REOUEST
Mrs. Helen Kopczynski is requesting that the Mayor and Common
Council overturn the Planning Commission's decision to reduce
the setback requirements for Review of Plans No. 88-41.
BACKGROUNP
Review of Plans No. 88-41, a project to construct ten con-
crete, tilt-up, light industrial buildings located in the
State College Industrial Park at the northeast corner of
Hallmark Parkway and Saratoga Way on about 18 acres in the M-
1A zone. This project proposal is consistent with the II,
Industrial Light land use designation of the Interim Policy
Document.
Review of Plans No. 88-41 was reviewed by the Development
Review Committee on May 26, 1988. The Committee recommended
approval of the project subject to the Planning Commission
reducing the setback requirement from 50 feet to 20 feet.
The San Bernardino Municipal Code, Section 19.38.070, allows
the Planning Commission to reduce the setback requirement.s in
the M-IA zone from 50 feet to 20 feet if there is uniformity
of setbacks with the adjoining properties which is not
detrimental to the neighboring properties; and, there is an
approved site development plan substantiating the necessity
for the reduction. This is not a Variance but an adjustment
procedure allowed by Code.
At the June 21, 1988 meeting of the Planning Commission, the
Commission voted to reduce the setback as allowed by Code.
The appeal is to overturn the reduction granted by the
Planning Commission. The appeal cites a concern of the
precedent that would be estabJished for the rest of the
development in the industrial park at the reduced setback. A
precedent may be established, but the Planning Commission is
not bound or required to reduce the setback in the future.
The appeal letter raised two issues. The first issue was
whether or not the reduction would further the Redevelopment
Agency Plan for this area. The proposed project lies within
the State College Redevelopment Project Area. This plan
requires a 20 foot from curb face setback and the developer
was using this standard during the design process. There-
fore, the Fedevelopment Plan was being followed. It was not
until the project came before the Development Review Com-

mittee that the more restrictive zone district setback was
noticed.
The second issue raised in the appeal letter was what was the
"legal nexus" or connection for approving the reduction as
required by Code. The site development plan for the project
details where the reductions would be required. The redevel-
opment plan has not detailed a plan for large setbacks in the
industrial park, and the underlying zone district is not
consistent with that plan in terms of setback requirements.

Parkway and Saratoga Way adjacent to the Interstate 215
Freeway within the State College Industrial Park.
MUNICIPAL CODE AND GENERAL PLAN CONFORMANCE
The proposed project is consistent with the Interim
Policy Document and is consistent with the M-1A, Limited
Light Industrial Zone, with the requested variance of
development standards.

Project Review Committee.
5. BACKGROUND
Review of Plans 88-41 was reviewed by the Development
Review Committee on May 26, 1988. The Committee
recommended approval of the project subject to the
Planning Commission reducing the front setback of the
project in certain cases. Parking spaces provided total
602. Due to the number, building occupancy will be
limited to 66% speculative industrial and 34%
warehousing. A condition reflecting such is included.

The front setbacks as being proposed for the ten
buildings are as follows:

All other aspects of the development in regards to side
setbacks and parking meet Code requirements.
In most cases except for buildings 8, 9 and 10, the
buildings are situated at an angle to the front property
line. The nearest point of the building is at 20 feet
and the furtherest poJnt of the front of the building is
at from 30 feet (Building 2) to 117 feet (Building 4).

The criteria within M-lA zone states:
"19.38.070 Yards
A. Front. Each front yard shall have depth of not
less than fifty feet. The front twenty feet of
such front yard shall be suitably landscaped with
plants, shrubbery or artificial landscape materials
which shall be adequately maintained. The planning
commission may reduce the front yard setback to not
less than twenty feet subject to its approval with
conditions of a specific plan of site development
substantiating the necessity for such reduction and
shall consider the uniformity of setbacks of
adjoining properties detriment to neighboring
properties and any unusual conditi.ons of the site
or proposeo development."
It is the provision for which the Planning Commission
may reduce the front setback for a specific plan of
development for the proposed industrial buildings the
applicant is requesting such a reduction. The adjacent
properties are vacant, so uniformity of setback is not
at issue.
The proposed project lies within the State College
Redevelopment Project Area. the Redevelopment Plan
requires a 20 foot from curb face front setback. It was
this standard the developer used throughout the planning
process. It was not until the project came before the
Development Review Committee that the setback
discrepancy was noticed.
The applicant has been working with the Redevelopment
Agency to resolve the setback issue. The agency has
indicated approval of the proposed setback since it is
in compliance with the project area standard. The
project plans generally state that whichever standard if
nlore restrictive shall prevail when a conflict between
project standards and zoning code exists. Since the
code allows the Planning Commission to reduce the
setback to not less than twenty feet, the applicant has
elected this route to gain approval of the project.

The project meets the intent of the Code in that the
applicant meets the minimum setback requirement of 20
feet for each case and in some cases exceeds the setback
by a substantial amount of footage. The average front
setback for the entire project is 52.3 feet so on an
average, the development exceeds the front setback
requirements. No other buildings are adjacent to the
subject site which would be impacted by the reduction of
the request.

MECHANICAL EQUIPMENT:
a. Air conditioning and vent ducts shall be directed away from any adja-
cent residential uses.
b. All mechanical equipment located on the roof shall be screened and
located away from adjoining residential uses. Screening design shall
be approved by the Planning Department.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of. bare soil exposed to precipitation.
Dur;nq construction, the City Engineer may require a fence around all or a
porlion of the periphery of the site to minimize wind and debris damage to
~dja(ent properties. The type of fencing shall be approved by the City
Engineer to assure adequate project site maintenance, clean-up and dust

Within 75 feet of any single-family residential district, the maximum
height of any bU1lding shall not exceed one-story or 20 feet unless the
Commission determines that due to unusual topographical or other features.
Such restrictive height is not practical. .

POLICE DEPARTMENT REQUIREMENTS
SECURITY LIGHTING
Lighting levels on the exterior of building is to provide a minimum of one
(1) foot candle of "maintained" illumination on the parking surface from
dusk until the termination of business each operating day.
All exterior doors to building shall be equipped with an illumination
device capable of providing a minimum of one (1) foot candle of maintained
illumination at ground level during hours of darkness.
All exterior lighting devices are to be inaccessible to common reach or
climbing shall be protected by weather and vandalism-resistant and be
valdal resistant. All exterior lighting shall be projected so as not to
cast light onto adjoining properties.
All roof openings giving access to the building shall be secured with
?ither iron bars, metal gates, stamped metal or shall be alarmed and meet
with approval of the Police Department.
Interior night lighting shall be maintained in those areas that are visible
from the street (ground floor only). .

Swinging exterior glass doors, wood or metal doors with glass panels, solid
wood or metal doors shall be constructed or protected as follows:
J. Wood doors shall be of solid core construction with a minimum thickness
uf 1 3/4 inches.
b. Hollow metal doors shall be constructed of a mlnlmum equivalent to six-
tepn U. S. guage steel and have sufficient reenforcement to maintain
the designed thickness of the door when any locking device is installed
'uch as reenforcement being able to restrict collapsing of the door
arou nd th e lock i ng devi ce.
c. Except when double cylinder dead bolts are utilized, any glazing uti-
lized within 40' of any door locking mechanism shall be constructed or
protected as follows: Fully tempered glass or rated burglary resistant
glazing or iron or steel grills of at least 1/8" metal with the maximum
2" mesh secured on the inside of the glazing may be utilized or the
glazing shall be covered with iron or steel bars of at least 1/2" round -
or 1" x 1/4" flat metal, space not more than 5" apart and secured on
the inside of the glazing.
All swinging exterior wood and steel doors shall be equipped as follows:

a. A single or double door shall be equipped with a double or single
cylinder dead bolt. The bolt shall have a minimum projection of 1" and
be constructed so as to repel cutting tool attack.
b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner portion of the lock by connecting screws of at least 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.

Double doors shall be equipped as follows:
a. ihe active leaf of double doors shall be equipped with metal flush
bolts having a minimum embedment of 5/8" into the head and threshhold
nf the door frame. Double doors shall have an astragal constructed of
~,teel, a minimum of .125" thick which will cover the opening between
the doors. This astragal shall be a minimum of 2" wide and extended a
minimum of 1" beyond the edge of the door to which it is attached. The
astragal shall be attached to the outside of the active door by means
of welding or with nonremovable bolts spaced apart on not more than 10"
centers. Hinges for outswinging doors shall be equipped with nonremo-
vable hinge pins or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a minimum of 3t" in length and secured to the jamb with screws a
minimum of zt" in length.
Windows:
a.r;,ll moveable windows shall be equipped with a locking device and shall

d. The above-described doors shall conform to the following standards:
(1) Wood doors shall have panels a minimum of five-sixteenths (5/16)
inch in thickness with the locking hardware being attached to the
support framing.

Aluminum doors shall be a mlnlmum thickness of .0215 inches and
riveted together a minimum of eighteen (18) inches on center along
the outside seams. There shall be a full width horizontal beam
attached to the main door structure which shall meet the pilot, or
pedestrian access, door framing within three (3) inches of the
strike area of the pilot or pedestrian access door.

(3) Fiberglass doors shall have panels a mlnlmum density of six (6)
ounces per square foot from the bottom of the door to a height of
seven (7) feet and panels in residential structures shall have a
density of not less than five (5) ounces per square foot.
b. Where sliding or accordion doors are utilized, they shall be equipped
with guide tracks which shall be designed so that the door cannot be
removed from the track when in the closed and locked position.
c. Doors that exceed sixteen (16) feet in width shall have two (2) lock
receiving points; or, if the door does not exceed nineteen (19) feet, a
single bolt may be used if placed in the center of the door with the
locking point located either in the floor or door frame header.
d. 0verhead doors shall be equipped with slide bolts which shall be
capable of utilizing padlocks with a minimum nine-thirty-seconds (9/32)
inch shackle.
(1) Slide bolt assemblies shall have a frame a minimum of .120 inches
in thickness, a bolt diameter a minimum of one-half (!) inch and
protrude at least one and one-half (I!) inches into the receiving
guide. A bolt diameter of three-eights (3/8) inch may be used in a
residential building.
:2) Slide bolt assemblies shall be attached to the door with bolts
which are nonremovable from the exterior. Rivets shall not be used
to attach such assemblies.
o. Padlocks used with exterior mounted slide bolts shall have a hardened
steel shackle a minimum of nine-thirty-seconds (9/32) inch in diameter
wi th heel and toe locking and a minimum five (5) pin tumbler operation.
The key shall be nonremovable when in an unlocked operation.

tumbler operation with the bolt or locking bar extending into the
receiving guide a minimum of one inch.

Each building in the complex shall display street address numbers placed in
a prominent location as near the street as practical. Numbers shall be a
minimum of six (6) inches in height and a contrasting color to the
background.
All individual offices and buildings within the complex shall be clearly
identified by numbers, letters, or a combination thereof.
The exterior business walls shall be posted with Municipal Code
Section 9.52.070 relative to trespass.
