MCC/2011-44 On April 21, 2011, the Redevelopment Committee Members Brinker, Johnson and Marquez unanimously recommended that the Mayor and Common Council confirm the election procedures and results of the Election of the Project Area Committee for the proposed Merged and Amended and Restated Redevelopment Plan for the Proposed San Bernardino Merged Redevelopment Project Area B and Added Areas. ------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------------ P:\Agendas\Comm Dev Commission\CDC 2011\05-16-11 Merger Area B-PAC Election SR.docx COMMISSION MEETING AGENDA Meeting Date: 05/16/2011 Agenda Item Number: /�� ECONOMIC DEVELOPMENT AGENCY STAFF REPORT ELECTION OF THE PROJECT AREA COMMITTEE FOR THE MERGED, AMENDED, AND RESTATED REDEVELOPMENT PLAN FOR THE PROPOSED SAN BERNARDINO MERGED REDEVELOPMENT PROJECT AREA B (STATE COLLEGE, CENTRAL CITY WEST, NORTHWEST, UPTOWN, MOUNT VERNON CORRIDOR, 40TH STREET) AND ADDED AREAS BACKGROUND: Since August 2010, Staff of the Redevelopment Agency of the City of San Bernardino ("Agency") has been working to prepare the necessary surveys, analysis, plan and environmental documentation for the proposed redevelopment project area merger and amendments for the State College, Central City West, Northwest, Uptown, Mount Vernon Corridor and 40th Street Redevelopment Project Areas (collectively the "Merged Area B"). Two of the proposed amendments would be to: • Add approximately 660 acres in fourteen (14) non contiguous sub-areas to Merged Area B for the purpose of eliminating blighting conditions that exist in the territories proposed to be added (proposed"Added Areas"). • Extend or re-instate the power of eminent domain within five (5) of the redevelopment project areas and the proposed added territories for 12 years from the effective date of the adopting ordinance excluding all owner occupied single family homes from such authority. The proposed amendments above require the formation and establishment of a Project Area Committee ("PAC") to consider the proposed merger and amendments for Merged Area B. The formation of a PAC for the Proposed Merged Area B does not create a redevelopment project area or amend one. The PAC would serve in an advisory capacity to the Mayor and Common Council of the City of San Bernardino ("Mayor and Common Council") and the Agency on the aspects of the proposed amendments as outlined in the California Community Redevelopment Law, Health and Safety Code Section 33000, et seq. ("CRL"). The PAC typically serves a three-year term after the adoption of the amendment to the Redevelopment Plan, subject to a one-year extension if granted by the Common Council. In February 2011, the Mayor and Common Council ("Common Council") adopted procedures for the formation of a PAC for Merged Area B. The PAC will consist of 14 members, of which two individuals were appointed from the Northwest Redevelopment Project PAC (Curtis Stout, Randolph Riley). On two separate occasions, March 15, 2011, and March 22, 2011, Agency Staff held a Merged Area B — PAC Information Meeting. The meetings were held to inform the public about the proposed redevelopment project,the proposed amendments and the required formation of a PAC. The Election was observed by Rachel Clark and Mayra Ochiqui, from the City of San Bernardino Clerk's Office. The following individuals were elected in the following categories: Existing Project Areas Residential Owner-Occupant Raye Sanchez Louise "Bonnie" Charlton Added Areas Residential Owner-Occupant Claudia Rodriguez Paul Guerrero Residential Tenant Gregory Jones Because Section 400 of the PAC Procedures allows the PAC to proceed with seven (7) members consisting of the appointed members and the elected members, the next phase of the merger and amendment can move forward. It should be noted that at the first Merged Area B PAC meeting, Agency Staff will ask the PAC to consider appointing additional PAC members for support and community participation to fill the remaining seven(7)positions by category as required by the CRL. Section 33385 of the CRL, provides that the Common Council shall adopt a finding that all adopted procedures for the formation and election of the PAC for the Project Area were followed in the election of the PAC and determine the validity of all challenges within 30 days following the PAC election. The law also requires that a challenge to the PAC election or the electoral process must be filed with the Common Council no more than 15 calendar days after the PAC election. The procedures for the formation and election of the Merged Area B PAC were followed in accordance with the resolution adopted by the Common Council on February 22, 2011. No challenges to the PAC election or the electoral process have been received to date. The attached resolution is scheduled to be considered by the Common Council on May 16'2011, after the time for challenge has passed. ENVIRONMENTAL IMPACT: The formation and election of a PAC do not meet the definition of a"project" under Section 15378 of the California Environmental Quality Act (CEQA). A listing of the Project Area Committee election results is attached hereto as Exhibit "A" 21 and each such person is hereby recognized and declared by the Common Council to be a member 22 of the Merged Area B Project Area Committee.
