Receipts/Lease Agreements Finance: Council Notes: Agenda Item No. J S- IJ, d-o -C)()/ 0 CITY OF SAN BERNARDINO - REQUEST FOR COUNCIL ACTION Staff Report Subiect: Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the City Manager to execute two Use of Facilities Agreements by and between California State University, San Bernardino and the City of San Bernardino and Inland Empire Pony Baseball and the City of San Bernardino; allowing for both groups' collective use of Fiscalini Field from January 1,2011 through December 31,2011, with the option of three (3) one-year renewals; and repealing resolution 2010-26. Backe:round: The City, California State University, San Bernardino, and Inland Empire Pony Baseball have worked cooperatively for several years to effectively accommodate both the University's needs as well as those of the community at Fiscalini Field in Perris Hill Park. The University has used Fiscalini Field as its home practice site for the men's baseball team in the past. In fiscal year 09- 10, the University held their home games at Fiscalini Field. During this term of use, the University had provided $17,500 in lease payments for the year. The University has also provided facility improvements through the replacement of sideline fencing ($12,000 value), as well as seed, sand, fertilizer and labor toward the annual fall field renovations. Additionally, Pony has operated its youth hardball league at Fiscalini as well as hosted regional tournaments at the park bringing recognition and tourism revenue to the City. Staff from the Parks, Recreation and Community Services Department has been engaged in discussions with the University and Pony in an effort to enhance this community partnership. The Use of Facilities Agreements will contractually make Fiscalini Field the official home field of Cal State Baseball in lieu of building an onsite facility at the campus and a home field of play for Pony youth baseball. As a result, the Department will be able to stretch limited resources, while promoting recreation/sports in Perris Hill Park. It is anticipated that these Agreements between the University and Pony will also serve as a catalyst for activity and development along the Highland corridor. Pursuant to the agreement with the University, the college will continue to pay the City $17,500 per year by January 1st of each year for the use of Fiscalini Field. The University will also provide the following services during the term of the agreement: . Provide annual facility renovations/capital improvements approved by city staff (value - $12, OOO/year) . Provide basic user upkeep, i.e. dragging, chalking, watering and field preparation · Maintain all aspects of the interior and exterior of the Players' Clubhouse and batting cages for the University's exclusive use Pursuant to the agreement with Pony, the league will provide the following services during the term of the agreement: . Provide annual facility renovations/capital improvements approved by city staff (value - $6,000/year ) . Provide basic user upkeep, i.e. dragging, chalking, watering and field preparation . Maintain all aspects of the interior and exterior of the snack bar/concessions building for Pony's exclusive use Staff and players of the University and Pony have been responsible users of the facilities at Fiscalini Field in the past, and their knowledge of field maintenance and use as resources in this regard are welcomed assets to both Fiscalini Field and Perris Hill Park. An agreement was previously approved by the Mayor, Common Council and City Manager on February 16, 2010; however after meeting with both groups, staff has determined that revised cooperative agreements are required as a replacement to the prior year's agreement. Financial Impact: There is no cost to enter into agreements with the University and Pony; however terms with both users are required to complete facility improvements/renovations valued at $18,000 (collective) annually plus a $17,500 annual lease paYment from the University, in exchange for ball field and stadium use.
