Elimination and Restructuring of Certain Commissions
Background
Over the years, the Mayor and Common Council have adopted a number of resolutions
and ordinances related to the establishment of Boards and Commissions in addition to
those identified in the Charter. On October 18, 2004 the Mayor and Common Council
adopted an ordinance relative to abolishing certain Boards and Commissions which had
been inactive. On May 18, 2009, the Mayor and Common Council referred a
recommendation to transfer the duties of the Bureau of Franchises to the Police
Commission to the Legislative Review Committee for consideration.
At the March 2010 retreat, entitled "Building a Better Community," the Mayor and
Common Council defined a vision and identified a set of strategic goals to achieve that
vision. During this retreat, one of the strategic initiatives presented for consideration was
a Review of Boards and Commissions. The purpose of this initiative was to improve the
efficiency of Mayor and Common Council appointed Boards and Commissions. The
Mayor and Common Council held a workshop on April 26, 2011 to review the number,
roles, and responsibilities of the various Boards and Commissions and approved several
motions to consider amendments to the Municipal Code. On May 16, 2011, the attached
item recommending the implementation of a number of these changes was presented to
the Mayor and Common Council for consideration and, as there were some questions
regarding the provisions of the Resolution creating the Santa Ana River Trail Ad Hoc
Committee, the item was continued to June 6, 2011.
Staff from the City Manager's Office and the City Attorney's Office reviewed the
existing provisions of the Municipal Code related to the Santa Ana River Trail
Committee and consulted with the Committee's support personnel from the Mayor's
Office. As a result, the Resolution was revised to clarify that the Ad Hoc Committee will
consist of eight members, that each of the Council members and the Mayor will nominate
a member, and that the appointees are subject to the approval of the Common Council. In
addition, the Chairperson of the ad hoc committee shall appoint non-voting
representatives from the federal, state and county elected officials representing the Santa
Ana Trail region; from the City organization; and from stakeholder groups.

Financial Impact
There will be some savings to the City as a result of this action. As three of the
commissions recommended for elimination are either inactive or have served their
purpose, the City is not incurring any expenditures currently. There will be an annual
savings of approximately $8,400 related to the reduction of staff time, posting and
mailing costs associated with the elimination of the Cable Commission. The elimination
of the Santa Ana River Trail Commission from the Municipal Code and establishment of
a new Ad-Hoc Commission will be expenditure neutral.

4 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
5 THE CITY OF SAN BERNARDINO AS FOLLOWS:

SECTION 1. PURPOSE. It is the desire of the Mayor and Common Council to
7
establish an Ad Hoc Committee to implement the recommendations in the Santa Ana River
8
Trail Concept Plan and to ensure the public health, safety, and enjoyment of those persons using
9
the Santa Ana River Trail in the City of San Bernardino.
10
SECTION 2. MEMBERS-APPOINTMENT. The Santa Ana River Trail Ad Hoc
11
12 Committee of the City shall consist of eight (8) members that serve at the pleasure of the Mayor
13 and Common Council. Members shall be appointed on the basis of demonstrated knowledge
14 and experience with the Santa Ana River Trail, recognized dedication to the project, or a deep
15 interest in the City of San Bernardino section of the Santa Ana River Trail. The Mayor and
16 each of the seven Council Members shall nominate one (1) member that serves during the term
17 of their office. Those appointees shall be subject to the approval of the Common Council.

The Chairperson of the Santa Ana River Trail Ad Hoc Committee shall appoint
19
dedicated non-voting representatives that serve at the pleasure of the federal, state and county
20
elected officials representing the Santa Ana River Trail region. The Chairperson shall also
21
appoint dedicated non-voting representatives from the Mayor's Office, Economic Development
22
23 Agency, City Administration, Parks and Recreation, Police, Development, Fire, Animal Control
24 and the Public Services Departments to assist the Committee in the realization of the
25 recommendations in accordance with the Santa Ana River Trail Concept Plan and to ensure the

I public health, safety and enjoyment of those persons using the Santa Ana River Trail in the
2 City's jurisdiction.
3 The Chairperson shall also appoint dedicated non-voting representatives that include,

but are not limited to, representatives from the following stakeholder groups.

and Community Development Citizens Advisory Committee Members

• Former appointees of the Santa Ana River Trail Blue Ribbon Committee

13 SECTION 3. DUTIES. The Santa Ana River Trails Ad Hoc Committee shall:

A. Make recommendations to the Mayor and Common Council regarding the

development and promotion of the City of San Bernardino section of the Santa Ana River Trail

in accordance with the Santa Ana River Trail Concept Plan adopted by the Mayor and Common
17
Council on October 17, 2005. The Committee's formal recommendations shall be made at
18
19 meetings of the Mayor and Common Council as may be necessary to respond to time sensitive
20 opportunities.
21 B. Work with public and private cultural organizations to promote the
22 efficient utilization of community resources.
23 C. Review the financial needs of the Santa Ana River Trail and recommend grant
24 opportunities, benefactors or the resources that may be available to achieve the overall goals as
25 provided by the Santa Ana River Trail Concept Plan.

I D. Accomplish specific projects related to the Santa Ana River Trail Concept Plan.
2 SECTION 4. CHAIRPERSON - MEETINGS - ABSENCES. The Ad Hoc
3 Committee shall elect a Chairperson and a Vice-Chairperson from among its members and the
4
Chairperson and Vice-Chairperson shall serve a term of one year. The Ad Hoc Committee shall
5
meet as needed in the City Hall, San Bernardino, California, or such other place within the City
6
as the Ad Hoc Committee may select.
7
If a Committee member fails to attend three consecutive regular meetings without
8
9 excuse from the chairperson, which excuse must be obtained before or within five calendar days
10 after any meeting date, he or she shall automatically cease to be a member of the Ad Hoc
11 Committee and the chairperson shall notify the former member and the nominating official of
12 the declared vacancy. The vacant office shall be filled by nomination and appointment made in
13 the manner of the original appointment.
14 Meetings of the Santa Ana River Trail Ad Hoc Committee shall be open to the public
15 and shall be governed by the provisions of the Ralph M. Brown Act, Sections 54950.5, et seq.
16 California Government Code.

SECTION 5. CONFLICT OF INTEREST. The Mayor and Common Council
18
declare that the individuals appointed to the Santa Ana River Trail Ad Hoc Committee are
19
intended to represent and further the interests of all organizations and professions and that such
20
representation and furtherance serves the public interest.
21
22 SECTION 6. QUORUM. Any five members in attendance at any meeting shall
23 constitute a quorum. Except for public hearings (which shall not be conducted without
24 quorum), the Ad Hoc Committee may meet in the absence of a quorum as a committee of the
25 whole and recommend actions and propose resolutions which, if ratified at a subsequent meeting

l of the Committee at which a quorum is present, shall constitute the official action of the
Committee.

Background
Over the years, the Mayor and Common Council have adopted a number of resolutions

Mayor and Common Council held a workshop on April 26, 2011 to review the number,
roles, and responsibilities of the various Boards and Commissions and approved several
motions to consider amendments to the Municipal Code, including the following:
1. Eliminating Boards and Commission that have served their purpose or are
inactive. There are three commissions to be considered for elimination:
The Central City Parking Place Commission has been inactive for many
years. There is no longer a parking district tax and the debt service for the
bonds supported by that tax has been satisfied.
The Community Television Commission's function was impacted by the
State revising the cable franchising regulations. As the City no longer has
franchise rights over the cable industry, there is no longer a regulatory role
for this Commission.
The Youth Advisory Commission has been inactive for some time; however,
each Recreation Center has a Teen Club that provides input on programs and
activities. The Parks and Recreation Department recommends continuing to
work with the Teen Clubs and to schedule an annual presentation by these
clubs on Youth Issues to the Parks and Recreation Commission. Further, the

scope of the responsibilities of the Human Relations Commission includes a
youth element.
The implementation of the recommendations to eliminate these commissions
require an ordinance in order to repeal the related provisions of the Municipal
Code.
2. Amending the Structure of an Existing Commission
Given the nature and timing of the issues that are reviewed by the Santa Ana
River Trail Commission, the Mayor and Common Council approved a
motion to consider amending its structure to be an ad-hoc committee.
Implementing this change requires an ordinance repealing the provisions of
the Municipal Code relative to the commission and a resolution establishing
the Santa Ana River Trail Ad-Hoc Commission.
In addition to these changes to the Boards and Commissions, at the meeting of April 26,
the Mayor and Common Council directed staff to initiate the actions necessary for
establishing a Public Safety Commission by combining a number of existing
commissions. A team of staff members from the various affected departments is in the
process of designing a transition plan for this project, which will involve input from the
members of the existing commissions. The recommendations and options related to the
Public Safety Commission will be presented to the Mayor and Common Council at a later
date.

Meetings of the Santa Ana River Trail Ad Hoc Committee shall be open to the public

and shall be governed by the provisions of the Ralph M. Brown Act, Sections 54950.5, et seq.

California Government Code.

21 SECTION 5. CONFLICT OF INTEREST. The Mayor and Common Council
22 declare that the individuals appointed to the Santa Ana River Trail Ad Hoc Committee are
23 intended to represent and further the interests of all organizations and professions and that such
24 representation and furtherance serves the public interest.

1 SECTION 6. QUORUM. Any five members in attendance at any meeting shall
2 constitute a quorum. Except for public hearings (which shall not be conducted without
3 quorum), the Ad Hoc Committee may meet in the absence of a quorum as a committee of the

whole and recommend actions and propose resolutions which, if ratified at a subsequent meeting
5
of the Committee at which a quorum is present, shall constitute the official action of the

Committee.

Elimination and Restructuring of Certain Commissions
Background
Over the years, the Mayor and Common Council have adopted a number of resolutions
and ordinances related to the establishment of Boards and Commissions in addition to
those identified in the Charter. On October 18, 2004 the Mayor and Common Council
adopted an ordinance relative to abolishing certain Boards and Commissions which had
been inactive. On May 18, 2009, the Mayor and Common Council referred a
recommendation to transfer the duties of the Bureau of Franchises to the Police
Commission to the Legislative Review Committee for consideration.
At the March 2010 retreat, entitled "Building a Better Community," the Mayor and
Common Council defined a vision and identified a set of strategic goals to achieve that
vision. During this retreat, one of the strategic initiatives presented for consideration was
a Review of Boards and Commissions. The purpose of this initiative was to improve the
efficiency of Mayor and Common Council appointed Boards and Commissions. The
Mayor and Common Council held a workshop on April 26, 2011 to review the number,
roles, and responsibilities of the various Boards and Commissions and approved several
motions to consider amendments to the Municipal Code, including the following:
1. Eliminating Boards and Commission that have served their purpose or are
inactive. There are three commissions to be considered for elimination:
The Central City Parking Place Commission has been inactive for many
years. There is no longer a parking district tax and the debt service for the
bonds supported by that tax has been satisfied.
The Community Television Commission's function was impacted by the
State revising the cable franchising regulations. As the City no longer has
franchise rights over the cable industry, there is no longer a regulatory role
for this Commission.
The Youth Advisory Commission has been inactive for some time; however,
each Recreation Center has a Teen Club that provides input on programs and
activities. The Parks and Recreation Department recommends continuing to
work with the Teen Clubs and to schedule an annual presentation by these
clubs on Youth Issues to the Parks and Recreation Commission. Further, the

scope of the responsibilities of the Human Relations Commission includes a
youth element.
The implementation of the recommendations to eliminate these commissions
require an ordinance in order to repeal the related provisions of the Municipal
Code.
2. Amending the Structure of an Existing Commission
Given the nature and timing of the issues that are reviewed by the Santa Ana
River Trail Commission, the Mayor and Common Council approved a
motion to consider amending its structure to be an ad-hoc committee.
Implementing this change requires an ordinance repealing the provisions of
the Municipal Code relative to the commission and a resolution establishing
the Santa Ana River Trail Ad-Hoc Commission.
In addition to these changes to the Boards and Commissions, at the meeting of April 26,
the Mayor and Common Council directed staff to initiate the actions necessary for
establishing a Public Safety Commission by combining a number of existing
commissions. A team of staff members from the various affected departments is in the
process of designing a transition plan for this project, which will involve input from the
members of the existing commissions. The recommendations and options related to the
Public Safety Commission will be presented to the Mayor and Common Council at a later
date.
Financial Impact
There will be some savings to the City as a result of this action. As three of the
commissions recommended for elimination are either inactive or have served their
purpose, the City is not incurring any expenditures currently. There will be an annual
savings of approximately $8,400 related to the reduction of staff time, posting and
mailing costs associated with the elimination of the Cable Commission. The elimination
of the Santa Ana River Trail Commission from the Municipal Code and establishment of
a new Ad-Hoc Commission will be expenditure neutral.
