After reviewing the qualifications of a number of firms, MAPCO, Inc., was awarded a professional services contract to provide design and engineering services for the two projects in need of immediate implementation. The two projects are Americans with Disabilities Act (ADA) Handicapped Access Improvements at various locations in the City of San Bernardino - Phase II and Street Reconstruction/Handicapped Access Improvements on Fairfax and Hillside Streets. CURRENT ISSUE: The plans, specifications and estimates are complete for the ADA Handicapped Access Improvements - various locations citywide project and 50% complete for the Street Reconstruction/Handicapped Access Improvements on Fairfax and Hillside Streets Project. Three additional street improvementlhandicapped access projects have been identified by the City's Development Services Engineering Design Section as significant to the continued redevelopment of the City's downtown area. These projects are the Courthouse Off-Site Street Improvements for the new State Courthouse, Second Street Off-Site Street Improvements (adjacent to the McDonalds restaurant) and Parking Lot Construction on "F" Street (Agency owned property). The contract for design and engineering services originally issued to MAPCO is insufficient to provide plans, specifications and estimates for these three projects. The Agency in requesting approval of a contract amendment for design and engineering services for these projects. ENVIRONMENTAL IMPACT: None. This activity does not meet the definition of a "Project" under Section 15378 of the California Environmental Quality Act ("CEQA"), which states that a "project" means the whole of an action, which has a potential for resulting in either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment. There is no fiscal impact to the City's General Fund. The Commission hereby approves Amendment No. 1 to the Agreement 16 between the Agency and the Consultant attached hereto, incorporated herein by reference. 17 Section 3. The Interim Executive Director of the Agency is hereby authorized to 18 execute the Agreement on behalf of the Agency in substantially the form attached hereto, together 19 with such changes therein as may be approved by the Interim Executive Director of the Agency and 20 Agency Counsel. WHEREAS, on November 15,2010, the Agency and the Consultant entered into an Agreement for Professional Services (the "Agreement") CDC/2010-60 to provide design, engineering, estimates and specification services for various Agency construction projects; and WHEREAS, the Agency desires to amend said Agreement in the amount of $150,000 for the Consultant to provide additional design, engineering, estimates and specification work for said projects in accordance with the terms and conditions of the Agreement. NOW, THEREFORE, IN CONSIDERATION OF THE PROMISES AND MUTUAL PROMISES CONTAINED HEREIN AND FOR SUCH OTHER GOOD AND VALUABLE CONSIDERATION, THE RECEIPT AND SUFFICIENCY OF WHICH ARE HEREBY ACKNOWLEDGED, THE PARTIES HERETO AGREE AS FOLLOWS: 1.
