HomeMy WebLinkAbout8197 1 RESOLUTION NO. fl9' '7 I A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO PROPOSING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY HEREINAFTER DESIGNATED AS THE l81ST ANNEXATION DISTRICT OF THE CITY OF SAN BERNARDINO. 2 Ii 3 i 4', I 5 WHEREAS, and heretofore, there has been presented to the Mayor and 6' 1 7, Common Council of the City of San Bernardino a written petition containing a description of certain territory which is hereinafter more specifically 8. 9' described, and said petition requested that said territory be annexed to and included in the City of San Bernardino in accordance with the provisions of 10 the "Annexation of Uninhabited Territory Act of 1939" as contained in 11 Government Code, Section 35300, et seq.; and 12 WHEREAS, the Common Council has made a complete investigation and 13 report in reference thereto. 14 I 15. i 161 NOW, THEREFORE, BE AND IT IS HEREBY RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION ONE: That a written petition containing a description of 17' certain uninhabited territory hereinafter more specifically described has 18 been presented to the Common Council of the City of San Bernardino. 19 SECTION TWO: That said petition contains a description of certain 20 uninhabited territory sought to be included in the City of San Bernardino, 21 and that a petition is signed by the owners of not less than one-fourth of 22: the assessed value of said territory according to the last preceding , 23 equalized assessment roll of the County of San Bernardino, in which said 24 County the City of San Bernardino is situated. 25 SECTION THREE: That notice is therefore hereby given of the 26 proposed annexation to the City of San Bernardino of the uninhabited territory 27 contiguous to the City of San Bernardino, the boundaries of which are 28 particularly described as follows, to wit: 29 That portion of the Southeast one-quarter of Section 19, Township 1 North, Range 3 West, San Bernardino Meridian; those portions of Lot 3, Block 20; Lots 3, 4,5 and 6, Block 17; Lots 3, 4, 5 and 6, Block 16, and Lots 4, 5 and 6, Block 13, West Highlands as per plat thereof recorded in Book 5 of Maps, page 77, records of the County Recorder of San Bernardino County, State of California, described as follows: 30 31 32 1 'I Iii I 2 31 4 1 5 6 7 i 8' 9 10 11 12' 13 i 14 15 i 16 17, 18 19 20 211 22 23 24 25 26 27 28 29 30 I ,I , , 31' 32 1- Beginning at a point on the Present Corporate Limits of the City of San Bernardino) said point being on the North line of the Southeast one-quarter of said Section 19 and being West thereon, 486.00 feet from the Northeast corner of said Southeast one-quarter; thence South 00 04' East, 2195.00 feet to a point in the Northeasterly line of said Lot 6, Block 17; thence West, 33.54 feet to the East line of said Lot 5, Block 17; thence South 470 22' West along the South- easterly line of the property conveyed to John D. Leedom, Jr., et ux, by Deed recorded November 25, 1957 in Book 4326, page 411, Official Records of said County, a distance of 355.70 feet; thence South, 451.35 feet to a point on the South line of said Lot 5, Block 17, which point is 178.30 feet East of the Southwest corner thereof; thence continuing South along the Southerly prolongation of said last course, a distance of 41.25 feet to the centerline of Marshall Boulevard; thence East along the said centerline of Marshall Boulevard to a point which is 435.25 feet West of the Northerly prolongation of the East line of said Lot 6, Block 16; thence South, parallel with said East line to a point in the North line of said Lot 6, Block 16; thence South OSO 35' West, 917.78 feet to a point in the South line of said Lot 5, Block 16, which point is East thereon, 353.52 feet from the Southwest corner thereof; thence South, 41.25 feet to the centerline of Lynwood Drive; thence East along said centerline to the intersection with the centerline of Victoria Avenue; thence South along the said centerline of Victoria Avenue to its intersection with the centerline of Citrus Street, 82.50 feet wide; thence West along the centerline of said Citrus Street to the intersection of the Southerly prolongation of the West line of said Lot 4, Block 13; thence North along said Southerly prolongation and the West line of said Lot 4, Block 13, and its Northerly prolongation to the centerline of said Lynwood Drive; thence West along said centerline to its intersection with the Southerly prolongation of the West line of said Lot 3, Block 16; thence North along said Southerly prolongation and West line of said Lot 3, Block 16, and its Northerly prolon- gation to the centerline of said Marshall Boulevard; thence East along said centerline to its intersection with the Southerly prolongation of a line which is 10.71 feet West of the East line of Lot 3, Block 17; thence North 00 09' West along said Southerly prolongation and said line a distance of 1034.20 feet to the Northeast corner of the property conveyed to Sierra-Johnson, a limited partnership, by Deed recorded November 30, 1961 in Book 5598, page 204, Official Records of said County; thence North 890 56' West along the North line of said Sierra-Johnson property a distance of 430.15 feet; thence North 00 12' West along the West line of said Lot 3, Block 20, a distance of 329.44 feet to a point which is North 00 12' West a distance of 39.39 feet from the Northwest corner of said Lot 3, Block 20; thence North 600 12' West a distance of 156.00 feet to a point on said City Limit line; thence North 00 04' West along said City Limit line a distance of 1522.00 feet, more or less, parallel to and 1982.70 feet distant from the East line of said Southeast one-quarter to a point on the North line of said Southeast one-quarter; thence East along the North line of said Southeast one-quarter and said City Limit line, 1496.70 feet to the point of beginning. That there are less than twelve qualified electors residing in said - 2 - . 10 11 i , 12 13 141 I 15 16' 17, 18 19 I 20' 21 22 23 24 25 26 1 territory and that said territory is uninhabited as defined by said Act; and 2: That the aforementioned uninhabited territory included in the , 3,', 41 I, proposed annexation shall hereafter be generally known and identified as t1Annexation District No. l8ln. 51 I 6' 71 II 8. SECTION FOUR: That upon the completion of said annexation of said territory, all of the property included in said Annexation District No. 181 shall be taxed equally with the other property within the City of San Bernardino to pay the bonded indebtedness and any and all general 9 indebtedness of the City of San Bernardino contracted prior to or existing or outstanding at the time of the aforesaid proposed annexation of said described property as provided in said Act. SECTION FIVE: Notice is hereby given that Monday, the / f'd day of , 1966, at the hour of 9:30 o'clock A. M. of said da Council Chambers of the City Hall in the City of San Bernardino, California, is the time and place designated at which time any person owning real property within the said territory may appear before the Mayor and Common Council of the City of San Bernardino and show cause why said territory should not be annexed to said City. UT I i i 1: of San Bernardino, the county in which is located the territory proposed to be 2 annexed to the City of San Bernardino, said publication to be complete at 3 least twenty (20) days prior to the date set for hearing; 4 And the said City Clerk is further authorized and directed to cause 5 written notice of such proposed annexation to be mailed to each person to 6 i whom land within the territory proposed to be annexed is assessed in the last 7 equalized county assessment roll available on the date the above said 8 proceedings were initiated, at the addresses shown on said assessment roll or 9 known to said Clerk, and to any person who has filed his name and address and 10 the designation of the lands in which he has an interest, either legal or 11 equitable, with said Clerk, such notice to be given not less than twenty (20) 12 days before the first public hearing on the proposed annexation; 13 And in the event any land within the territory proposed to be 14 annexed is owned by a county, the said City Clerk is directed to cause 15 written notice of such proposed annexation to be mailed to the Board of 16 Supervisors of such county, such notice to be given not less than twenty (20) 17 days before the first public hearing on the proposed annexation; 18 And in the event there is upon the land proposed to be annexed a 19 structural improvement owned, being acquired or leased by a county fire 20 protection district, the said City Clerk is directed to cause written notice 21 of such proposed annexation to'be mailed to the governing body of such 22 district, such notice to be sent not less than ten (10) days before the 23 first public hearing upon such proposed annexation; 24 And the said City Clerk is directed to cause written notice to be 25 given to such other persons as may be legally entitled thereto, in the 26 manner required by law.
