Mayor and Common Council and the Community Development Commission consider the approval of Professional Services
Agreements by and between the Agency and the Rosenow Spevacek Group, Inc. and RBF Consulting, to provide Consultant
Services in connection with the preparation of Redevelopment Plan and Environmental documentation for the proposed Area B
West Project Areas Merger and Plan Amendments (State College, Central City West, Northwest, Uptown, Mt. Vernon
Corridor and 40th Street Redevelopment Project Areas)
On June 7, 2010, the Community Development Commission of the City of San Bernardino approving and authorizing the
Interim Executive Director of the Redevelopment Agency of the City of San Bernardino("Agency")to execute a Professional
Services Agreements by and between the Agency and the Rosenow Spevacek Group, Inc., and RBF Consulting, to provide
Consultant Services in connection with merging and amending certain redevelopment project areas and environmental
document preparation for the proposed Area B West Project Areas Merger and Plan Amendments(State College, Central City

On July 8, 2010, Redevelopment Committee Members Johnson, Marquez and Brinker unanimously
recommended that the Mayor and Common Council consider the designation of the San Bernardino
Redevelopment Survey Area for redevelopment project study purposes
On August 16, 2010, the Mayor and Common Council of the City of San Bernardino designated the San
Bernardino Redevelopment Survey Area for Project Study Purposes. MCC/2010-290
On September 9, 2010, Redevelopment Committee Members Johnson, Brinker and Marquez unanimously
recommended that the Community Development Commission consider approval to amend the current
Professional Services Agreement by and between the Agency and the Rosenow Spevacek Group for
additional tasks related to the Merged Area B Merger and Amendment Project.
On September 9, 2010, the Redevelopment Committee Members Johnson, Marquez and Brinker
unanimously recommended that the Community Development Commission and the Mayor and Common
Council approval of the proposed annexed areas to the Merged Area B Merger and Amendment
Redevelopment Project Area.
On November 1, 2010, of the Community Development Commission of the City of San Bernardino
approving and authorizing the Interim Executive Director of the Redevelopment Agency of the City of San
Bernardino ("Agency") to execute Amendment No. 1 to the Agreement for Professional Services by and

ELECTION OF THE PROJECT AREA COMMITTEE FOR THE MERGED,
AMENDED, AND RESTATED REDEVELOPMENT PLAN FOR THE PROPOSED
SAN BERNARDINO MERGED REDEVELOPMENT PROJECT AREA B (STATE
COLLEGE, CENTRAL CITY WEST, NORTHWEST, UPTOWN, MOUNT VERNON
CORRIDOR, 40TH STREET) AND ADDED AREAS
BACKGROUND:
Since August 2010, Staff of the Redevelopment Agency of the City of San Bernardino ("Agency") has
been working to prepare the necessary surveys, analysis, plan and environmental documentation for
the proposed redevelopment project area merger and amendments for the State College, Central City
West, Northwest, Uptown, Mount Vernon Corridor and 40th Street Redevelopment Project Areas
(collectively the "Merged Area B"). Two of the proposed amendments would be to:
• Add approximately 660 acres in fourteen (14) non contiguous sub-areas to Merged Area B for the
purpose of eliminating blighting conditions that exist in the territories proposed to be added
(proposed"Added Areas").
• Extend or re-instate the power of eminent domain within five (5) of the redevelopment project
areas and the proposed added territories for 12 years from the effective date of the adopting
ordinance excluding all owner occupied single family homes from such authority.
The proposed amendments above require the formation and establishment of a Project Area Committee
("PAC") to consider the proposed merger and amendments for Merged Area B. The formation of a
PAC for the Proposed Merged Area B does not create a redevelopment project area or amend one. The
PAC would serve in an advisory capacity to the Mayor and Common Council of the City of San
Bernardino ("Mayor and Common Council") and the Agency on the aspects of the proposed
amendments as outlined in the California Community Redevelopment Law, Health and Safety Code
Section 33000, et seq. ("CRL"). The PAC typically serves a three-year term after the adoption of the
amendment to the Redevelopment Plan, subject to a one-year extension if granted by the Common
Council.
In February 2011, the Mayor and Common Council ("Common Council") adopted procedures for the
formation of a PAC for Merged Area B. The PAC will consist of 14 members, of which two
individuals were appointed from the Northwest Redevelopment Project PAC (Curtis Stout, Randolph
Riley).
On two separate occasions, March 15, 2011, and March 22, 2011, Agency Staff held a Merged Area B
— PAC Information Meeting. The meetings were held to inform the public about the proposed
redevelopment project,the proposed amendments and the required formation of a PAC. Both meetings
were well attended, including participation from Councilmember Virginia Marquez, Ward 1.

CURRENT ISSUE:
The CRL requires that the Merged Area B PAC be an elected body comprised of Residential Owner-
Occupants, Residential Tenant, Business Owners (including Property Owners) and Existing
Community Organizations within the Project Area. The Merged Area B PAC will be comprised of
fourteen(14)members, including the number of representatives in each of the following categories:

On April 5, 2011, the Merged Area B PAC Election was held in accordance with the adopted PAC
Election Procedures for Merged Area B. In accordance with the Procedures, seven (7) pre-qualified
candidates sought board membership within the following (PAC) categories:

Those in attendance elected five individuals to participate on the Merged Area B PAC, two from the
Existing Areas and three from the Added Areas. The Election was observed by Rachel Clark and
Mayra Ochiqui, from the City of San Bernardino Clerk's Office. The following individuals were
elected in the following categories:

Because Section 400 of the PAC Procedures allows the PAC to proceed with seven (7) members
consisting of the appointed members and the elected members, the next phase of the merger and
amendment can move forward. It should be noted that at the first Merged Area B PAC meeting,
Agency Staff will ask the PAC to consider appointing additional PAC members for support and
community participation to fill the remaining seven(7)positions by category as required by the CRL.
Section 33385 of the CRL, provides that the Common Council shall adopt a finding that all adopted
procedures for the formation and election of the PAC for the Project Area were followed in the
election of the PAC and determine the validity of all challenges within 30 days following the PAC
election. The law also requires that a challenge to the PAC election or the electoral process must be
filed with the Common Council no more than 15 calendar days after the PAC election. The procedures
for the formation and election of the Merged Area B PAC were followed in accordance with the
resolution adopted by the Common Council on February 22, 2011. No challenges to the PAC election
or the electoral process have been received to date. The attached resolution is scheduled to be
considered by the Common Council on May 16'2011, after the time for challenge has passed.
ENVIRONMENTAL IMPACT:
The formation and election of a PAC do not meet the definition of a"project" under Section 15378 of
the California Environmental Quality Act (CEQA). It should be noted that the added areas will be
considered and analyzed as part of the Program Environmental Impact Report for the proposed Merged
Area B.

FISCAL IMPACT:
There are no fiscal impacts to the Agency at this time; a contract was previously approved with RSG
and RBF Consulting for all consultant costs associated with Merged Area B, as part of the approved
Redevelopment Agency FY 2009-2010 Budget and FY 2010-2011 Budget.
RECOMMENDATION:
That the Mayor and Common Council adopt the attached Resolution.

8 WHEREAS, the City of San Bernardino, California (the "City"), is a municipal corporation
9 and a charter city duly created and existing pursuant to the Constitution and the laws of the State of
10 California; and
11 WHEREAS, the Mayor and Common Council of the City of San Bernardino ("Common
12 Council") adopted Resolution No. 2011-44 on February 22, 2011, thereby approving the
13 Procedures for the Formation and Election for the Merged, Amended, and Restated Redevelopment
14 Plan for the proposed San Bernardino Merged Redevelopment Project Area B (State College,
15 Central City West, Northwest, Uptown, Mount Vernon Corridor, 40th Street) and Added Areas
16 ("Procedures") calling upon any or all residential owner-occupants, residential tenants, community
17 organizations, and business owners (including property owners) within the proposed San
i8 Bernardino Merged Redevelopment Project Area B (State College, Central City West, Northwest,
19 Uptown, Mount Vernon Corridor, 401h Street) and Added Areas ("Merged Area B") to form a
20 Project Area Committee ("PAC")to consider the proposed Merger and Amendments; and
21 WHEREAS, Agency Staff on two separate occasions, March 15, 2011, and March 22,
22 2011, conducted a Merged Area B — PAC Information Meeting to inform the public about the
23 proposed redevelopment project, the proposed merger and amendment process and the required
24 formation of a PAC as well as accept applications from those persons interested in serving on the
25 PAC; and
26 WHEREAS, on April 5, 2011, the Merged Area B PAC Election was held in accordance
27 with the adopted PAC Election Procedures for Merged Area B; and

16 1 WHEREAS, the Procedures adopted by the Common Council were followed in the PAC
2 election; and
3 WHEREAS, Section 33385(d) of the Redevelopment Law (Health & Safety Code Section
4 33000, et seq.) provides that a challenge to the PAC election or the electoral process followed in
5 connection with the PAC election must be filed with the Common Council no more than 15
6 calendar days after the PAC election and further provides that the Common Council shall consider
7 all challenges within 30 days following the PAC election; and
8 WHEREAS, no challenges to the PAC election or the electoral process have been received.
9 NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED BY
10 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, AS
11 FOLLOWS:
12 Section 1. The Mayor and Common Council hereby acknowledge the results of the
13 election of PAC members for the proposed San Bernardino Merged Redevelopment Project Area B
14 (State College, Central City West, Northwest, Uptown, Mount Vernon Corridor, 40th Street) and
15 Added Areas ("Merged Area B") and find and determine that (i) no challenges to the election of the
16 Project Area Committee or to electoral procedures were filed with the Common Council; and (ii)
17 all of the "Procedures for the Formation and Election of a Project Area Committee" for the
18 proposed Merged Area B which were adopted by the Common Council on February 22, 2011 were
19 followed in connection with the election of the Project Area Committee which was held on April 5,
20 2011. A listing of the Project Area Committee election results is attached hereto as Exhibit "A"
21 and each such person is hereby recognized and declared by the Common Council to be a member
22 of the Merged Area B Project Area Committee. The Mayor and Common Council further confirm
23 the process to allow the Northwest Redevelopment Project Area Committee (the "Northwest
24 PAC"), a duly elected Project Area Committee, to appoint two (2) representatives of the Northwest
25 PAC to serve on the Merged Area B PAC, and that such process provides adequate representation
26 of residential owner-occupants, residential tenants, community organizations, and business owners
27 (including property owners) within the Northwest Redevelopment Project Area as to the Merged
28 Area B.

1 Section 2. This Resolution shall take effect upon its adoption and execution in the manner
2 as required by the City Charter.
