AN ORDINANCE RE~UIRING THE DISPOSAL OF ALL REFUSE AND
COMBUSTIBLE MATERIAL; PROVIDING FOR NOTICE TO DISPOSE OF THE
S~~ ~L~ PRESCRIBING A 1lETHOD FOR THE COLLECTION OF THE COST
A1ID~ENSES OF THE DISPOSAL THlIREOF. AND A PENALTY FOR A
VIOLATION.

The Mayor and Common Council of the City of San Bernardino
do ordain as fOllows:
Section 1. The accumulation of shavings, straw, sacks,
bags, litter, weeds. grass, or other combustible waste or
fragments in any yard, lot, or upon any premises within the
corporate limits of the City ot San Bernardino, is hereby
declared a nuisance and the owner, occupant, or a.ent of any
lot or premises within said City who shall permit or allow
the accumulation or existence of any shavings, straw, sacks,
bags, litter, grass, weed., or other combustible waste or
fragments Upon /;j!r~ lot or premises owned, occupied, or con'trolleci
by him, after notice to remove the same, 88 herein provided,
shall be gUilty of a misdemeanor and upon ctnviction thereof
shall be fined not le85 than Five Dollars nor more than Fifty
Dollars. or by imprisonment in the City Jail for a period not
exceeding 25 days, or by both such five and imprisonment.
Section 2. It is hereby made the duty of the Chief of the
Fire Department of said City, to require the owner, occupant, or
agent of any lot or premises, after notice so to do, to clear
the same from all shavings, straw, sacks, bags, litter, grass,
weeds, or other combustible waste or "fragments.
Said notice
shall be in writing and shall be delivered to said owner,
. occupant, or agent of said premises, personally, or conspicuously
posted in a conspicuous place on such lot or premises and if
such owner, occupant, or agent shall neglect so to do, for 48
hours after such notioe, then said Chief of the Fire Department

shall cause said lot or premises to be cleared ot all auch
shavings, straw, sacks, bags, litter, graas, weeds, or other
combustible waste or fragments, and the expense of such cleariag
and disposing of such shavings, straw, sacks, bags, litterJ
grass, weeds, or other combustible waste or fragments, together
with an additional sum of not ~ess than Five Dollars ($5.00), nor
more th'an Ten Dollars (tlO.OO), which shall be chargeable against
such owner, occupant, or agent and shall be a lien on ssid lot
or premises.
Section 3. The Chief of the Fire Depa~tment of said City
shall, . without delay, report all such delinquent sums so charged,
together with the penalty as provided in Section 2 hereof, to ~.
officer having charge and under his control the assessment roll
of said City for such fiscal year, who shall add and charge such
sum on said assessment roll to the taxes of such delinquent
party, and such expense and such penalty are hereby declared to
be a lien of equal force as the taxes on such lot or premises for
such fiscal year and shall oe collected at the same time and in
the same manner as the taxes levied against said property.
Section 4. Ordinance No. 87 and all ordinances or parts of
ordinances in conflict herewith, are hereby repealed.
Section 5. This ordinance shall take effect and be in force
from and after thirty days after its passage and approval.
Section 6. The City Clerk shall certify to the passage of
this ordinance and cause the same to be published for three
consecutive days in The Evening Index.
