STAFF REPORT
The Metropolitan Opera Western Regional Auditions
grant in the amount of $3,000 is for a young art
development program which will give the artists
the opportunity to be heard and encouraged in
their careers.
This grant assures the regional competition for
opera to be held in the City of San Bernardino.
Winners from this region continue to Los Angeles
to compete in a final competition.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1.
The Mayor of the City of San
Bernardino is hereby authorized and directed to execute
on behalf of said City an Agreement with the Metropoli-
tan Opera Western Regional Auditions a copy of which is

attached hereto, marked Exhibit "A" and incorporated

1 AGREEMENT
2 Fine Arts Fundinq
3 THIS AGREEMENT is entered into between the CITY
4 OF SAN BERNARDINO, a municipal corporation, referred to
5 as "City", and the Metropolitan Opera Western Regional
6 Auditions a non-profit organization, referred to as
7 "Organization".
8 The parties agree as follows:
9 1. Recitals.
10 A. organization has requested financial
11 assistance from City for the fiscal year 1988-89, in
12 order to assist in defraying the expense of certain
13 concerts, shows, festivals or events or activities
14 sponsored by Organization as set forth in Org~ni-
15 zation's grant proposal (hereinafter "the proposal")
16 approved by the Fine Arts Commission of the City, a
17 copy of which proposal is on file in the Office of
18 Cultural Affairs. The terms of the proposal are in-
19 corporated herein by reference and shall govern the
20 uses of the funds provided here-in. The financial
21 assistance provided for in this agreement is made on a
22 one-time' only basis, and receipt of said funds shall
23 not imply a continuing obligation of the City beyond
24 the terms of this Agreement.
25 B. The expenditure is for a valid munici-
26 pal public purpose, to wit: for the promotion of music
27 appreciation in San Bernardino, as more fully set forth
28 in the proposal submitted by Organization.

5. Hold Harmless. Organization covenants and
agrees to indemnify and save harmless the City and its
employees and agents from all liabilities and charges,
expenses (including counsel fees), suits or losses
however occurring, or damages arising or growing out of
the use or receipt of the funds paid hereunder and all
operations under this agreement. PaYments hereunder
are made with the understanding that the City is not
involved in the performance of services or other acti-
vities of Organization. Organization and its employees
and agents are independent contractors and are not emp-
loyees or agents of the city in performing said ser-
vices.
6 Termination. City shall have the right to
terminate this Agreement and any funding remaining un-
paid hereunder for any reason by mailing a ten-day
written notice to Organization and this agreement shall
terminate ten days after the mailing of such notice. In
the event this Agreement is terminated for reasons of
improper use of funds or use of funds for any purpose
other than those authorized, any unexpended portion of
the funds provided by City shall be returned to City.
In addition, Organization shall reimburse to City any
funds expended which were used for any purposes other
than those authorized under this Agreement.
7. Assiqnment. Organization shall not assign
its interest in this Agreement without the prior
written approval of city.

8. Insurance. Organization shall take out
and maintain during the life of this Agreement such
public liability and property damage insurance as shall
insure City, its elective and appointive boards, comm-
issions, officers, agents and employees, Permittee and
its agents performing acts covered by this Agreement
from claims for damages for personal injury, including
death, as well as from claims for property damage which
may arise from organization's or its agents' operations
hereunder, whether such operations be by Organization
or its agents or by anyone directly or indirectly
employed by either Organization or its agents, and the
amounts of such insurance shall be as follows:
(a) Public Liability Insurance. In an
amount not less than $100,000 for injuries, including,
but not limited to, death, to anyone person and,
subject to the same limit for each person, in an amount
not less than $100,000 on account of anyone
occurrence;
(b) Property Damage Insurance. In an
amount of not less than $50,000 for damage to the
property'of each person on account of anyone occurr-
ence.
9. Organization hereby convenants that it has
taken all actions necessary to make the adherence to
the obligations imposed by this agreement a binding
obligation of the organization.

11. Entire Agreement. This Agreement and any
documents or instruments attached hereto or referred to
herein integrate all terms and conditions mentioned
herein or incidental hereto, and supersede all negotia-
tions and prior writing in respect to the subject

In the event of conflict between the
terms, conditions or provisions of this Agreement, and
any such document or instrument, the terms and condi-
tions of this Agreement shall prevail.

Dear Mr. Silver and members, Fine Arts Commission:
Enclosed are the forms for the Grant Application
for funds from the Fine Arts Commission. I am hoping
that we may be considered for additional funds for
our Auditions thet ere to be held this next October 30,
1986.
I have waited to send this to you until I was
sure of the amounts that we will possibly be receiving
from other sources.
We are very grateful for the Grant we received
last year which enabled us to expand our program of
services for the singers of this area. We think that,
in spite of the raises in the Liability insurance which
we must carry and the increase in postage, office supplies
etc., we will be able to continue our program with some
additional assistance from you.
We want to continue our program as we have been able
to increase our services for singers, so that the singers
will not be deterred in their efforts to build a career.
We feel that this is such a valuable service, that it
does deserve a good deal of consideration.
The past support of the Fine Arts Commission is so
gratefully appreciated. We could never have built our
organized efforts without your assistance and we thank
you. I shall appreciate your consideration or this
added request.

SECTION VI I. NEED STATEME,o.:
Due to the fact that each District is rSQuired to finance its own
needs for awards and administration, we need funds for:
1. Awards for 1st, 2nd, 3rd, 4th, and a possible 5th place awards and
for Study Awards.
2. We need funds to pay for Rent of Auditorium, Stage Hands,
Insurance, Accompanists, printing of letterheads, envelopes,
programs, brochure-applications, postage, office supplies, printing
of forms for the singers and for the judges, telephone calls,
for refreshments for the reception during the judges deliberations.
The tremendous increase in Insurance has presented a real problem for us,
and the increase in postage and office supplies also represent a financial
for us for this next audition.
We have secured the promise of a grant of $3000. or approximately that
amount, from several sources. Therefore, if we could be considered for a
Grant from the Fine Arts Commission of $3,000 for the Auditions for 1988-1989,
to be held on October 30, 1988, we would be able to meet our expenses and
still have enough for substantial Awards for our sinners.
We will be holding a Master Class for all of the singers in the Auditions
on November 6th, I~ith a fine vocal authority from Los Angeles as clinician,
thus giving our singers added assistance in preparing for the Regional
Aurlitions in Los Anqe1es.
SECTION v. SUMMARY OF PROJECT DESCRIPTION
The purpose of the National Council, of the Metropolitan Opera is to:
1. Find exceptionally talented opera singers and to assist in their
development.
2. to discover new talent for the Metropolitan Opera.
3. To search for possible participants in the young Artist Develop-
ment program of the Metropolitan Opera Association.
4. To give singers an opportunity to be heard and encouraged in
their careers.
A special aspect of this program is the contActs with producers and
directors for programing vocal concerts and appearances with orchestras
and production events thus giving the singers experience in performing
and encouragement for further development and progress in meaningful
careers.
