The resolution has subsequently been amended by Resolution Nos. 82-402, 83-462, 84-17, 84- 428,85-97,86-105,88-420,89-16,91-12,92-466, 94-31, 94-362, 96-381, 97-23, 98-333, 2000- 355, 3001-345, 2002-328, 2004-338, 2006-374, 2008-376 and 2009-1 to add or delete positions required to file, or to change filing requirements and/or position titles of the various positions and/or committees contained in the code. Clark, CMC, City Clerk Resolution of the Mayor and Common Council adopting an amended Conflict of Interest Code and rescinding Resolution No. 2009-1 Council Meeting: December 20, 2010 Background: The Political Reform Act requires every local government agency to review its Conflict of Interest Code biennially to determine if it is accurate and up-to-date, or alternatively, whether the Code must be amended. In 2009 the Fair Political Practices Commission (FPPC) notified us that there were a number of areas of the Code which should be amended. Specifically, FPPC asked that the following areas be amended: o Add standard language indicating that the 87200 filers are listed in the code for information purposes only. o Include a cover page that incorporates Regulation 18730, and delete language that duplicates the language incorporated in Regulation 18730. o Create disclosure categories. o Consultants are required to file annual Form 700's in addition to the assuming and leaving office 700's required in the code. Recommended deleting this language from the code. Since then, several departments have been reorganized. Given the fact that FPPC requested that our Code be amended and taking into account the reorganization of several departments, representatives from the City Attorney's Office and the City Clerk's Office have given an in- depth analysis of our existing Conflict of Interest Code and the disclosure categories. The City Attorney's Office has prepared the attached Resolution that brings the City's Conflict of Interest Code up to date. Additionally, the Disclosure Categories have been revised, as requested by FPPC. U sing current organization charts for each department and the proposed disclosure categories, representatives from the City Attorney's Office and the City Clerk's Office made preliminary recommendations on disclosure categories for positions on the organization charts. Subsequently, City Clerk Clark and Deputy City Clerk Hartzel met with each department head, or a representative, to confirm that the disclosure categories we had identified fit the position for the designated filers, as well as to assist us in identifying any positions that should be added or deleted from the list of designated filers. Attached is a list of the designated filers and their disclosure categories. Financial Impact: Although there is significant staff time involved in processing Statements of Economic Interests and answering conflict of interest questions, the recommended changes would not result in significant added fiscal impact. RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO ADOPTING AN AMENDED CONFLICT OF INTEREST CODE AND RESCINDING RESOLUTION NO. 2009-1. WHEREAS, the City of San Bernardino is required by the Political Reform Act of 1974 (Govt. Code section 81000 et seq; hereinafter referred to as "Act") to adopt a Conflict of Interest Code; WHEREAS, the Fair Political Practices Commission has adopted a regulation (2 California Code of Regulations section 18730) containing a model Conflict of Interest Code ("Model Code"), which if incorporated by reference along with a designation of employees and formulation of disclosure categories by the City will constitute the Conflict of Interest Code required by the Act; WHEREAS, the terms of 2 California Code of Regulations Section 18730 and any amendments to it duly adopted by the Fair Political Practices Commission were incorporated by reference by Resolution No. 82-99; and WHEREAS, the City is required to review its conflict of interest code every two years and the City now wishes to readopt and update its conflict of interest code. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Resolution No. 2009-1 is hereby rescinded. SECTION 2. The terms of the Model Code set forth in 2 California Code of Regulations Section 18730, as such may be amended from time to time by the Fair Political Practices Commission, are duly adopted and incorporated by reference as if set forth fully herein. SECTION 3. For purposes of the requirements of the Act and the provisions of the Model Code, the Designated Employees of the City of San Bernardino shall be the persons holding those offices and/or positions set forth in appendix "A", attached hereto and incorporated by reference herein. fF8fJ {;;?-'dtJ-CJo I 1 SECTION 4. For purposes of the requirements of the Act and the provisions of the 2 Model Code, the disclosure categories of the City of San Bernardino shall be the categories 3 set forth in Appendix "B", attached hereto and incorporated by reference herein. 4 SECTION 5. For purposes of the Act, the provisions of this Resolution, the Model 5 Code, and the attached Appendix "A" and "B" shall together constitute the Conflict of 6 Interest Code of the City of San Bernardino. 7 SECTION 6. Designated employees shall file their statements of economic interest 8 with the City Clerk of the City of San Bernardino, using forms prescribed by the Fair 9 Political Practices Commission. 10 SECTION 7. Statements for all designated employees will be retained by the City 11 of San Bernardino and will be available for inspection and reproduction pursuant to Govt. 12 Code section 81008. 13 SECTION 8. Following each Disclosure Category is a description of the Rf!2.Q.!l.i!.L~~Q.TI9.Dlicll}tere~ts which the Designated Employee must disclose when i!?!ilgl1ec! that Disclosure Category. When a financial interest is identified, reporting of the interest is made through the timely filing of FPPC Form 700. The FPPC Form 700 contains multiple schedules. To meet the reporting requirement for a single Disclosure Category, the Designated Employee may need to complete more than one FPPC Form 700 schedule.. Category 1 (Full disclosure): Interests in real property located within the jurisdiction of the City of San Bernardino or within two miles of the boundaries of the jurisdiction or within two miles of any land owned or used by the agency, as well as investments, business positions and sources of income, including gifts, loans and travel payments. Category 2: All investments, business positions and sources of income, including gifts, loans and travel payments. Category 3: Interests in real property located within the jurisdiction of the City of San Bernardino or within two miles of any land owned or used by the City of San Bernardino. Category 4: All investments and business positions in, and sources of income from, business entities that are engaged in land development, construction or the acquisition or sale of real property within the jurisdiction of the City of San Bernardino. Category 5: All investments, business positions and income from business entities that provide services, supplies, materials, machinery, vehicles or equipment of a type purchased or leased by the City. Category 6: All investments, business positions and income, including gifts, loans and travel payments from sources that provide purchased or leased facilities, goods, equipment, vehicles, machinery or services, including training or consulting services, of the type utilized by the designated employee's department. Category 7: All investments and business positions in, and sources of income from, business entities subject to the regulatory, permit, licensing application or other authority or entitlement of the designated employee's department.
