A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF TWO
AGREEMENTS BETWEEN SAID CITY AND THE ATCHISON, TOPEKA AND
SANTA FE RAILWAY COMPANY FOR ADDITIONAL RAILWAY CROSSING
PROTECTION AT GRADE CROSSINGS ON RIAL TO AVENUE AND PEPPER
A VENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION ONE: That the City of San Bernardino execute two agreements
between said City and the Atchison, Topeka and Santa Fe Railway Company for
additional railway crossing protection at grade crossings on Rialto Avenue and
Pepper Avenue.
SECTION TWO: That said agreements, copies of which are attached hereto,
marked Exhibit" A" and Exhibit" B" and referred to and made a part hereof
as fully as though set out a length herein, are hereby approved.
SECTION THREE: That the Mayor is hereby authorized and directed to
execute said agreements on behalf of the City of San Bernardino.
I HEREBY CERTIFY that the foregoing resolution was duly adopted by
the Mayor and Common Council of the City of San Bernardino. at a-U

Gentlemen:
Pursuant to terms of California Public Utilities Commission's
Decision No. 72106 handed down in connection with Case No. 8135 covering
sufficiency of crossing protection at main track grade crossings in
San Bernardino County, additional grade crossing protection is to be
installed at nine crossings prior to June 30. 1967.

As Rialto Avenue Grade Crossing No. 2B-0.7 and Pepper Avenue
Crossing No. 2-83.9 are included in the nine above mentioned crossings
and appear to be under City jurisdiction, we are enclosing three copies
of proposed cost agreements covering required additional grade crossing
protection for each of the two crossings for City's consideration. Please
note that the agreement pertaining to the Rialto Avenue crossing requires
installation of two additional flashing light signals to be installed on
median islands to be provided by City. The additional flashing light
signals are necessary at this location in order that we may install three
automatic crossing gates due to restrictive overhead utility line clearance.

Providing the agreements are satisfactory to City, please have
Santa Fe and City original of each agreement executed by City and return
along with two copies of City Council Resolution authorizing such execution
for completion by Santa Fe. The extra copy of each agreement is for reten-
tion by City pending return of City's fully executed originals.

ATCHISON. TOPEKA AND SANTA FE RAILVlAY CmIPANY. a
Kansas corporation, hereinafter designated "Santa Fe'\
and the CITY OF SAN BERNARDINO, a municipality, in the
State of California, hereinafter designated "City".
WITNESSETH:
.v~qR~S the Public Utilities Commisftion, State of California, has
ordered that autonlatic crossing gates be installed at the Rialto Avenue cross-
ing of Santa Fe track (designated by said Commission as Crossing No. 2J>-O.7). and;
WHEREAS the vertical clearance of overhead utility lines preclude sup-
plementing the existing two (2) flashing light signals at the Rialto Avenue
crossing with automatic crossing gates at sufficient length to afford adequate
roadway coverage.
NOd TH&qEFORE IT IS AGREED by the parties hereto as follows:
1. Santa Fe shall install two (2) additional flashing light signals
on six foot minimum width me.dian islands to be provided by City and supplement
three (3) of the flashing light signals with automatic crossing gates.
~. Such work shall be performed as soon as practicable, considering
availability of materials and manpower, and in consideration thereof the City
will pay to Santa Fe, as its share of the cost thereof, one-half of the actual
total cost which total cost is presently estimated by Santa Fe to beTVrl!.1VE
THOUSA}ID SIX HU}IDRED THENTY ($12,620.00) Dollars. Santa Fe's contribution
toward the total cost of the work shall be applied first toward any replace-
ment or relocation involved.
3. That upon completion of the work specified in Paragraph 1 of this
agreement, Santa Fe will render City a bill for its portiqn of the costs and
City will promptly reimburse Santa Fe for such costs.

4. That all work covered by this agreement shall conform to
requirements of the Public Utilities Commission of the state of California.
5. After installation of railroad crossing protection signals and
appurtenances under terms of this agreement, Santa Fe shall physically maintain
same so long as they remain in place. The maintenance cost of said signals and
appurtenances shall be divided in the same proportion as the cost of constru~
ing such automatic grade crossing protection as provided in Section 2 hereof,
in accordance with Section 1202.2 of the California Public Utilities Code.
6. The ol'TIership of all materials used or placed in connection
wi th the work specified in Paragraphs 1 and 5 hereof shall be in Santa Fe.

to be executed and attested by its duly qualified and authorized officials pur-
suant to authority regularly granted them by its City Council and THE ATCHISON,
