Synopsis of Previous Council action:
At the September 2, 1988 Board of Building Commissioners Meeting, the Board
heard testimony regarding the property located at 125 East Ninth Street, in
which the Board adopted a Resolution that required the Owner to obtain a
rehabilitation permit within ten (10) days and complete the rehabilitation
work within thirty (30) days; or demolish structure and clean lot; and incur
all current and future costs in the form of a lien on the property.

This case comes before
after eleven (11) months of

The involvement began in late November of 1987, after
receiving a complaint of trash, debris and a fire hazard that
existed on this property. The complaint was confirmed and
the owner of the property was notified of the violations.
The owner, at that time, indicated that they would make
the necessary corrections; however, n2 positive steps were
taken to correct this situation and the City had to clean the
property of the trash and debris. In an effort to mitigate a
portion of the problem, this action was taken in March of
1988.
Being that it was obvious that the owner(s) were not
going to take care of the remaining problems, staff proceeded
to prepare a case and bring this matter before the Board of
Building Commissioners.
In August of 1988, the Notice of Hearing was sent to the
new owner (Mr. Solomon o. Saddi - 1605 West Olympic Boulevard
Los Angeles, california) indicating the date and time of the
hearing.
On September 2, 1988, this case was heard in the
presence of Mr. Saddi, and after hearing testimony from Mr.
Saddi, the Board passed a resolution that required the owner
to obtain a rehabilitation permit within ten (10) days and
complete the work in thirty (30) days; or demolish all
structures and clean the lot; and incur all present and
future costs in the form of a lien on the property.
Mr. Saddi took exception to this rUling, claiming that
he was unaware that there was a problem with the property,
despite the fact that at the time he was being questioned by
the Board, he stated that he did examine the property prior
to sale.
Mr. Saddi filed an Appeal of the Board of Building
commissioners' decision on september 15, 1988.

Pursuant to action of the Board of Building Commissioners taken on September 2, 1988
a nuisance was found to exist at 1'~ E 9t~ ~t~ppt . Certain costs have
been incurred in the investigation and determlnatlon of this condition. These costs
are set forth in the enclosed statement and are now due and payable pursuant to
San Bernardino Municipal Code Section 15.28.150.
An appeal may be made within ten (10) days of the date of the decision of the Board
of Building Commissioners to the Common Council. If no appeal is taken, the costs
incurred shall become a lien upon the real property unless paid to the City Clerk
within thirty (30) days of the date of this notice.
If this condition is not corrected by the owner, and the nuisance has to be abated by
the City, additional costs will accrue for the performance of the necessary work.

Item No. 14 - 125 East Ninth street/Report No. 3134 -
Mark sutton presented Item No. 14, Report/project No. 3134, a
4-plex with some units open and vacant and owned by Solomon
Olsadi and Didi -Geniblazo.
Mark Young presented photographs to Mr. Olsadi and the Board
stating that the 4-plex has some open and vacant dwellings;
with termite damage: plumbing/waterpipe and electrical
problems. Due to an abundance of trash and debris on
property, the city cleaned on March 7, 1988. Staff
Recommendation is to adopt a resolution to obtain the proper
permits within 10-days and rehabilitate to current building
codes within 60-days, or demolish: and incur all current and
future costs in the form of a lien on the property. Current
Costs: $1,569.78.
Mr. sutton swore in Mr. Solomon Olsadi, who was present to
speak on behalf of the property. Mr. Olsadi stated that he
obtained ownership three months prior, and did not know why
he was called before the Board, inwhich Mr. sutton proceeded
to explain to Mr. Olsadi the reason why he was at the
meeting.
Mark Young stated that a Notice of Pendency (NOP) had been
placed on the property, and the Title Company should have
informed Mr. 01sadi of this prior to purchasing the 4-plex.
commissioner Ponder asked Mr. Olsadi if he had seen the
property prior to purchasing, inwhich Mr. Olsadi replied that
he had.
commissioner Pollock motioned to adopt Staff Recommendation
to adopt a resolution to obtain permits within 10-days and
rehabilitate to current building codes within 30-days,
instead of the 60-days recommended, or demolish; and incur
all current and future costs in the form of a lien on the
proper~y. Commissioner Ponder seconded.

To the City Council of San Bernardino:
This letter is to respectfully appeal a motion to demolish or rehab. a
property located at 125 E. 9th St., San Bernardino.
My client purchased this property with the intent to build new multiple
family housing. However at the time he closed escrow, a mortorium was in
effect while the General Plan was being revised. Then, also the partner that
he arranged to assist him in building out the property left the area.
Since he is an investor and not a builder/developer, he has been actively
seeking other options for this property. He has kept one unit rented so that
there would be someone on the property to help prevent vandalism and waste.
At the time he closed escrow, a lien was paid to the City of San Bernardino
for cleaning up the junk cars and weeds on the property. However, I noted
recently that the same cars are still there despite the fact that the city
was paid to have them removed.
Also, I note that now the city has placed charges to my client for boarding
the property when in fact this has never been done. I would respectfully request
that these charges be removed.
This particular owner is not a slumlord and it is not his intent to maintain
these unitr in this condition. However, in light of the fact that the property
has been in this condition for many years and many legal difficulties with the

previous owners and finally a lengthy probate out of which the current owner
bought the property.

I would appeal for an appropriate time period to allow plans to be drawn in
conformity with the zoning and General Plan and those plans to be approved
so that a construction loan could be obtained. Then, as follows the course of
development, the older buildings could be removed.
