Using funds approved as part of the current fiscal year's budget, the program is projected to cost approximately $6,000 and would include the hiring of a part-time intern to serve as Public Input and Information Coordinator. The attached contract for services outlines the intern's duties and tasks, all of which will be overseen by supervisory staff in the Planning Department and the Mayor's Office. The primary purpose of the program is to ensure that business people and property owne~s are kept up to date on the General Plan efforts and given as much opportunity as possible to provide input along the way. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH SHEILA L. MADISON TO PERFORM CONSULTING SERVICES FOR THE PLANNING DEPARTMENT. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an agreement with Sheila L. Madison to perform consulting services for the Planning Department, a copy of which is attached hereto marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. MADISON, 7 referred to as "CONSULTANT". 8 CITY and CONSULTANT agree as follows: 9 1. General Description of Work to be Done. CITY retains CONSULTANT to perform planning services for the Planning Commission and the Planning Department. Such planning services shall include, but are not necessarily limited to, preparing monthly newsletters, information flyers, press releases and other similar public relations information through the Mayor's Office and the Planning Department, as well as other related planning 16 services which may be required by the Planning Department. 17 2. Termination of Agreement. Either party may terminate 18 this agreement without cause and for any reason by giving fifteen 19 days advance written notice of termination to the other party. 20 3. The term of this agreement is for a period of Term. 21 seven and one-half (7-1/2) months. This agreement shall 22 commence on November 22, 1988 and terminate on June 30, 1989. 23 4. Payment to CONSULTANT for Provision for Payment. 24 services provided under this agreement shall be at the rate of 25 Seven Dollars ($7.00) per hour and in no event shall exceed $7.00 26 per hour. CONSULTANT shall maintain and file with the Planning 27 Department a record of hours expended on assigned projects and 28 HE:ms 1 November 9, 1988 1 2 the Planning Department shall submit a claim or request for 3 payment to the Finance Department every two weeks. The parties 4 estimate that the services hereunder will require approximately 5 eighty (80) hours per month. Notwithstanding the foregoing, 6 CONSULTANT shall devote all hours necessary to the projects 7 assigned by the Planning Director to insure adequate performance 8 hereunder. CONSULTANT shall assume and pay all out-of-pocket 11 10 and CITY shall not be liable for such costs and expenses. 9 expenses and costs of performing services under this agreement 5. Taxes. CITY shall withhold Social Security, Federal 13 12 and state income taxes from CONSULTANT'S pay. 6. Amendments. This agreement may be amended or modified 14 only by written agreement signed by both parties. 15 CONSULTANT'S rights under this agreement 7. Assignment. 16 shall not be assigned by CONSULTANT to any other person, firm or 17 corporation without the prior written consent of CITY. 18 8. Attorney's Fees. In the event that an action is filed 19 by either party to enforce rights under this agreement, the 20 prevailing party shall be entitled to recover reasonable 21 attorney's fees in addition to any other relief granted by the 22 court. 23 9. Acknowledgment. 24 (a) CONSULTANT acknowledges and agrees that CITY is 25 the sole and exclusive owner of all rights and remedies in and to 26 certain confidential ideas and secrets concerning the operations 27 of CITY, any products or information resulting, in whole or in 28 HE:ms 2 November 9, 1988 1 2 part, from the work performed under this agreement, and all 3 products or information derived or to be derived from said work, 4 regardless of whether CITY'S or CONSULTANT'S work is subject to 5 patent, copyright, or other protection. 6 (b) In the event that any work performed under this 7 agreement is or becomes the subject of a patent application, 8 patent, copyright, or other rights under the laws of the United 9 States or any other country, CONSULTANT agrees and understands 10 that CITY shall have all of the rights and remedies available to 11 CITY under the law as a result of such patent applications, 12 patents, copyrights, or other rights. 13 10. Entire Agreement.
