lent to the storm drainage fees collected from Tract No.
13,457, be allocated in the 1989/90 Storm Drain Construc-
tion Fund as a contribution to Joint Community Facilities
District.
Recommended motion:
That an amount equivalent to the storm drain fees col-
lected from Tract No. 13,457, be allocated in the 1989/90
Storm Drain Construction Fund Budget, to be applied to
the portion of the cost for constructing Phase II of the
Citrus Avenue Storm Drain assessed to the 208 lots of
Tract No. 13,457 within the City of San Bernardino, in
order to reduce their special tax from the maximum esti-
mated amount of $661.00 per lot for FY 1988-

STAFF REPORT
Tract No. 13,457 is a 208-lot subdivision, north of Colton
City Limits. The prevailing grade is to the south, so all storm
waters from this tract drain into the City of Colton.
Concern has been expressed in the past by Colton relative
to increased flows creating flooding problems. A plan has been
developed to construct the Citrus Avenue Storm Drain, in order to
alleviate flooding in this portion of Colton. Copies of the pre-
liminary estimate of cost, and source of funds, of this storm drain
are attached for reference.
The preliminary source of funds showed the storm drain fees
of $70,200, to be collected from this tract, being contributed to
the district. This estimate was based upon the fees in effect at
that time. Our storm drain fees have since been increased, and the
new estimate of storm drain fees to be collected is $140,400.
Lots within Tract No. 13,457 will have a maximum special
tax in 1988/89 F.Y. of $661 per dwelling unit, but not less than
$2,644 per acre. Allocation of $70,200 to the district will serve
to reduce the special tax paid by residents in San Bernardino.
Residents of the tract in Colton will pay a maximum special tax of
$759 per dwelling unit, but not less than $2,644 per acre, since
other items will be provided for their area.
A letter, dated 10-7-88, has been received from Mayor Frank
A. Gonzales requesting that all storm drainage fees collected be
used to offset the cost incurred by the district for construction
of Phase II of the services district. This request is based upon
the fact that all storm water from this tract will drain to the City
of Colton, and be conveyed to Lytle Creek Channel by the Citrus
Street Storm Drain.
The recommended form motion will direct that the amount of
storm drainage fees collected be allocated in the 1989/90 Storm
Drain Construction Fund Budget to be applied toward the cost for
Phase II of the Citrus Street Storm Drain assessed to the 208 lots
in the City of San Bernardino.

Dear Honorable Mayor and City Council Members:
As you are aware, our Cities have entered into a joint powers
agreement to construct a major storm drain system along Citrus
Street in the vicinity of Meridian and Laurel Streets. This
system will provide drainage capacity for the Forecast Mortgage
Company development, Tract 13457 which is within the boundaries
of the City of San Bernardino. It is my understanding that this
facility will provide for all of the drainage needs for Tract
13457, and that there will be no spill-over into any San Bernardino
drainage facility.
The cost of our joint project, estimated to be $2.6 million, will
be funded through a Mello-Roos Community Facilities District.
San Bernardino residents within the district will pay a special
tax which may not exceed $759.00 during the initial year. The
City of Colton is hereby requesting, on behalf of the district,
the pass thru of any drainage fees which the City of San Bernardino
will be collecting from the developer. Since the district will
fund the total cost of any and all drainage facilities required
by Tract 13457, we feel that monies collected for drainage
proposed should go to offset the cost incurred by the district
to provide these facilities. Funds received will be deposited
in the district's special fund and will be used to reduce the
special tax paid by district residents.
I have requested that this item be placed on your City'S Council
agenda. We appreciate your consideration of this matter. If

TENTATIVE TRACTS 13451-13462
CITY OF COLTON AND CITY OF SAN BERNARDINO
SEQUENCE OF EVENTS - CITRUS AVENUE STORM DRAIN AND DEVELOPMENT OF PROJECTS
1. Forecast to start construction of storm drain from the channel
to Eighth Street as quick as possible. (Phase IA)
2. Forecast to have storm drain plans prepared and submitted for
approval from Pennsylvania to the project.
3. City of Colton, City of San Bernardino to obtain necessary
resolutions to authorize the formation of an Assessment Dist.
This should include an agreement with the City of San Bernardino
to allocate their storm drain fees to the City of Colton.
(Bond Consultant Team: Miller and Schroder, Mackenzie Brown
and Wildan Engineering) (This may best be an acquisition type
of Bond Program)
4. Forecast to submit tentative maps for approval in both city's.
(To be conditioned on the formation of an Assessment District)
5. Forecast to start Phase IB and Phase II storm drain construction
at such time as the City of Colton and San Bernardino has agreed
to form an Assessment District and all plans have been approved
by the City of Colton.
6. Forecast shall proceed with the tract final engineering, obtain
approval and record final subdivision maps.
7. Forecast to start tract construction on the San Bernardino tract
with the grading of a storm runoff detention basin to control
drainage until the Citrus Avenue storm drain is complete.
8. At such time as the storm drain is complete Forecast shall start
tract construction or the tracts located in the City of Colton.
9. At the time the storm drain is complete the City of Colton
shall authorize the sale of the bonds and reimburse Forecast
for construction expenditures. This district must be formed
and bonds sold prior to the close of escrow on the first unit
in any tract home in either city.
