The funding level of each Cal Fire Urban Forestry grant program may be adjusted based on the applications received and funds available to Cal Fire for these purposes. Funding of the program is established through Proposition 40, California Clean Water, Clean Air, Safe Neighborhood, Parks, and Coastal Protection Act of 2002 and Proposition 84, Safe Drinking Water, Water Quality and Supply, Flood Control, River and Coastal Protection Bond Act of 2006. Eligible applicants include cities, counties, qualifying districts, or nonprofit organizations. The purpose of the Green Trees for the Golden State grant program is to provide funding for urban tree planting projects and up to two years of initial maintenance. Preference will be given to tree planting projects that provide multiple benefits, with an emphasis on greater air quality benefits and greater energy conservation benefits. Additional benefits that may be taken into consideration include: storm water runoff reduction, storm water quality improvement, improvement of public health, creation of "green jobs", social benefits, and environmental justice It is anticipated that proposals funded will not be less than $30,000, nor greater than $100,000 each. Current Issue: In September 2010, the City of San Bernardino Economic Development Agency (the "Agency"), on behalf of the City, submitted a concept proposal application in the amount of $99,982 to Cal Fire for the 2010/2011 Cal Fire Urban Forestry Grant Program. The application was made for the San Bernardino Downtown Urban Forest Project. The Project will create, develop and implement a large- canopy urban forestry tree planting project for San Bernardino's historic Downtown as part of the City's revitalization strategy based on the Downtown Core Vision & Action Plan and current planning and design efforts of the Downtown San Bernardino Streetscape Project. The implementation of an urban forest will add to planned and proposed public improvements that will help the Downtown be more livable, pedestrian-friendly and safe for residents and visitors alike. This project covers six (6) city blocks on Fourth (4th) and Fifth (5th) Streets, west of "E" Street, between the 1-215 Freeway and "E" Street, providing a gateway into Downtown and along 4th Street to the California Theatre and Theater Square Entertainment District, and improving the experience for everyone in the Downtown where few urban forest resources exist. At the same time the Agency submitted its proposal, the Sustainable Communities Reinvestment Partnership (SCRP) also submitted a similar proposal for the same area east of "E" Street" and another proposal to use geothermal runoff water to irrigate such street trees. --------------------------------------------------------------------------------------------------------------------------------------------------------- P:lAgendaslComm Dev CommissionlCDC 20] 110]-10-] I Cal Fire Urban Forestry Grant Application SR.docx COMMISSION MEETING AGENDA Meeting Date: 01/10/2011 Agenda Item Number: ~ Economic Development Agency Staff Report Cat Fire - Urban Forestry Grant Program and Application Page 2 In addition, another benefit of the Project would help to achieve the following: · improve air and water quality, · promote public health, · increase infill and compact development, · revitalize urban and community centers, · improve infrastructure systems, and · promote energy efficiency and water conservation On December 6, 2010, the Agency received a letter informing them that their, "concept application has been ranked high enough to be eligible for the next step in the Green Trees for the Golden State" (similar letters were received for the SCRP Grants). The next step in this process for applying for this grant program is the submittal of the final application/proposal. Agency Staff is working to complete and submit the final application/proposal package by the due date, January 22, 2011. The final application/proposal package also requires a resolution of the Mayor and Common Council of the City of San Bernardino ("MCC Resolution"), to go along with the final application/proposal. It should be noted that due to the submittal due date of the grant application/proposal, and scheduling of the next Redevelopment Committee Meeting (Thursday, January 13, 2011), the Redevelopment Committee has not had an opportunity to consider this item nor taken any action. Agency Staff has contacted each Committee member and informed them of the Cal Fire - Urban Forestry Grant Program opportunity. ENVIRONMENTAL IMPACT: The action of preparing the Cal Fire - Urban Forestry Grant Program application does not meet the definition ofa "project" under Section 15378 of the California Environmental Quality Act (CEQA). FISCAL IMPACT: There is no fiscal impact to the City's General Fund by the preparation of a Cal Fire - Urban Forestry Grant application. Research and grant preparation costs are borne by the Agency. RECOMMENDATION: That the Mayor and Common Council adopt the attached Resolution. ~ Emil A. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO APPROVING THE FORM OF AND AUTHORIZING THE SUB MITT AL OF THE APPLICATION FOR GRANT FUNDS FROM THE CAL FIRE - URBAN FORESTRY GRANT PROGRAM ENTITLED, "GREEN TREES FOR THE GOLDEN STATE" AS PROVIDED THROUGH PROPOSITIONS 40 AND 84 WHEREAS, the City of San Bernardino (the "City"), is a municipal corporation and a 8 charter city duly created and existing pursuant to the Constitution and laws of the State of 9 California; and 10 WHEREAS, the Mayor and Common Council of the City of San Bernardino (the "Common 11 Council") is the legislative body for certain actions and activities of the Redevelopment Agency of 12 the City of San Bernardino (the "Agency"); and 13 WHEREAS, the people of the State of California in cooperation with the California State 14 Legislature have enacted Propositions 40 and 84, which provide funds to the State of California and 15 its political subdivisions for urban forestry programs; and 16 WHEREAS, the State Department of Forestry and Fire Protection has been delegated the 17 responsibility for the administration of this grant program within the State, setting up necessary 18 procedures governing application by local agencies and non-profit organizations under the program; 19 and 20 WHEREAS, said procedures established by the State Department of Forestry and Fire 21 Protection require the applicant to certify by resolution of the legislative body the approval of the 22 application before submittal of said application to the State; and 23 WHEREAS, the City as the applicant, if selected, will enter into an agreement with the State 24 of California to carry out an urban forestry project. 25 NOW, THEREFORE, IT IS HEREBY RESOLVED, DETERMINED AND ORDERED B 26 THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO, A 27 FOLLOWS: 28 1 P:\AgendasIResolutions\Resolutions\2011\OI-IO-11 Urban Forestry Grant Program MCC Reso.doc ::L~ v2. 2.\ ~A\.l\)U() MtC 0\-\0--\ \ 1 Section 1. The Common Council herby approves the form of and the filing of an applicatio 2 on behalf of the City through the Agency in order for the City to receive Urban Forestry Gran 3 Programs Funds pursuant to Propositions 40 and 84. 4 Section 2. The Common Council herby certifies that the City through the Agency as th 5 applicant will have sufficient funds to develop the final application/proposal for the City to secur 6 Urban Forestry Grant Program Funds or will secure the resources to thus develop said fina 7 application/proposal. 8 Section 3. The Common Council herby certifies that the City through the Agency as th 9 applicant will have sufficient funds to begin, operate and maintain the project. 10 Section 4. If selected, the Common Council herby certifies that the City as the applicant wil 11 expend the Urban Forestry Grant Program Funds prior to March 30, 2013. 12 Section 5. The Common Council hereby certifies that the proposal for the City to receiv 13 Urban Forestry Grant Program Funds and the implementation and administration thereof wil 14 comply with any and all applicable laws and regulations. 15 Section 6. The Common Council hereby appoints the Interim Executive Director of th 16 Agency in the manner as provided in the application or his designee, as agent to conduct al 17 negotiations, execute and submit all documents including, but not limited to applications 18 agreements and payment requests but only upon the State approval of the application and th 19 designation of the City as a sustainable community. Such actions of the Interim Executive Directo 20 as may be necessary for the completion of the aforementioned project shall be subject to suc 21 subsequent official actions as may be taken by the Common Council to specifically authorize th 22 expenditure of funds as may be required from time to time after such time as the City has bee 23 designated as a sustainable community by the State upon approval of the previously submitte 24 application. 25 Section 7.
