At the meeting of the Planning Commission on March 15, 1988, the
following recommendation was made:
The application for Change of Zone No. 88-2 was unanimously
recommended for approval. The Negative Declaration for environ--
mental impact was also recommended for approval.

1. REQUEST
The applicant requests approval for a change of zone for
four parcels from R-I-IO,800, Single Family Residential
T, Transitional and for one parcel from R-1-7200 Single
Family Residential to T, Transitional. The intent of
the Zone Change is to allow for additional parking for
the Indian Bingo Parlor.
2. SITE LOCATION
The subject sites are located at the northwest corner of
Victoria Avenue and Marshall Boulevard and consisting of
four parcels totaling 2.01 acres.
3. MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The zone change from R-l, Single Family Residential to
T, Transitional would allow either the adjacent single
family use or a parking lot for the adjacent Indian
Bingo Parlor on the San Manuel Indian Reservation.
The zone change is not consistent with the letters from
the State Office of Planning and Research dated June 11,
1987, July 3, 1987, August 18, 1987, January 14, 1988
and February 5, 1988, which stipulates that "...land
uses proposed during the period of the extension wil be
consistent with the purpose of the updated general plan
provisions...." and with the City of San Bernardino
Housing and Scenic Highway Elements. It is, however, in
compliance with an Order of the Federal Court Case No.
85-6800-WJR(bx) . This Federal Court Order supersedes
local and State requirements.
4. CEQA S'l'ATUS
An initial study was prepared by staff and presented to
the Environmental Review Committee on February 18, 1988.
A Negative Declaration was recommended. The initial
study was available for public review and comment from
February 25 to March 9, 1988. No comments were
received. See Attachment "A", Initial Study.

5. BACKGROUND
The Indian Bingo Parlor was constructed in 1986 on the
San Manuel Indian Reservation adjacent to the site of
the proposed change of zone. Because the Indian Re-
servation and Bingo Parlor are on Federal lands, no City
review or approval was required or requested. Four
single family residences on the subject property were
constructed prior to the construction of the Bingo
Parlor. A Federal Court Order in the Case of the City
of San Bernardino vs. San Manuel Band of Mission Indions
et a1., that mandated the change of zone from single
family residential to transitional to allow for
additional parking for the Indian Bingo.
6. ANALYSIS

The four parcels at the northwest corner of Victoria
Avenue and Marshall Boulevard are large enough in
acreage to accommodate either the residential use or
parking and provide adequate access from a dedicated
street. The one parcel is located at the northeast
corner of Piedmont and Victoria is adequate to
accommodate the residential use and a small parking
area.

The general vicinity is predominately single family
residential to the south of both areas of the site. The
Indian Bingo Parlor and Health Center are the only other
uses in the area. Some vacant land is located north and
west of the site. The San Manuel Indian Reservation is
located to the north and east of Victoria. The property
to the north and west of Victoria is vacant.

The change of zone to transitional would not increase
traffic of the area. The change of zone will allow for
demolition of the existing homes and construction of
parking lots. The parking lots are to be provided for
the Bingo Par]or which is the generator of traffic in
the area.

No conwents have been received.
8. The change of zone to transitional is not consistent
with the letters from the Office of Planning & Research,
but has been required pursuant to a Federal Court Order.
The.change of zone will allow either a single family use
or a parking lot. The parking lot would allow addi-
tional parking for the Indian Bingo Parlor and the
adjacent San Manuel Indian Reservation.
9. RECOMMENDATION
Staff recommends that the Planning Commission:
1. Approve the Negative Declaration; and
2. Approve Change of Zone 88-2.

2 .0 EXECUTIVI': SUMMARY
2.1 Proposed Project
The request is for approval of a zone change of 5 parcels
from R-l, Single Family Residential to T, Transitional. Four
of the parcels are located at the northwest corner of
Marshall and Victoria Avenue, one parcel is located at the
northeast corner of Victoria Avenue and Piedmont. The total
acreage of the site is 2.24 acres.
2.2 Project Impacts
Impacts identified in the attached checklist include:

2. The proposed zone change may result in a change of

3.0 Project Description
3.1 Location
The sites are located at the northern terminus of Victoria
Avenue, near the San Manuel Indian Reservation. Four parcels
are located on the west side of Victoria, north of Marshall.
One parcel is located on the east side of Victoria, north of
Piedmont Drive on the northeast corner.
3.2 Site and Project Characteristics
3.2.1 Existing Conditions
Three of the parcels are rectangularly shaped and two are
irregularly shaped. The site has a total of 2.24 acres.
Four of the parcels on the site presently have single family
homes on them, one is vacant. The site on Victoria and
Marshal] is bordered by vacant land to the north and west, 3
modular homes to the south and Indian Bingo and San Manuel
Indian Health on the east. The site on Victoria and Piedmont
is bordered by single family homes to the east and south,
Indian Bingo to the north and a parking lot to the east.
3.2.2 Project Characteristics
The zone change is from Single Family Residential to

The subject area has ~ vacant lot. The other ~ lots have
been developed with single family dwellings. Although the
area in general has a slight slope, the lots have been graded
into buildable pad areas.
