RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF TH
CITY OF SAN BERNARDINO ESTABLISHING THE SCHEDULE OF FEES FOR TH
CRIME FREE RENTAL HOUSING PROGRAM.

WHEREAS on May 16, 2011, the Mayor and Common Council approved a mandator
Crime-Free Rental Housing program and directed staff to establish fees to cover the cost 0
administering the program; and
WHEREAS code enforcement and other staff is required to conduct inspections an
classes to implement the Crime Free Rental Housing program; and
WHEREAS the implementation of a crime-free rental housing program results in lowe
maintenance costs and improved safety for tenants, property owners and the community;
WHEREAS the subject proposed fees and charges are exempt from the voter approva
requirements of Proposition 26 pursuant to Article XIII C, Section I, subdivision (e)(2) and (3
of the California Constitution.

NOW, THEREFORE, BE IT RESOLVED, FOUND AND DETERMINED B

SECTION I. This Resolution contains fees that are subject to adoption and modification
pursuant to the provisions of California Government Code Section 66016 et seq.

A hearing has been held by the Mayor and Common Council pursuant to th

provisions of Government Code Section 66016 to consider the levy of new and additional fee
and services, which hearing was held following public notice published in a newspaper 0
general circulation in the City of San Bernardino.
B. Neither of the proposed new or modified fees exceeds the actual cost of pro vi din
such services, and for the service which is not completely paid for by the proposed fee, th
additional expense, if any, to the City of providing the services shall be borne by the general
fund of the City of San Bernardino.

C. The proposed fees and charges are reasonable and necessary to enable the City 01
San Bernardino to more nearly meet the actual costs of providing such services.
D. The adoption of this Resolution is exempt from the California Environmental
Quality Act because it approves fees for the purpose of meeting a portion of the operatin
expenses of the City as set forth in California Public Resollrces Code Section 21080(b)(8).

Pursuant to Government Code Section 66017(a), the fees established in thi.

resolution, and elsewhere contained herein which are subject to the provisions of Governmen
Code Sections 66016 et seq., shall become effective 60 days following the effective date of thi
resolution.

SECTION 2. The following schedule of fees shall be charged to all owners of multi
family residential rental properties for annual inspections pursuant to Chapter 15.27 of the San
Bernardino Municipal Code.
