RESOLUTION FOR APPROVAL OF AMENDMENT NO. STAFF REPORT
1 TO JOINT POWERS AGREEMENT WITH CITY
SCHOOL DISTRICT FOR USE OF DEL VALLEJO
SCHOOL FACILITIES FOR PARK AND PLAYGROUND
PURPOSES.
The attached Resolution to amend the Joint Powers Agreement for use of Del Vallejo
School Facilities for park and recreational purposes is a culmination of discussions
with the School District for maintenance of the Del Vallejo facilities since the
school facility has reopened and for maintenance of the Highland-Pacific School
property used by American Youth Soccer Organization (AYSO). This amendment will
provide for maintenance of City use facilities at Del Vallejo to continue as it
was during the period when the school was closed and as a compromise, the School
District has agreed to take over the maintenance of the AYSO facilities at the
Highland-Pacific site.
Approval of this amendment should serve to close the issue of grounds maintenance
at the AYSO fields and will simply allow for the City to continue maintaining
the Del Vallejo property which is used for City Park and Recreational purposes.
Therefore, it is recommended that the Resolution be adopted.
Justification for Plans on Supplemental Agenda
This item was received and reviewed by Department staff and City Attorney in an
expeditious manner, however, it could not be completed prior to the regular
agenda deadline. It is important that this item be on the December 5, 1988
agenda so that the issues involved with maintenance of the AYSO fields and the
Del Vallejo fields may be resolved.

RESOLUTION 82-350 AUTHORIZING THE EXECUTION OF A FIRST AMENDMENT
3 TO THE JOINT POWERS AGREEMENT WITH THE SAN BERNARDINO CITY
UNIFIED SCHOOL DISTRICT RELATING TO THE USE OF CERTAIN REAL
4 PROPERTY AT DEL VALLEJO JR. HIGH SCHOOL FOR PARK AND PLAYGROUND
FACILITIES.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
6 OF SAN BERNARDINO AS FOLLOWS:

SECTION 1.
The Mayor of the City of San Bernardino is
8 hereby authorized and directed to execute on behalf of said City
9 a First Amendment to the Joint Powers Agreement with the San
10 Bernardino City Unified School District relating to the use of
11 certain real property at Del Vallejo Jr. High School for park and
12 playground facilities, a copy of which is attached hereto, marked
13 Exhibit "A" and incorporated herein by reference as fully as
14 though set forth at length.

16 adopted by the Mayor and Common Council of the City of San
17 Bernardino at a meeting thereof, held on the

1 AMENDMENT NO.1
TO JOINT POWERS AGREEMENT
2 (Del Vallejo Jr. High School)
3 The Joint Powers Agreement between the SAN BERNARDINO CITY
UNIFIED SCHOOL DISTRICT and the CITY OF SAN BERNARDINO dated
4 September 14, 1982 is hereby amended in the following manner:

Paragraph 7 is hereby amended to read: Maintenance.
City shall repair and maintain the turf areas and an
adequate sprinkler system in a usable condition at
all times during the term of this Agreement in order
to assure that the sports field turf areas are kept
in usable condition at all times.

City shall be responsible for the maintenance of the
lighting system for the term hereof. City's
maintenance shall include the replacement of bulbs,
fixtures, fuses, switches, and all other items
necessary to maintain the ball field lighting system.
City's maintenance of the field and the sprinkler
system shall include the application of necessary
water, soil amendment and fertilizers, the mowing of
the grass, and all necessary repairs to the sprinkler
system in order to maintain the field in a
satisfactory usable condition.

During the term of this Agreement, the District shall
maintain the turf areas of the soccer fields located
on the Highland Jr. High School Athletic Grounds. The
District's maintenance of the turf area shall include
the mowing of the grass in order to keep the soccer
fields in a usable condition. The establishment of
a mowing schedule will be determined by mutual
agreement of both parties.

with thirty (30) days written notice by either party.
