Finance: Council Notes: Agenda Item No. ;).3 ",....,-/Q-;HJII CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subject: Resolution of the Mayor and Common Council of the City of San Bernardino ratifying submittal of the FY 2011-12 Oil Payment Program application for funds from the Department of Resources Recycling and Recovery (CaIRecycle). Background: The California Oil Recycling Enhancement Act (Public Resources Code 48600) which provides for, among other things, funding to assist local governments in developing and maintaining an on-going used oil and used oil filter collection/recycling program for their communities. In 2009, Senate Bill 546 was enacted and made various changes to the Act, including: changing the funding from a reimbursable grant program (formerly known as the Used Oil Block Grant Program [UBG)) to a payment program (referred to as the Oil Payment Program [OPP)), and encouraging local governments to use a minimum of $1 million (approximately 10 percent of their individual funding) on collection and recycling of used oil filters.The utilization of OPP funding has enabled the City to provide residents with used oil and filter collection containers, maintain certified used oil collection centers throughout the City, and provide public education programs. The FY 2011-12 OPP Cycle 2 application, if approved, will provide approximately $50,000 to enhance and maintain the City's current used oil and filter recycling program. A portion of these funds will be used to offset personnel costs within the Integrated Waste Management Division, Environmental Projects. The remaining funding will be utilized to purchase materials and supplies necessary for program implementation and promotion. The City has received oil recycling funds from CalRecycle for the past 16 years. During the FY 2009-10 funding cycle, as a result of the State budget deficit, the City received $27,602. In the FY 2010-11 funding cycle, the City received $65,108. The City has met the application deadline date of June 30, 2011. Proposed projects include the continuation of the used oil and filter recycling program, distribution of used oil and filter collection containers for residents, public education programs, storm water mitigation and community events, such as the Route 66 Rendezvous. The term is from July 1, 2011 through June 30, 2013. The City will receive approximately $50,000 for the term and will have two years to expend the funds. Financial Impact: The amount of funding allocated to the City in FY 2011-12 is approximately $50,000. There are no matching funds required by the City. Recommendation: Adopt Resolution. 1 RESOLUTION NO. 2 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO RATIFYING SUBMITTAL OF THE FY 2011-12 OIL PAYMENT PROGRAM APPLICATION FOR FUNDS FROM THE DEPARTMENT OF RESOURCES RECYCLING AND RECOVERY (CALRECYCLE). 3 4 5 WHEREAS, the State of California Oil Recycling Enhancement Act provides 6 funds to cities and counties for establishing and maintaining local used oil collection 7 programs that encourage recycling of used motor oil and filters; 8 WHEREAS, the Department of Resources Recycling and Recovery (CaIRecycle) 9 has been delegated the responsibility for the administration of the program with the 10 State, setting up necessary procedures governing applications of cities and counties 11 under the program; 12 WHEREAS, the City of San Bernardino, as applicant, will enter into the 13 agreement with the State of California for the implementation and maintenance of an Oil 14 Payment Program (OPP) that offers used oil and filter recycling opportunities for 15 residents and encourages the proper disposal of used motor oil and filters; 16 NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 17 18 SECTION 1. That the Mayor and Common Council of the City of San Bernardino 19 ratify the submittal of an application to the Department of Resources Recycling and 20 21 Recovery (CalRecycle) for the FY 2011-12 Oil Payment Program, Cycle 2, a copy of 22 which is attached hereto as Exhibit "A".
