STAFF REPORT
The Public Buildings Division, Parking Control Section
proposed increased bail schedule for certain type parking
offences in San Bernardino, such as blocking of sidewalks and
driveways, parking at red curbs, and semi-trucks parking in
residential areas.
Detail justification back-up was submitted to the Legislative
Review Committee on Sept. 8, 1988, and the committee directed
the City Attorney to prepare the ordinance and amendments to
the Municipal Codes for adoption of these new proposed bail
schedules as a deterrent to these serious type offenders. *
Legislative Review Committee also recommended the elimination
of a volunteer Handicapped Blue Crew concept since statistics
did not support this concept. It could subject the City to
excessive unjustified potential liabilities. The staff and
Legislative Review Committee recommend the adoption of the
changes to the Municipal Code and attached resolution.

A.end.ents to Municipal Code regarding parking
violations.
Pursuant to your memo to Jim Robbins dated June 8, 1988
(copy attached), you have requested our office to research
proposed amendments to the San Bernardino Municipal Code which
would strengthen the City's enforcement of parking regulations
and provide greater deterrence for violators. These proposed
amendments will also be discussed at the September 8, 1988
Legislative Review Committee Meeting:
1. 'Prohibited parking in red curbs, SBMC Section
10.16020(A)
Raising the bail forfeiture penalty from $15.00 to $25.00
would provide greater deterrence. If the Mayor and Common
Council concur, this should be recommended to the Municipal Court
by way of a Council Resolution.
2. Prohibited parking of trucks and trailers in residential
districts, SBMC Section 10.16.120.
Raising the bail forfeiture penalty from $15.00 to $50.00
would also provide greater deterrence. Again this may be
initiated by Council Resolution and requires the Municipal
Court's approval.
3 & 4. Blocking of Driveways, California Vehicle Code Section
22500(e) and Parking on Sidewalks, California Vehicle
Code Section 22500(f).
This can best be accomplished by amending Municipal Code
Section 10.16.020(8) "Parking Prohibited at any time", to add
Sections 5 and 6:
"B. It is unlawful for any person to stop,
stand or park a vehicle upon any street,
alley, or portion thereof, or other property

owned, leased, operated or controlled by the
City:
5. In front of a public or private
driveway, except that a bus engaged as a
common carrier, school bus, or a taxicab may
stop to load or unload passengers when
authorized by the City pursuant to ordinance.
6. On a sidewalk, except electric cars when
authorized by City ordinance, as specified in
Vehicle Code Section 21114.5."

The following proposed amendments to Municipal Code Section
10.16.150, "Parking enforcement", would give your parking
control checkers citation authority throughout the City and your
security personnel citation authority only in designated areas
for these violations:
"10.16.150 Parking enforcement.
A. Parking control checkers are authorized and
empowered to enforce parking regulations
adopted pursuant to this article and to issue
parking control notices throughout the City
as provided in Section 411ea40202 of the
California Vehicle Code.
B. Designated security personnel afte-parkiftg-
eefttrel-eheekers-ef-the-parkiftg-eefttrel
eivisieft are authorized and empowered to
enforce parking regulations adopted pursuant
to this article and to issue parking control
notices as provided in Vehicle Code Section
411ea 40202, in public parking areas,
facilities and structures and the public
streets located adjacent to or surrounding
the Central City Mall and City Hall, San
Bernardino, California, and in privately
owned or operated parking areas declared open
to the general public by the Mayor and Common
Council.
C. The Public Buildings Superintendent, or his
authorized representatives, including
volunteers approved by said Superintendent,
are authorized and empowered to enforce
parking regulations adopted pursuant to
Section 10.16.160 relating to parking spaces
reserved for handicapped persons and to issue
parking control notices relating thereto as
provided in Vehicle Code Section 411ea
40202.
D. The p ~ublic BUildings Superintendent, or his

authorized representative, is authorized and
empowered to enforce parking regulations
adopted pursuant to Section 10.16.170
relating to parking spaces reserved for City
board or commissioner members and to issue
parking control notices relating thereto as
provided in Vehicle Code Section 41193 40202.
E. Any pOlice officer, the Public Buildings
Superintendent, parking control checkers,
designated security personnel, or any
regularly employed and salaried City employee
enforcing parking laws and regulations, are
authorized and empowered to immobilize
vehicles as provided in Section 22651.7 of
the Vehicle Code of the State of California.

Pursuant to our telephone conversation on September 1, 1988,
you now wish to postpone any proposed amendments to the Municipal
Code regarding this topic until after you review the City's
abandoned vehicle abatement program.
Because your personnel only have the power to cite parked or
stopped vehicles, they cannot stop motorists and issue citations
for "operating" a motor vehicle. That power is reserved for law
enforcement officials.
If your department and/or the Legislative Review Committee
wishes to recommend these proposed amendments for Council
approval, we would draft the appropriate resolutions and
ordinances.

An annual analysis has been performed on our efficiency in
the enforcement of parking witbin tbe City of San Bernardino,
as it relates to our amount of fines for parking violation..
Our analysis indicates that our bail scbedule of $15.00 for
some violations is not a sufficient deterrent to control sucb
violations. Some of the types of violations are as follOWS.
1. Prohibited parking in red curbs, SBMC, Section
10.l6020A
Presently $15.00 penalty, recommend $25.00 penalty,
bail schedule change only after Mayor and Council
bave concurred.
2. Prohibited parking of motor vehicle trucks in
residential district, SBMC, Section 10.16120.
Presently $15.00 penalty, recommend $50.00 to be
consistent with S.B County law enforcement system
misdemeanor and infraction uniform bail schedule,
dated 7-7-86.
3. Blocking of driveways, California Vebicle Code,
Section 22500B.
Presently $ -0-, recommend $20.00 in accordance
with S.B. County law enforcement system
aisdemeanor and infraction uniform bail scbedule,
dated 7-7-86.

to issue a parking violation for such an offense.
We believe that it sbould be included in the
Municipal Code and our parking enforceaent person-
nel be authorized to issue citations for sucb
offenses.
We furtber believe that it sbould be included under
the SBMC, Section 10.16.060D.
5. Operating, Parking or Storing of a vebicle witb
expired/no vehicle registration.
Presently there is no municipal code tbat makes the
operation of a vehicle tbat ia not properly regis-
tered or bas expired license plates a viOlation.
Records in our office indicate that the DMV bas records on
file that indicate that there are over 9,000 vebicles witb
City of San Bernardino addressea tbat bave not renewed tbeir
vebicle registrations in excess of one year. This is a
direct contribution factor to tbe problem of abandoned
vehicles in tbe city.
If sucb violations were covered by tbe aunicipal codes that
prohibit our residence from storage or operating such a
vehicle witbin our city limits, and an appropriate fine was

2 ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
10.16 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROHIBIT BLOCKING
3 OF DRIVEWAYS, PARKING ON SIDEWALKS, AUTHORIZING PARKING CONTROL
CHECKERS TO ISSUE CITATIONS AND ELIMINATING CITATION POWER TO
4 VOLUNTEERS FOR HANDICAPPED PARKING VIOLATIONS.
5 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:

SECTION 1.
Section 10.16.020(B) of the San Bernardino

Municipal Code is amended to read as follows, adding Sections 5
and 6:
"10.16.020(B). It is unlawful for any person to
stop, stand or park a vehicle upon any street, alley,
or portion thereof, or other property owned, leased,
operated or controlled by the City:

5. In front of a public or private driveway, except
that a bus engaged as a common carrier, school bus,
or a taxicab may stop to load or unload passengers
when authorized by the City pursuant to ordinance.

6. On a sidewalk, except electric cars when
authorized by City ordinance, as specified in Vehicle
Code Section 21114.5."

SECTION 2. 10.16.150 of the San Bernardino Municipal Code
is amended to read as follows:

"10.16.150 Parking enforcement.

A.
Parking control checkers are authorized and
empowered to enforce parking regulations
adopted pursuant to this article and to
issue parking control notices throughout
the City as provided in Section 40202 of
the California Vehicle Code.

B.
Designated security personnel are
authorized and empowered to enforce parking
regulations adopted pursuant to this
article and to issue parking control
notices as provided in Vehicle Code Section
40202, in public parking areas, facilities
and structures and the public streets
located adjacent to or surrounding the
Central City Mall and City Hall, San
Bernardino, California, and in privately

owned or operated parking areas declared
open to the general public by the Mayor and
Common Council.
C.
The Public Buildings Superintendent, or his
authorized representatives, are authorized
and empowered to enforce parking
regulations adopted pursuant to Section
10.16.160 relating to parking spaces
reserved for handicapped persons and to
issue parking control notices relating
thereto as provided in Vehicle Code
Section 40202.
D.
The Public Buildings Superintendent, or his
authorized representative, is authorized
and empowered to enforce parking
regulations adopted pursuant to Section
10.16.170 relating to parking spaces
reserved for City board or commissioner
members and to issue parking control
notices relating thereto as provided in
Vehicle Code Section 40202.
E.
Any police officer, the Public Buildings
Superintendent, parking control checkers,
designated security personnel, or any
regularly employed and salaried City
employee enforcing parking laws and
regulations, are authorized and empowered
to immobilize vehicles as provided in
Section 22651.7 of the Vehicle Code of the
State of California.
