SUBJECT:
An approval by the Mayor and Common Council of the City of San Bernardino, California
adopting a Resolution establishing the schedule of fees for the Crime Free Rental Housing
Program.
BACKGROUND:
On May 16, 2011, the Mayor and Common Council approved a mandatory Crime-Free Housing
program and directed staff to establish fees to cover the cost of administering the program
consisting of a training class and Crime Prevention Through Environmental Design inspections.
FINANCIAL IMPACT:
No financial impact to the general fund.
RECOMMENDATION:
That the hearing be closed and said resolution be adopted.

3 RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO ESTABLISHING THE SCHEDULE OF FEES FOR THE
4 CRIME FREE RENTAL HOUSING PROGRAM.

6 WHEREAS on May 16, 2011, the Mayor and Common Council approved a mandator
7 Crime-Free Rental Housing program and directed staff to establish fees to cover the cost of
8 administering the program; and
9 WHEREAS code enforcement and other staff is required to conduct inspections an
10 classes to implement the Crime Free Rental Housing program; and
11
WHEREAS the implementation of a crime-free rental housing program results in Lowe
12 maintenance costs and improved safety for tenants, property owners and the community;
13 WHEREAS the subject proposed fees and charges are exempt from the voter approval
4 requirements of Proposition 26 pursuant to Article XIII C, Section 1, subdivision (e)(2) and (3)

of the California Constitution.
16 NOW, THEREFORE, BE IT RESOLVED, FOUND AND DETERMINED B
17 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS
18 FOLLOWS:

SECTION 1. This Resolution contains fees that are subject to adoption and modification
20 pursuant to the provisions of California Government Code Section 66016 et seq.
21 A. A hearing has been held by the Mayor and Common Council pursuant to the
22 provisions of Government Code Section 66016 to consider the levy of new and additional fee
23 and services, which hearing was held following public notice published in a newspaper of
24 general circulation in the City of San Bernardino.
25 B. Neither of the proposed new or modified fees exceeds the actual cost of providing
26 such services, and for the service which is not completely paid for by the proposed fee, the
27 additional expense, if any, to the City of providing the services shall be borne by the genera
fund of the City of San Bernardino.

C. The proposed fees and charges are reasonable and necessary to enable the City o
San Bernardino to more nearly meet the actual costs of providing such services.
3 D. The adoption of this Resolution is exempt from the California Environmental
Quality Act because it approves fees for the purpose of meeting a portion of the operatin
expenses of the City as set forth in California Public Resources Code Section 21080(b)(8).
E. Pursuant to Government Code Section 66017(a), the fees established in thi
0 resolution, and elsewhere contained herein which are subject to the provisions of Governmen
7 Code Sections 66016 et seq., shall become effective 60 days following the effective date of this
8 resolution.

SECTION 2. The following schedule of fees shall be charged to all owners of multi
10 family residential rental properties for annual inspections pursuant to Chapter 15.27 of the Sa
1 1 Bernardino Municipal Code.
