Description: N/A Finance: Council Notes: Agenda Item No. IS- tJg-IS--~11 CITY OF SAN BERNARDINO REQUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Authorization to Proceed and Approval of Plan No. 12798 - Proposed street vacation of a portion of Spruce Street between Mt. V ernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon A venue. BACKGROUND: On June 13,2011, an application was received from the Redevelopment Agency of the City of San Bernardino (RDA), requesting the vacation of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue. This portion of Spruce Street was dedicated as public right-of-way on the map of the Tompkins Subdivision, thus the City does not own any portion in fee. RDA owns the parcels directly adjacent to this portion of Spruce Street, and is planning to use this portion for future development, which will also include the current gas station. If authorization to proceed is given, all City departments, utility companies and affected property owners will be notified to determine if any conflicts exist, including the traffic circulation of the existing area. Once all research is completed, the findings will need to be made by the Public Works Director that the proposed vacation of this portion of Spruce Street between Mt. Vernon Avenue and a north-south alley approximately 150 feet west of Mt. Vernon Avenue are no longer needed for public right-of-way. A map depicting the general vicinity and Plan No. 12798 showing the details of the proposed vacation is attached. FINANCIAL IMPACT: There is no financial impact associated with this action. The petitioner has paid the total processing fee of $2,000. RECOMMENDATION: Staff recommends that authorization to proceed with the proposed vacation be given and that Plan No. 12798 be approved. I understand that at the conclusion of the investigative proceedings, the City will notify me of its findings including and conflicts with City facilities now located in the area proposed to be vacated, or the request by any utility company for the reservation of any existing easements and that such conflicts or reservations may affect the intended use of the proposed area, once vacated, and that I may elect to terminate or continue the proceedings. If I elect to continue. the remaining unpaid fees shall be paid by me prior to the continuance of said proceedings.
