HomeMy WebLinkAbout8178 1 RESOLUTION NO. ff/ ;1 ,f 2 A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 6433 ENTITLED, "A RESOLU- 3 TION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO CREATING AND ESTABLISHING POSITIONS FOR THE VARIOUS DEPARTMENTS 4 OF THE CITY OF SAN BERNARDINO". 5 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY 6 OF SAN BERNARDINO AS FOLLOWS: 7 SECTION ONE: That Resolution No. 6433, Section Eleven 8 is hereby amended to read as follows, to-wit: 9 SECTION ELEVEN: VACATION: Every employee of the City of 10 San Bernardino (exclusive of those employees under the Board of 111 Water commissioners and the Free Public Library Board) shall be 121 allowed vacation as follows: 131 (a) After the completion of one (1) year of continuous I 14 full time employment with the City of San Bernardino, and there- 15 after up to and including nine (9) years of continuous full time 16 employment, every employee shall be allowed vacation equivalent 17 to two (2) calendar weeks with pay per year. Vacation shall 18 accrue at the rate of 1.166 calendar days per month, and shall 19 not exceed two (2) calendar weeks in anyone year. . , 201 (b) After the completion of ten (10) years of continuous 211 full time employment with the City of San Bernardino and there- " 22!1 after up to and including nineteen (19) years of continuous full , , 231 time employment, every employee shall be allowed vacation equiva- 24 lent to three (3) calendar weeks with pay per year. Vacation 25 shall accrue at the rate of 1.75 calendar days per month, and 26 shall not exceed three (3) calendar weeks in anyone year. 27 (c) After the completion of twenty (20) years of continu- 28 ous full time employment with the City of San Bernardino, and 29 thereafter, every employee shall be allowed vacation equivalent 30 to four (4) calendar weeks with pay per year. Vacation shall 31 accrue at the rate of 2.33 calendar days per month and shall not 32 exceed four (4) calendar weeks in anyone year. II " II I II " il 1 Compensation for the above vacation other than payment 2 for earned vacation at time of termination of employment, shall 3 be for the amount normally earned for regular assigned working 4 time, other than overtime. 5 I Wherever the terms "year or years of employment" appear 6 herein, it shall be deemed to include all service for the City 7 of San Bernardino, the San Bernardino City Board of Water Com- 8 missioners and for the San Bernardino Free Public Library Board. 9 No vacation or portion thereof from anyone year shall 10 run consecutively with the vacation of the preceding year. Employees shall not be permitted to work in their City position in lieu of taking vacations ~n order to receive addi- tional compensation from the City. The vacation period to which any employee shall be entitled shall be assigned by the Head of the Department in the calendar year when due. When a holiday, authorized by the Mayor and Common Council, occurs within the vacation period of an employee, then such emp- loyee shall receive an additional day of vacation with pay, except those employees of the Police and Fire Departments who receive additional vacation time in lieu of holidays. When an employee resigns or otherwise leaves the service of the City of San Bernardino and has not had his earned vacation since his last anniversary date, then payment shall be made to the employee for the earned portion of his vacation. When an employee resigns or otherwise leaves the service of the City of San Bernardino prior to the next anniversary date of his employment and has received a vacation with pay under the provisions of this Resolution prior to his termination of service, 1 2 3 4 5 6 7 8 9 10 11 121 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 II 'I II ji d ! then a deduction will be made in such employee's final pay period for the unearned portion of his vacation. Calculation of payment for earned vacation, or deduction for unearned vacation upon termination, shall be made on the basis of the annual salary of such employee. The annual salary shall be computed at twelve (12) times the monthly rate for monthly employees; 261 times the established daily rate for 5-day week employees; 313 times the established daily rate for 6-day week employees. The annual salary divided by 365 will secure the vacation daily rate. This rate multiplied by the number of earned or unearned vacation days will result in the amount to be paid respectively for earned vacation due the employee or for unearned vacation due the City of San Bernardino by the employee. When an employee returns to work after a break in"con- tinuous service" as defined in section 9 of this Resolution, and when such break in "continuous service" shall have been by leave of absence with the approval of the Mayor and Common Council, vacation time shall accrue monthly from the date of return to service from such approved leave of absence, based upon the total length of service of the officer and/or employee. SECTION TWO: That this Resolution shall be effective and operative on July 1st, 1966.
