Description: Finance: Council Notes: Agenda Item No. II O~~{l)~ J-tJtJ CITY OF SAN BERNARDINO - REOUEST FOR COUNCIL ACTION STAFF REPORT SUBJECT: Authorize the Director of Public Works to execute Contract Change Order No.3 with Bomel Construction Co., Inc. for the Metrolink Parking Structure at the Santa Fe Depot (GB 04-19), per Plan Nos. 12591, 12328, 12336, 12337, 12327, and 12348. BACKGROUND: In December 2003, the San Bernardino Associated Governments (SANBAG) and the City of San Bernardino signed a cooperative agreement as part of the Metrolink Commuter Rail Station and the Santa Fe Depot Rehabilitation Project. Subsequent amendments in September 2005 and in July 2007 were approved to provide reimbursement provisions for all engineering, inspection, and construction costs for an amount up to $3,500,000 associated with the construction of the Metrolink Parking Structure project. The Congestion Mitigation and Air Quality (CMAQ) improvement program will provide the remaining matching funds for the total construction costs with a reimbursement ratio of 88.53 percent. On February 16, 2010, the Mayor and Common Council approved a Resolution awarding a contract to Bomel Construction Co., Inc., for the Metrolink Parking Structure at the Santa Fe Depot (GB04-19). On October 4, 2010, the Mayor and Common Council authorized the City Engineer to execute Contract Change Order No. I to include the excavation work for percolation testing to comply with the Water Quality Management Plan and to substitute the fiber mesh as a concrete additive ingredient instead of the originally specified Elastomeric coating for the project. On November 2, 2010, the Mayor and Common Council authorized the City Engineer to execute Contract Change Order No.2 to provide a trailer for the construction management team and to substitute the light emitting diode fixture system (known as LED) instead of the originally proposed fluorescent lighting system for the project. CONSTRUCTION CHANGE ORDER NO.3: The first item included in this change order involves the change of work related to the Water Quality Management Plan (WQMP) and the Storm Water Pollution Prevention Plan requirements. The contractor was directed to provide an on-site retention of storm water (bio- swale) for the project in the final design. In addition, the WQMP required that changes be made to the landscaping and irrigation system to accommodate drought-tolerant landscaping materials associated with the new bio-swale. The second item included in this change order addresses additional costs between the period January through March 2011 for the on-going use of the construction management trailer, including electricity, telephone, internet service and restroom facilities. The third item included in this change order is related to scope of work changes under the bid item no. 6, "Parking Structure". Some of the changes include the deletion of roof trellis and planters, replacement of guardrail with barrier rail at the ground floor, provision of elevator shaft 2 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION STAFF REPORT - Continued architectural/structural changes, an addition of an air conditioning unit for the elevator machinery room per California Building Code requirements, and installation of additional conduits for future cameras and control gates at the parking structure entrances. The fourth item included in this change order is related to changes in the subgrade preparation as required per the civil drawings and the additional 75 lineal feet of retaining wall installed by the contractor in the field. The fifth item included in this change order provides an Americans with Disabilities Act (ADA) compliance landing base at Mt. Vernon Bridge and the newly constructed sidewalk path of the Metrolink Parking Structure along 3rd Street. The sixth item included in this change order provides an additional II lineal feet of 2 inch conduit for a point of connection for the proposed street lights along 3rd Street north of the Metrolink Parking Structure. The seventh item included in this change order provides additional conduits, several stations to the irrigation system along with the drought tolerance landscaping materials as required for the new proposed bio-swale configuration. The remaining items (eighth through sixteenth) included in this change order provide for the additional and/or reduced costs of changes and/or deletion of items of work. The description and justifications of all the above listed items are detailed in the attached Contract Change Order No. 3. FINANCIAL IMPACT: The revised estimated project costs are as follows: TOTAL Original Contract Amount $ 4,167,526.00 Contract Change Order No. One $ (27,850.00) Contract Change Order No. Two $ 62,576.94 Contract Change Order No. Three $ 32,895.03 Total Construction Contract Amount $ 4,235,147.97 The net change order amount of$32,895.03 represents an increase of 0.79 percent ofthe original contract amount. This increase does not significantly change the total project cost and is less than the contingency amount estimated in the design phase, so no additional funds are currently needed for this project. Remove Curb and Gutter and Asphalt Concrete for Street Lil!ht During construction, it was determined that removal of curb, gutter and asphalt concrete 3-6 was required to install the missing 2" conduit and point connection to the proposed new street light for the parking structure project. This request was not included in the oripinal bid. Chanl!es in Landscaoinl! and Irril!ation System The contractor was directed to install additional conduit and stations to the irrigation 3-7 system along with landscaping materials (drought tolerance) in order to accommodate the bio-swale configuration as part of the WQMP changes. STREET AT THE SANTA FE DEPOT (GB 04-19) Modifv East Vehicle Entrance During construction, it was detennined that additional concrete sidewalk, curb and 3-8 gutter were required in order to construct driveway at the east entrance for ADA compliance to provide a pedestrian path with a slope not to exceed 2%. This request was not included in the original bid. Install Concrete Curb under Mt. Vernon Bridge The contractor was directed to install an additional of 120 feet of curb (2-ft high) under 3-9 Mt. Vernon Bridge in order to provide a protection and a path to pedestrians between the over-flow parking area and the Metrolink Parking Structure along 3'd Street. This reauest was not included in the original bid. Install Handicap Curb Ramp under Mt. Vernon Bridl!e During construction, it was determined that one additional handicap curb ramp 3-10 installation with tactile detection was required under Mt. Yernon Bridge for pedestrians crossing 3'd Street from the over-flow parking area to the Metrolink Parking Structure. The request was not included in the original bid. Add Trench Drain at Pedestrian Path to Metrolink Platform During construction, it was detennined that a trench drain was required along the 3-11 pedestrian path crossing 3'd Street between the Metrolink Parking Structure and the platfonn in order to channelize surface water away from the path. This request was not included in the original bid. Relocate the Proposed Irril!ation Controller Location 3-12 During construction, it was detennined that relocation of the proposed irrigation controller was required to another location with an additional pipe sleeve in order to avoid the water line. This request was not included in the original bid. Construct 2' X 2' X 4" Concrete Pad for Air Yac 3-13 During construction, it was detennined that the construction of a concrete pad (2' X 2' X 4") was required per the precise grading plan for the relocated air vac assembly. This reauest was not included in the original bid. Removal of the Temporary Chain Link Fences/Gates 3-14 The contractor was directed to remove temporary chain link fences/gates for the grand opening of the Metrolink Parking Structure early in the morning. This request was not included in the original bid. Adiustment due to ReducedlDeleted Items 3-15 During construction, it was detennined that some of the items (such as 18" RCP stonn drain pipe, stonn drain manhole, metal hand railing, concrete retaining wall, concrete cross gutter and soandrels) were reduced or deleted from the scooe of work. Modifv Landscape Drain and Downspout During construction, it was determined that a modification to the landscape drain and 3-16 downspout was required in order to meet NPDES requirements at the east end of the structure.
