STAFF REPORT
In January of 1989, another semi-annual payment of interest is due to
be paid the bondholders of Assessment District #5861. The City, through
its Community Development Department, is in the final stages of purchasing
the property from the County of San Bernardino under the delinquent
property tax sale provisions. Last month the Mayor and Common Council
authorized an agreement with the County for the final purchase of these
properties. The City is suppose to receive the property no later than
January 24, 1989.
Once the City gains title, Community Development will proceed with
the publication of an RFP for the development of the sites and then
recommend the best proposal.
In the interim, the January 1989 semi-annual payments are due to the
bondholders. Therefore, this Office is seeking an authorized advance
ln order to make timely payment to the bondholders and insure that they
do not go into default. These advances are to be repaid at the completion
of the transaction of the properties.
Assessment District #5861 is an assessment district formed to provide
offsite improvements under the 1915/13 Act. The district was formed
in 1980 and there are presently 123 homes and 77 vacant lots in the
projects. All of the vacant lots have delinquent payments.
In March of 1987, the Mayor and Common Council authorized the beginning
of foreclosure proceedings through the Superior Court. However, in March
of 1988, the City was notified that the parcels wou1e be put up for sale
by the County of San Bernardino for delinquent property taxes. The
authorization was given to purchase the lots under Revenue and Taxation
Code Sections 3695 and 3791.3 through the Community Development Department.
That process will be completed within the next month. Community Development
will then process an RFP.

EXECUTION OF AN AGREEMENT TO PURCHASE TAX-DEFAULTED PROPERTY
DATED NOVEMBER 16, 1988, BETWEEN THE COUNTY OF SAN BERNARDINO AND
THE CITY OF SAN BERNARDINO
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLLOWS:
SECTION 1. The Mayor is hereby authorized and directed to
execute, on behalf of said City, an Agreement to Purchase Tax-
Defaulted property dated November 16, 1988 between the County of
San Bernardino and the City of San Bernardino.
This Agreement is
attached hereto marked Exhibit "A", and incorporated herein by
reference as though fully set forth at length.

the Board of Supervisors of
("PURCHASER"),
pursuant to the provisions of Division 1, Part 6, Chapter e, of the Revenue and Taxation Code.
The real property situated within said county, hereinaf1er set forth and described in Exhibit "A" attached hereto and
made a part herlof, is tax-defaulted and is subject to the power of sale by the tax collector of :s.aid county for the
nonpayment of taxes. pursuant to provisions of law.
It is mutually agreed as follOws:
1. that as provided by Section 3800 of the Revenue and Taxation Code. the cost of giving notice of
this agreement shall be paid by the PURCHASER, and .
2. that the PURCHASER agrees to pay the sum of S 101. 300. 00 for the real property
described in Exhibit "A" within 21 days af1er the date this agreement becomes effective.
Upon payment of said sum to the tax collector, the tax collector shall execute and record a
deed conveying title to said property to PURCHASER no later
than January 24, 1989.
3. that said PURCHASER will not share in the distri-
bution of the payment required by this agreement.
This agreement shall be null and void if all or any portion of the property is redeemed prior tothe effective date 01 this
agreement. This agreement shall also become null and void and the right of redemption restored upon the
PURCHASER'S failure to comply with the term and conditions 01 this agreement. Time is 01 the essence.
