SUBJECT:
Appeal of Planning Commission's Denial of Conditional Use
Permit No. 88-42
REQUEST:
That the Mayor and Common Council approve of Conditional Use
Permit No. 88-42 for the off-site sale of beer and wine in a
mini-market at Foothill Meridian Plaza.
BACKGROUND:
The applicant is requesting approval of a Conditional Use
Permit for the off-site sale of beer and wine in a 3,000
square foot mini-market located at the southwest corner of
Foothill Boulevard and Meridian Avenue at 2775 West Foothill
Boulevard on a 3.7 acre site.
The proposed use is permitted in the C-3A district subject to
approval of a Conditional Use Permit. The proposal is also
consistent with the Interim Policy Document land use
designation of CG - General Commercial, and is categorically
exempt from the requirements of CEQA.
The 3,000 square foot mini-market was approved under
Conditional Use Permit No. 85-15 by the Planning Commission
on June 4, 1985. The site plan for the retail center was
approved as Review of Plans No. 87-36 by the Development
Review Committee on April 30, 1987.
The application for Conditional Use Permit No. 87-42 was
considered by the Planning commission on September 20, 1988.
At the Commission hearing, testimony was given by neighboring
landowners and the Police Department against the application.
A major concern was the negative effect the outlet might have
on Nicholson City Park, between Court and Second Streets.
This park is heavily utilized and is a concentrated crime
site, many of which are alcohol related. The police
contacted eight persons behind the site and no one was in
favor. The police also testified that eight out of eleven
persons contacted in the neighboring mobile home park were
against the issuance of the Conditional Use Permit. After the
testimony, the Commission voted 3 to 3 for denial, and the
application was effectively denied. The Planning
Department's staff recommendation to the Commission was for
denial.
OPTIONS:
The Mayor and Council may deny the appeal and deny
Conditional Use Permit No. 88-42 or uphold the appeal,
approve Conditional Use Permit No. 88-42, and adopt the
appropriate findings of fact and conditions of approval to be
prepared by the Planning staff.

1 . REQUEST

the sale of beer and wine for off-site consumption in a
3,000 square foot market.
2 . LOCATION
The market will be located in an existing commercial center
at the southwest corner of Foothill Boulevard and Meridian
Avenue at 2775 West Foothill Boulevard on a 3.7 acre site.
3. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed use is permitted in the C-3A district subject
to approval of a Conditional Use Permit. The proposal is
also consistent with the Interim Policy Document adopted
by the City Council on May 23, 1988, amended June 6, 1988 and
approved by the State Office of Planning and Research on
June 9, 1988. (See Attachment "A".)
4 . CEQA
The project is categorically exempt from the requirements
of the California Environmental Quality Act (Section 15301).
5. BACKGROUND
The 3,000 square foot market is located in an existing
commercial center which includes retail shops and mini
storage units. This project was approved under Conditional
Use Permit No. 85-15 by the Planning Commission on June 4,
1985. The site plan for the retail center was revised under
Review of Plans No. 87-36 and approved by the Development
Review Committee on April 30, 1987.
6. ANALYSIS
Details of Business Operations
The market will offer items which will include soft drinks,
impulse items (candy, gum, ice~, etc.) beer and wine,
and other items normally found in a convenience store. The

hours of operation will be from 7:00 a.m. to 9:00 p.m.
Monday through Thursday and 8:00 a.m. to 10:00 p.m. on Friday,
Saturday and Sunday. The market will employ four people.
The market will offer the sale of beer and wine only, no other
alcoholic beverages will be sold. The market will occupy the
north section of the building which has frontage on Foothill
Boulevard.
Traffic, Parking, Circulation
Traffic, parking and circulation were addressed during Review
of Plans No. 87-36 and Conditional Use Permit No. 85-15. The
market is a retail use permitted in the center which was
designed to accommodate retail uses.
General Vicinity
The general vicinity includes retail uses to the north, com-
mercial offices to the west, a mobile home park to the
east and single family homes to the south. The mobile home
park and residential area are located within 500 feet of the
proposed market. Nicholson Park is located approximately
1/10th of a mile to the south. No churches, schools or
hospitals were observed in the immediate vicinity. Two
alcohol outlets are also located near the proposed location.
A 7-11 is located one block away at the southwest corner of
Foothill Avenue and Pepper. A liquor store is located just
east of the northeast corner of Foothill and Meridian.
The market with off-site sale of beer and wine is compatible
with the surrounding commercial uses. Although there are other
alcohol outlets in the general vicinity, the area is not
saturated with a large number of outlets in close proximity.
According to the Police Department, there is not an over
concentration of alcohol licenses in the census tract. How-
ever, with residences located within a 500 foot radius, and a
park within l/lOth of a mile, an alcohol outlet is not com-
patible with the general vicinity.
Findings Discussion
In order to recommend approval for this Conditional Use
Permit, staff must find that there will be no detrimental
effect on nearby residentially-zoned neighborhood considering
the distance of alcohol outlet to residential buildings and
parks. Since homes and a park are located in such close proxi-
mity to the site of the proposed outlet, this finding cannot
be made.

7. AGENCY COMMENTS
The Police Department has concerns about a Conditional Use
Permit going in at this location. They have stated that the
area does not have a very high crime rate and that the census
tract permits two additional licenses. The police concerns
are with the residential areas in such close proximity and
Nicholson Park, one block away. The park has a history of
narcotic sales and use. Lt. Curtis, the area commander, is
not in favor of this Conditional Use Permit and believes that
the consumption of alcohol will increase at this park.. He
has added a list of conditions he would like to see if the
Conditional Use Permit was approved. (See Attachment "C".)
The Parks Department is recommending denial due to the
location of the park, one block away and the possibility of
increase alcohol consumption at the park. (Attachment "0".)
8. CONCLUSION
The size and shape of the parcel are adequate to accommodate
the proposed use and is consistent with the Municipal Code
and the Interim Policy Document. While the use is compatible
with the surrounding commercial uses, it is not compatible
with the adjacent mobile home park and single family homes to
the south. The proximity of a park, one block to the south
could result in increased alcohol consumption as a result
of the store. Staff cannot make the finding that there will
be no detrimental effect considering the distance of the
alcohol outlet to the residential uses and the park.
9. RECOMMENDATION
Staff recommends that the Planning Commission deny Conditional
Use Permit No. 88-42 based on the attached Findings of Fact.

1. The proposed use conforms to the objects of the City's
General Plan in that the Conditional Use Permit is consistent
with the Interim Policy Document adopted by the Mayor and
Council on May 23, 1988, amended June 6, 1988 and August 1,
1988 and approved by the State Office of Planning and Research
on June 9, 1988.
2. The proposed use will adversely affect the adjoining land uses
and the growth and development of the area in which it is to
be located in that alcohol consumption could increase at the
park which is 1/10th of one mile south and this could create
adverse impacts on residential areas.
3. The size and shape of the site proposed for the use is adequate
to allow the full development of the proposed use in a manner not
detrimental to the particular area nor to the peace, health,
safety and general welfare in that the site has been reviewed
and approved for development and can accommodate the proposed
market with the sale of beer and wine.
4. The traffic generated by the proposed use will not impose an
undue burden upon the streets and highways designed and improved
to carry the traffic in the area, and that adequate parking
is provided in that traffic and parking were addressed during
the Review of Plans No. 87-36 and approved. This use will not
intensify the retail use which was presented.
5. The granting of the Conditional Use. Permit under the conditions
imposed may be detrimental to the peace, health and safety
and general welfare of the citizens of the City of San
Bernardino in that residential areas are located to the south
and east and a park is located to the south.
6. The introduction of alcoholic beverage sales at the proposed
location will pose significant impacts to the surrounding land
uses due to the proximity of a park and homes.
7. The introduction of alcoholic beverage sales at the proposed
location will not create an adverse impact on the surrounding
traffic pattern nor will a parking congestion be generated in
that the beer and wine sales does not intensify the retail
use which was considered in original approval of the center
where both traffic and parking were considered.

development which is consistent with the objectives of the
elements of the City's General Plan in that the proposed
use is consistent with the Interim Policy Document.

At 1000 hours, 8-31-88 I made contact with Lieutenant MIKE VISSER at
the Rialto Police Department. Lt. VISSER is the day shift watch commander.
I asked Lt. VISSER if he had any particular knowledge of alcohol related
violations at the 7-11 Store, southwest corner of Foothill and Pepper
and Brownie's Liquor Store, approximately five doors west of 7-11.
I advised him I was primarily interested in minors purchasing alcohol,
consumption of alcohol on the premises, littering, and loitering. I
told him that these two locations in Rialto were approximately two blocks
from a proposed off-sale Type 20 beer and wine license in the City of
San Bernardino at Foothill and Meridian. He related that neither the
7-11 nor Brownie's Liquor Store were any type of continual police problem
for Rialto PO, but that the 7-11 Store has their occasional grab-and-
runs for beer. He further indicated the CRIP gang members sometimes
congregate across the street at the Orange Bowl and that Rialto PO is
involved in running them out of this establishment on occasion. Lt.
VISSER could add nothing further concerning this subject.
At approximately 1315 hours, 9-1-88, I made phone contact with Lt. CURTIS,
the area commander for the 'c' Area where the proposed C.U.P. is located.
Lt. CURTIS was not in favor of another off-sale ABC license going in
this area. I advised him at this time we had zero complaints from any
neighbors to the new complex where the C.U.P. was to be located and
the crime stats for this reporting district are low. Lt. CURTIS stated
that if an off-sale ABC beer and wine license was to go in he desired
conditions. A few of those conditions consisted of no single unit cans
of beer be sold, no game machines to create an attractive nuisance and
of course, adequate lighting. His reasoning for the conditions on the
license and his not being in favor of the license at all are Nicholsen
Park which is located within 1/10 of a mile to the south of the proposed
location. Nicholsen Park is a park which is used year-round by area
youth for football, baseball, and there is also a youth center located
at the park. The park has a history as a gathering place for narcotic
sales and use. Lt. CURTIS believes the consumption of alcohol at this
park will increase with this ABC license, but would definitely increase
if single unit cans were sold in close proximity to the park.
A survey was conducted by Cpl GERALD JONES as to the acceptability of
an off-sale beer and wine license at this proposed location. The first
part of the survey covered the 2700 block of Court Street which is directly
south of the proposed location. Of eight people contacted all eight
stated they wanted no more liquor stored in the area. Cpl JONES also
interviewed several coaches in the mobile home park just east of the
proposed site. Out of eleven people contacted, eight desired no liquor
sales, two were undecided, and one stated yes, that he wanted the sales

of beer and wine at this location.
Due to potential police problems with the issuance of this ABC off-sale
license, the close proximity of the city park, and the desires of the
COP Commander, Lt. CURTIS~ the following is a list of conditions requested
by the Police Department if there is an issuance of a conditional use
permit at this location.
1. No!malt beverage products shall be sold in less than six pack
quantities per sale.
2. No coin operated amusement devices shall be maintained on the license
premises.
3. No alcoholic beverages shall be consummed on any property adjacent
to the license premises under control of the licensee.
4. No wine shall be sold in containers of less than 750ml.
5. All ice shall be sold at or about prevai~ing prices in the area
and in quantities of not less than five pounds per sale.
