Mayor and Council Meeting of July 18, 1988 REOUEST Mrs. Helen Kopczynski is requesting that the Mayor and Common Council overturn the Planning Commission's decision to reduce the setback requirements for Review of Plans No. 88-41. BACKGROUNP Review of Plans No. 88-41, a project to construct ten con- crete, tilt-up, light industrial buildings located in the State College Industrial Park at the northeast corner of Hallmark Parkway and Saratoga Way on about 18 acres in the M- 1A zone. This project proposal is consistent with the II, Industrial Light land use designation of the Interim Policy Document. Review of Plans No. 88-41 was reviewed by the Development Review Committee on May 26, 1988. The Committee recommended approval of the project subject to the Planning Commission reducing the setback requirement from 50 feet to 20 feet. The San Bernardino Municipal Code, Section 19.38.070, allows the Planning Commission to reduce the setback requirement.s in the M-IA zone from 50 feet to 20 feet if there is uniformity of setbacks with the adjoining properties which is not detrimental to the neighboring properties; and, there is an approved site development plan substantiating the necessity for the reduction. This is not a Variance but an adjustment procedure allowed by Code. At the June 21, 1988 meeting of the Planning Commission, the Commission voted to reduce the setback as allowed by Code. The appeal is to overturn the reduction granted by the Planning Commission. The appeal cites a concern of the precedent that would be estabJished for the rest of the development in the industrial park at the reduced setback. A precedent may be established, but the Planning Commission is not bound or required to reduce the setback in the future. The appeal letter raised two issues. The first issue was whether or not the reduction would further the Redevelopment Agency Plan for this area. The proposed project lies within the State College Redevelopment Project Area. This plan requires a 20 foot from curb face setback and the developer was using this standard during the design process. There- fore, the Fedevelopment Plan was being followed. It was not until the project came before the Development Review Com- Appeal of Reduction in Setback Requirement for RP No. 88-41 Mayor and Council Meeting of July 18, 1988 Page mittee that the more restrictive zone district setback was noticed. The second issue raised in the appeal letter was what was the "legal nexus" or connection for approving the reduction as required by Code. The site development plan for the project details where the reductions would be required. The redevel- opment plan has not detailed a plan for large setbacks in the industrial park, and the underlying zone district is not consistent with that plan in terms of setback requirements. The Committee recommended approval of the project subject to the Planning Commission reducing the front setback of the project in certain cases. Parking spaces provided total 602. Due to the number, building occupancy will be limited to 66% speculative industrial and 34% warehousing. A condition reflecting such is included. 6. In most cases except for buildings 8, 9 and 10, the buildings are situated at an angle to the front property line. The nearest point of the building is at 20 feet and the furtherest poJnt of the front of the building is at from 30 feet (Building 2) to 117 feet (Building 4). ~ . Each front yard shall have depth of not less than fifty feet. The front twenty feet of such front yard shall be suitably landscaped with plants, shrubbery or artificial landscape materials which shall be adequately maintained. The planning commission may reduce the front yard setback to not less than twenty feet subject to its approval with conditions of a specific plan of site development substantiating the necessity for such reduction and shall consider the uniformity of setbacks of adjoining properties detriment to neighboring properties and any unusual conditi.ons of the site or proposeo development." It is the provision for which the Planning Commission may reduce the front setback for a specific plan of development for the proposed industrial buildings the applicant is requesting such a reduction. The adjacent properties are vacant, so uniformity of setback is not at issue. The proposed project lies within the State College Redevelopment Project Area. the Redevelopment Plan requires a 20 foot from curb face front setback. It was this standard the developer used throughout the planning process. It was not until the project came before the Development Review Committee that the setback discrepancy was noticed. The applicant has been working with the Redevelopment Agency to resolve the setback issue. The agency has indicated approval of the proposed setback since it is in compliance with the project area standard. The project plans generally state that whichever standard if nlore restrictive shall prevail when a conflict between project standards and zoning code exists. Since the code allows the Planning Commission to reduce the setback to not less than twenty feet, the applicant has elected this route to gain approval of the project. \0... COMMEN~$.~~G~lV~P No comments were received. 8 .GQ~CJ.JJ.~ The project meets the intent of the Code in that the applicant meets the minimum setback requirement of 20 feet for each case and in some cases exceeds the setback by a substantial amount of footage. The average front setback for the entire project is 52.3 feet so on an average, the development exceeds the front setback requirements. No other buildings are adjacent to the subject site which would be impacted by the reduction of the request. 9 . Compliance with all recommendations of the Geology Report shall be required (if applicable). Grading and revegetation shall be staged as required by the City Engineer in order to reduce the amount of. bare soil exposed to precipitation.
