commissioner is intended to create an objective for younger Commissioners to
accomplish, as well as to construct a mentoring environment. The Commissioners will
work together on the development of a Youth Master Plan and the issues facing youth,
yet also be able to focus on concerns that target their specific age groups.
. Currently, participation in illegal activity may result in the dismissal from the
Commission. The City Attorney's Office recommends modifying this section to read,
"Conviction of any illegal activity will be cause for dismissal from the Youth Advisory
Commission.
Staff recommends that Parks and Recreation continue to staff this Commission with the
understanding that the Advisory Commissioners will assume many of the administrative duties.
This will allow older commissioners to receive administrative, mentoring and leadership
experience, as well as take a responsible role in Commission functions.
Attached is the current Ordinance, as well as a revised Ordinance, modifying the above
mentioned items. The Mayor and Common Council may begin filling vacant positions
immediately following the adoption of this Ordinance.
On August 19' 2008, the Legislative Review Committee requested that staff from the City
Manager's Office and the Parks and Recreation Department work together to draft a Youth
Advisory Commission Code of Conduct. Chapter 2.19.040 will be amended to include this code
of conduct after it has been developed.

2.19.040 Conduct
. Upon appointment, all Commissioners may be required to read and sign a Youth
Advisory Code of Conduct, which may be developed by the Commission. Any
Commissioner who fails to follow this Code may be subject to removal from the
Commission by City staff.
Staff recommends that Parks and Recreation continue to staff this Commission with the
understanding that the Advisory Commissioners will assume many of the administrative duties.

15 There is hereby established in the City of San Bernardino a Youth Advisory Commission. The
purpose of this Commission is to involve young people in local governance, to engage youth in
16 creating positive social change, and to serve in an advisory capacity to the Mayor and Common
Council on topics relating to needs, priorities, programs and opportunities for youth in the
17 community. .

2.19.010 Members - Appointment - Terms

The Youth Advisory Commission shall consist of 19 voting members between the ages of 15 -
20 23, serving without compensation at the pleasure of the Mayor and Common Council. All
21 appointees shall be residents of the city and have an awareness and understanding of the needs of
young people in San Bernardino. Commissioners shall be appointed as follows:

a) 2 members appointed by each Council Member.
b) 5 members appointed by the Mayor

24 Each Councilperson shall appoint two (2) members, who need not be residents of their Ward, to
serve for the term of their office. The Mayor shall appoint five (5) members, who are residents of
25 the City, to serve for the term of the Mayor. All appointments shall be subject to the approval of
26 the Common Council.

2.19.013 Progression from Apprentice to Advisory Commissioner
Any appointed Commissioner who is under the age of 18 at the time of appointment shall
serve as an Apprentice Commissioner. These Commissioners shall be responsible for
fulfilling the duties and purposes of the Commission while representing the youth of the city
of San Bernardino.
Any appointed Commissioner who is 18 years of age or older at the time of appointment
shall serve as an Advisory Commissioner. These Commissioners shall be responsible for
fulfilling the duties and purposes of the Commission while representing the college age youth
of the City of San Bernardino. Under the guidance of City staff, Advisory Commissioners
shall assume the task of staffing the Commission which includes organizing and managing
the Commission meetings, keeping Minutes of Action taken at meetings, filing all meeting
notices and minutes with the City Clerk's Office and serving as mentors to the Apprentice
Commissioners. Advisory Commissioners shall not serve in a supervisory capacity. All
Advisory Commissioners shall be subject to a "live-scan" background check within 30 days
of date of appointment.
In the event that an Apprentice Commissioner reaches the age of 18 during their term, he/she
shall be automatically promoted to Advisory Commissioner on their birthday. Within 30 days
of their turning 18, Advisory Commissioners shall be subject to a "live-scan" background
check. Non-compliance within the 30 day time period will result in automatic removal from
the Commission.

17 If any member of the Commission fails to attend three consecutive regular meetings without
contacting staff or their designee prior to the absence(s), he or she will automatically cease to be
18 a member of the Commission. Vacancies shall be filled in the manner set forth in San
Bernardino Municipal Code Section 2.17.030.
2.19.015 Absences - Vacancies

20 2.19.020 Purpose - Duties.
21 The Youth Advisory Commission shall:
(A) Work with the city and community based organizations to develop a Youth Master Plan.
22 (B) Provide an avenue for youth to express their concerns, ideas and recommendations.
23 (C) Act in an advisory capacity to the Mayor and Common Council and other City Commissions
in all matters pertaining to youth issues.
24 (D) Encourage and promote youth involvement and participation in city and community
activities.
25 (E) Work with community based organizations, such as the Inland Congregations United for
Change, and other governmental agencies to advocate for youth.
26 (F) Promote public understanding of the accomplishments being made by youth in the city.
27 (G) Positively represent and act as role models to youth in the community.
