STAFFING FOR VEHICLE ABATEMENT PROGRAM (VAP) - The Committee unanimously recommended approval of the proposed Vehicle Abatement Program, including organization, cost and staffing to be implemented January 2, 1989 (See attached). Councilman Minor requested that the City Attorney resolve any possible legal conflict between the California Highway Code and San Bernardino Municipal Code regarding the administra- tive hearing process prior to the implementation date. This item will be brought before the Mayor and Council on November 21, 1988. 2. REQUEST TO MOVE TWO FINANCE DEPARTMENT FROM GENERAL UNIT TO CONFIDENTIAL UNIT The recommended approval of this item and that it be the Council meeting agenda of November 21, attached). POSITIONS Committee placed on 1988 (See 3. EMPLOYMENT CONTRACTS The Committee discussed the contract agreement for the City Administrator's position. The Committee unanimously recommended approval of the con- tract agreement provided the position calls for a 90-day notice and a four-month severence pay if terminated at the end of the contract period. If employee is terminated before expiration of the contract, then only four-months severance pay shall apply. Also, the Committee requested the Personnel Director research the pros and cons of contract agreements with cities of comparable size and report back to the Committee November 24, 1988. The Committee favored contracts only for the City Administrator and the Director of the Redevelopment Agency positions. Meeting adjourned. - ::X;;l1~~~~:;t::. (2) EXECUTIVE SUMMARY TRANSFER OF VEHICLE ABATEMENT PROGRAM Background: The Acting City Administrator asked that plans for the transfer of the Vehicle Abatement Program (VAP) from the Fire Department to the Public Works Department be thoroughly reviewed. The Deputy City Administrator/ Development reviewed a draft report prepared by the Superintendent of Public Buildings/Parking Control. The attached report of september 20, 1988, has been finalized to reflect concerns regarding costs and organization to facilitate implementation. Cost: The projected cost for the transfer of the VAP is estimated at $57,614 which includes $22,500 in nonrecurring equipment costs. The balance of $35,114 is for personal services, data processing, and other administrative costs. The VAP costs can easily be offset by more proactive enforcement procedures using the $100 per vehicle administrative charge of Resolution No. 88-101. Organization: The transfer of the VAP will entail the reorganization of the Public Buildings/Parking Control Division. The reorganization is necessary to maintain a proper level of supervision (span-of-control) and to administer the complex procedures of a more proactive VAP. The reorganization calls for: the addition of only one position (Parking Control Checker), the redesignation of an existing position as Parking Control Supervisor, and the redesignation of the Building Maintenance Supervisor to Assistant Superintendent-Maintenance. These organizational changes have been reviewed with the Personnel Director. Implementation: This executive summary and the detailed staff report is presented to the Personnel Committee for consideration. The transfer of the VAP from the Fire Department is proposed for January 2, 1989, if approved by the Mayor and Common 'Council. Some of the changes to the Municipal Codes have already been accomplished and a draft amendment to Resolution No. 6433 on staffing is included in the 9/20/88 staff report. Accordingly, the transfer of the VAP as proposed is recommended by staff for legislative approval and subsequent implementation. Prepared by: James C. Public Buildings/Parking Control SUBJECT: TRANSFER OF VEHICLE ABATEMENT PROGRAM (VAP) DATE: September 20, 1988 COPIES: Deputy City Administrator1 City AttorneY1 Fire Chief1 Police Chief1 City Clerk1 Director Public Works/City Engineer1 Finance1 Mayor1 Building & Safety ------------------------------------------------------------- BACKGROUND: June 13, 1988 a meeting was held in the MIC Room, City Hall, regarding the possibility of transferring the vehicle abate- ment Program (VAP) from the Fire Department to Public Build- ings which would allow them to concentrate on life, safety inspections which have increased because of city growth. Also, transfer of the VAP would be logical and compatible with the Parking Control Program currently assigned to this department. It was also concluded that the grouping of homogeneous functions under one organizational manager would allow the City to establish a clear cut charter, a well defined goal, objective and purpose under one single super- visor, utilizing the existing workforce to the maximum, requiring minimum augmentation and change to establish administrative procedures. The VAP is now being performed to some degree by three (3) and sometimes (4) separate departments/divisions, Police/ Pubic Buildings (on street/off street parking lots) Fire/ Building & Safety for off street - private property. Following review with the City Administrator's office, organizational and format changes were made to attached documentation set forth in the table of contents CONCLUSIONS: The transfer and consolidation of the Vehicle Abatement Program (VAP) would allow: 1. Total functions of parking enforcement (Parking Citations & Vehicle Abatement) to be placed under ooooo~!. Allow Police, Fire and Building' Safety Department to consentrate on their higher priority tasks. 5. The Mayor and Common Council to fix administrative cost (CSBMC 8.36.070) on accurate cost bases, by establishment of central control system. assessed a more a .cost 6. Establishment of a standardized appeal process (CSBMC 8.36.110). 7. A smooth transition because of a close working relationship presently existing between departments 8. Maximum utilization of existing system presently available to Public Buildings. RECOMMENDATIONS: 1. Approve the transfer of the VAP to Public Buildings effective, not later than January 2, 1989. 2. It is unlawful for the operator of any vehicle to stand or park such vehicle upon any roadway for the principal purpose of: A. It is unlawful for the driver of any vehicle to park such vehicle upon any public street, or alley, within the City, the roadway of which is not more than twenty-five feet and not less than twenty feet in width for a period of not to exceed thirty minutes between the hours of eight a.m. and five p.m. of any day except Sundays and holidays. B. It is unlawful for the driver, owner or operator of any truck to park such vehicle upon any public street or alley within the City, the roadway of which is not more than sixty-two and one-half feet, between the hours of six p.m. and six a.m., except for the period of time necessary for the loading or unloading of passengers or freight; provided, that in no event shall such truck be stopped for a period in excess of twenty minutes for the loading or unloading of freight. C. The Chief of Police may, with the consent of the Mayor and Common Council; permit the parking of trucks upon such streets or alleys for a period of time as specifically set forth in the permit and upon such conditions as therein specified. D. Use of Streets for Storage of Vehicles - Generally - When Prohibited. It is unlawful for any person who owns or has possession, custody or control of any vehicle to park or leave standing such vehicle upon any street or alley for seventy-two or more consecutive hours. F. Whenever a police officer removes a vehicle from a street or highway or public property as authorized in this section and the officer knows or is able to ascertain from the regis- tration records in the vehicle or from the registration records of the California Department of Motor Vehicles the name and address of the registered or legal owners thereof, such police officer shall immediately give or cause to be given notice in writing to such owner of the fact of such removal, the grounds thereof and of the place to which ~ch vehicle has been moved. Whenever a police officer removing a vehicle from a street or a highway or public property under this section does not know and is not able to ascertain the name of the owner or for any other reason is unable to give the notice to the owner as hereinbefore provided and in the event the vehicle is not returned to the owner within a period of seventy-two hours, then and in that event the police officer shall imme- diately send or cause to be sent written report of such removal by mail to the Department of Motor Vehicles at Sacramento and shall file a copy of such notice with the proprietor of any public garage in which the vehicle may be stored. Such report shall be made on a form furnished by such department and shall include a complete description of the vehicle, the date, time and place from which removed, the grounds for such removal and the name of the garage or place where the vehicle is stored. Listed below are the estimated revenue we can expect from the Abandoned Vehicle Assessment of Administration Overhead Cost. The basis of the estimates are annual work days, number of vehicles towed and a $100 administrative cost for each vehicle towed. I expect that we will be able to remove 3 or 4 vehicles per day once the program is in operation and personnel are trained. Cost of towing vehicles should be added to Administrative Cost of $100. 2. We would need some up front money until the Administrative Charges start coming in. 3. We can expect to loose money on a few vehicles that can not be 1.0. and are parked on streets, parks, etc. 4. If only 2 vehicles were abated on a daily basis, the first year cost to the City would be $8214., and would take approximately one and one-half years to recover the operating and non-reoccuring start-up costs. And after that revenue in excess of operating cost would be approximately $14,286. per year less inflation. s. Revenues to support this start up program could come from the Parking Citations, which is estimated to be over $40,000 greater than revenue projected when the Budget was prepared. Revenue for FY 88-89 was estimated to be $234,000 and money received for July and August has already exceeded $45,800. Since we have valid reason to anticipate even a greater revenue than projected, we believe this estimated surplus to be valid. The dis- crepancies of the Computerized Parking Citation Program have been greatly improved, which has allowed us better 'J-' tracking and management of this system and improved 00 0 o:;i't revenue flow.
