Synopsis of Previous Council action: of Fire Prevention Inspection Fee Schedule.
Public hearing was set for September 6, 1988, at which time the Mayor
and Council recommended action relative to institution of a Fire Pre-
vention Inspection Fee Schedule.
Proposed Ordinance amending Section 2.201(a) of the Uniform Fire Code,
1985 Edition, to authorize the collection of fees for certain inspec-
tions conducted thereunder and setting the amount of such fees; and a
Resolution setting certain Fire Department Inspection Fees as required
under San Bernardino Municipal Code Section 15.16.075, and providing
for a cost-of-living increase in said fees have been approved by the
City Attorney as to form and content.
Recommended motion:
#1 Adopt Resolution.
#2 Waive further reading of Ordinance and layover for final adoption.

STAFF REPORT
It is recommended that a fire inspection fee be instituted
to fund additional personnel for the fire prevention division
of the fire department. It is the responsibility of the fire
department to inspect all structures in the city except single
family residences at least once a year. Some buildings require
up to four inspections per year, depending on the type of
occupancy. Because of the increase in the number of buildings,
the fire prevention staff has not been able to do all of the
required inspections. The fire inspection fees will fund
two inspectors and one clerk. The additional personnel are
necessary to maintain life safety throughout the city.

FIRE DEPARTMENT INSPECTION FEES AS REQUIRED UNDER SAN BERNARDINO
3 MUNICIPAL CODE SECTION 15.16.075, AND PROVIDING FOR A COST-OF-
LIVING INCREASE IN SAID FEES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
5 OF SAN BERNARDINO AS FOLLOWS:
6 WHEREAS, pursuant to San Bernardino Municipal Code Section
7 15.16.075 the Fire Department shall charge fees for certain types
8 of inspections, and;
9 WHEREAS, said fees shall be the actual cost of making said
10 inspection;

NOW, THEREFORE, the City Council of the City of San
12 Bernardino does hereby resolve as follows:

SECTION 1. That from and after

15 Section 15.16.075, performed by the San Bernardino Fire
16 Department, the fee for such inspection shall be as set forth

SECTION 2.
Fire Department inspection fees shall be a
2 personal obligation of the owner or owners of the real or
3
personal property which is the subject of the inspection.
The
4 fee may be collected by any lawful means available to the City of
5 San Bernardino.

SECTION 3. Definitions - The terms used in sections 1 and
7 2 of this resolution shall have the same meanings as defined in
8 the Uniform Fire Code.

SECTION 4. That the fees herein shall be adjusted annually
10 on the anniversary of the effective date of this resolution in
11 accordance with the Consumer Price Index, Los Angeles - Anaheim-
12 Riverside for all urban consumers, prepared by the Bureau of
13 Labor Statisticsof the United States Department of Labor.
14 If the said bureau shall discontinue the preparation of the
15 price index, then the fees shall be increased or decreased on the
16 basis of any other nationally recognized indicator of increases
17 or decreases in consumer prices.

SECTION 5. The Fire Chief, in conjunction with the Finance
19 Director, shall administer this resolution and is authorized to
20 establish procedures for collection of fees.
