Synopsis of Previous Council action:
On April 6, 1987, the Mayor and Common Council authorized the hiring of
Sabo and Deitsch to initiate foreclosure proceedings on d~linquent
property owners for Assessment District Number 5861 Bond Payments.
On December 21, 1987, the Mayor and Common Council authorized advance-
ment of $85,000 from Assessment District Fund for January, 1988 payment
of interest on bonds for Assessment District Number 5861.
On February 15, 1988, the Mayor and Common Council authorized the
submittal of an application to purchase seventy-seven lots in Assess-
ment District Number 5861 through sale of County Treasurer/Tax
Collector.

On June 20, 1988, the Mayor and Common Council authorized the
Director of Finance to advance $80,000 to the debt service account
of Assessment District number 5861, to be refunded to the City at
the completion of the property transactions.

STAFF REPORT
Assessment District Number 5861 was formed to provide public
improvements for development of the Orangewood Estate project. Bond
payments are made in January and July of each year. This District
was formed in 1980 to assist with the development of two-hundred
(200) single family homes in the vicinity of California street and
16th street. The development was plagued with many problems and the
holders of the construction loans finally foreclosed on the homes
and lots. There are presently one hundred, twenty-three (123) homes
and seventy-seven (77) vacant lots in the project. On all of the
vacant lots and a few of the homes the city has delinquent bond
payments dating back to the beginning of the project.
The City had been able to keep the bondholders current by using the
Reserve Fund and excess construction funds to make timely Bond
payments. These funds were exhausted in the fall of 1987. In
December, 1987, the City Treasurer requested the Mayor and Common
Council to authorize the advancement of $85,000 from the City
General Fund to make the January, 1988 payment. At the time the
Mayor and Common Council authorized the payment of funds, the City
Treasurer advised that said advance would be repaid at the time the
property is bought during foreclosure or during a transaction with a
developer chosen through the issuance of a Request for Proposals.
In April of 1987, the Mayor and Common Council authorized the law
firm of Sabo and Dietsch to begin foreclosure proceedings. However,
in February, 1988, the City was notified that the parcels would be
advertised for sale by the County of San Bernardino in order for the
County to recover delinquent property taxes. The Mayor and Common
Council authorized the submittal of an application to purchase the
properties pursuant to the California Revenue and Taxation Code
Section 3791.3. While the City was waiting for the County
Treasurer/Tax Collector to complete all its respective procedures
before obtaining title, in June, 1988, the Mayor and Common Council
authorized the City Treasurer to advance an additional $80,000, to
the Debt Service Account of Assessment District number 5861, to be
refunded to the City at the completion of the property transfer to a
private developer.
The County recently notified the Community Development Department
that two (2) of the seventy-eight (78) parcels have been redeemed,
thereby leaving seventy-six (76) parcels eligible for sale to the
City for the sum of $101,300. An additional amount will be charged
by the County for the cost of providing notice.
The attached resolution authorizes the execution of an agreement to
purchase tax defaulted property. Once the City, the County and the
State have executed said agreement, the Treasurer/Tax Collector
anticipates recording the deed conveying title to the city by
January 24, 1989.

EXECUTION OF AN AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY
DATED NOVEMBER 16, 1988, BETWEEN THE COUNTY OF SAN BERNARDINO AND
THE CITY OF SAN BERNARDINO
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLLOWS:
SECTION 1. The Mayor is hereby authorized and directed to
execute, on behalf of said City, an Agreement to Purchase Tax-
Defaulted property dated November 16, 1988 between the County of
San Bernardino and the City of San Bernardino.
This Agreement is
attached hereto marked Exhibit "A", and incorporated herein by
reference as though fully set forth at length.

The real property situated within said county. hereinafter set forth and described in Exhibit "A" attached hereto and
made a part herEJof. is tax-defaulted and is subject to the power of sale by the tax collector of said county for the
nonpayment of taxes. pursuant to provisions of law.
It is mutually agreed as follows:
,. that as provided by Section 3800 of the Revenue and Taxation Code. the cost of giving notice of
this agreement shall be paid by the PURCHASER. and .
2. that the PURCHASER agrees to pay the sum of $ 101. 300. 00 for the real property
described in Exhibit "A" within 21 days after the date this agreement becomes effective.
Upon payment of said sum to the tax collector. the tax collector shall execute and record a
deed conveying title to said property to PURCHASER no later
than January 24, 1989.
3. that said PURCHASER will not share in the distri-
bution of the payment required by this agreement.
ThiS agreement shall be null and void if all or any portion of the property is redeemed prior to the effective date of this
agreement. This agreement shall also become null and void and the right of redemption restored upon the
PURCHASER'S failure to comply with the term and conditions of this agreement. Time is of the essence.
