Resolution awarding a contract to Elite Companies US, Inc. for Pavement Rehabilitation on
Rialto Avenue from Lena Road to Tippecanoe Avenue (SS06-044), per Project Plan No.
12283B.
Background:
On June 28, 2010, the Mayor and Common Council approved the FY 2009-10 Capital
Improvement Program (CIP) and $514,000 was budgeted in FY 2010/11 for Project No. SW08-
05 for sewer improvements on Rialto Avenue from Lena Road to Tippecanoe Avenue. The first
phase of the project involved construction of the sewer main and laterals, which is currently
underway. This project provides the final phase of pavement rehabilitation.
Local advertising included the San Bernardino County Sun Newspaper, F. W. Dodge Company
(Rancho Cucamonga and Monrovia), High Desert Plan Room, Construction Bid Board, San
Diego Daily Transcript, Bid America Electronic, AGC Plan Room/The Daily Construction
Reporter, Reed Construction Data, Construction Bid Source, Bid Ocean, and with the San
Bernardino Area Chamber of Commerce. As well, information was posted on the City's website.
A total of nine bids were received and are listed below:

After a complete review of the nine sealed competitive bids and verification of mathematical
calculations and certifications, staff has determined that Elite Companies US, Inc. of Huntington
Beach is the apparent low bidder, has met the minimum requirements of the specifications and
bid guidelines, and is recommended. If approved, this project is expected to begin construction
in late June of 2011 and be completed by August 2011. The estimated project costs are as
follows:

RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
3 BERNARDINO AWARDING A CONTRACT TO ELITE COMPANIES US, INC. FOR

6 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:

8 SECTION 1. Elite Companies US, Inc., 15321 La Salle Lane, Huntington Beach, CA
9 92647, is the lowest responsible bidder for Pavement Rehabilitation on Rialto Avenue from
10 Lena Road to Tippecanoe Avenue (SS06-044), per Project Plan No. 12283B. A contract is
11 awarded accordingly to said bidder in a total amount of $109,705.65, with a contingency
12 amount of$16,500.35, but such contract shall be effective only upon being fully executed by
13 both parties. All other bids, therefore, are hereby rejected. The City Manager is hereby
14
authorized and directed to execute said contract on behalf of the City; a copy of the contract is
15
16 on file in the office of the City Clerk and incorporated herein by reference as fully as though set
forth at length.

18 SECTION 2. This contract and any amendment or modifications thereto shall not take
19 effect or become operative until fully signed and executed by the parties and no party shall be
20 obligated hereunder until the time of such full execution. No oral agreements, amendments,
21 modifications or waivers are intended or authorized and shall not be implied from any act or
22 course of conduct of any party.
23 SECTION 3. The authorization to execute this resolution is rescinded if the parties to
24 the contract fail to execute it within sixty(60)days of passage of this resolution.
