I have received a letter dated Jan. 9, 1987 from the
Planning Director, Frank SchUI!\d regarding the Planning
Commission action on Jan.6, 1987 which in essence re-
versed the decisi6n of the Development Review Committee
granted to me on August 25, 1986. .
ARCHITECTURE
I grievously wish to state at this time that this adverse
decision places my client in a dilemma without benefit of
aid nor direction as to what anyone can hope to do to assist
in the endeavor to develop this ill-timed parcel of land
that would be financially feasible.
For four years now the owner has become perplexed by the
m3neuvering by various individuals, to halt the hopes and
patient progress to install a beautiful building that would
be a boon to the site.All this has been at a great expense
and effort, for which 80 far has come to naught.
Therefore, on behalf of my client) I wish to respectfully
submit this letter of appeal to be conducted through the
appropriate channels, so as to be heard in accordance with
the relevant Municipal Codes.

Dear Mr. Del'Andrae:
At the meeting of the Planning Commission on January 6, 1987,
the following action was taken:
The application for Review of Plans No. 86-43, to construct a
48 unit, three-story apartment complex on a rectangularly
shaped parcel of land consisting of approximately 1.3 acres
having a frontage of approximately 498 feet on the south side
of Mill street and being located approximately 200 feet west
of the centerline of Rancho Avenue in the R-3-l200 Multiple
Family Residential zone, was reviewed. Based upon aesthet-
ics, incompatibility with the surrounding area and the social
implications of the project, the Planning Commission reversed
the decision of the Development Review Committee and denied
Review of Plans No. 86-43.
According to the San Bernardino Municipal Code, Sections
2.64.030 and 2.64.040, the following would apply in regard to
appeals to the Mayor and Council of Planning Commission
actions: \
"Except as provided in Section 2.64.020., any person
aggrieved by, dissatisfied with, or excepting to any action,
denial, order, requirement, permit, decision or determination
made or issued by an administrative official or by an admini-
strative board, commission, body or other agency of the City
pursuant to the provisions of any ordinance, code, rule or

regulation of the City, may appeal therefrom by filing a
written notice of appeal with the City Clerk, directed to the
Common Council.
"Any such notice of appeal shall not be valid and shall not
be acted upon unless filed within fifteen days after the date
of the action or decision appealed from. If notice of such
action has not been provided in writing, and the appellant
had no notice of the hearing at which the action was to be
considered, the appellant may, within five days after first
becoming aware of such action, demand written notice thereof,
and shall have ten days following such notice in which to
file the notice of appeal. A prospective appellant who was
present at the time the action or decision relating thereto
was made shall be presumed to have constructive notice
thereof and shall file a notice of appeal within fifteen days
after the date of the action or decision."
If no appeal is filed pursuant to the previously mentioned
provisions of the San Bernardino Municipal Code, the action
of the Commission shall be final.

Review of Plans No. 86-43 is a proposal to construct a 48 unit, three-story
apartment complex on approximately 1.3 acres of land located on the southside
of Mill Street, west of Rancho Avenue and in the R-3-1200 Multiple Family
Residential zone. This item was originally presented to the Development
Review Committee for the review and approval at their meeting of May 16, 1986.
At the request of the Planning Department staff, the development proposal,
which was ultimately approved by the Development Review Committee at their
August 7, 1986 meeting, was altered several times to insure compatibility with
the surrounding area.
One of the issues concerning staff was the issue of three-story structures in
an area where the predominance of development is single story with some two-
story development in the immediate area.
The letter advising the applicant that the application had been approved was
dated August 25, 1986. The letter contained the approval along with the
appropriate standard requirements and conditions applicable to the project.
The letter further stated that the approval of Review of Plan~~o. 86-43 was
final unless appealed within 10 days of the date of the approval letter.
Councilman Hernandez, at a meeting of the Mayor and Council on August 18, 1986,
indicated his desire to appeal Review of Plans No. 86-43. At the City Council
meeting of September 8, 1986, Councilman Ralph Hernandez reaffirmed his appeal
of the decision of the Development Review Committee. A letter indicating such
was sent to the owner on September 25, 1986. The appeal was based on the pro-
posed three stories, and the incompatibility of the structure and resulting
density with the surrounding uses. Density at the site is proposed at 36
units per acre. Surrounding land uses include: a single family tract to the
north, directly across Mill Street; two-story apartments to the west; commer-
cial uses to the east; and single story apartment units to the south (these
are within the City Limits of Colton).
On November 5, 1986, Review of Plans No. 86-43 was before the Planning Commis-
sion to determine if the appeal by Councilman Hernandez was filed in a timely
and appropriate manner. At that hearing, it was determined that the appeal
had not been filed in a timely or appropriate manner.

On November 13, 1986, the November 5 decision of the Planning Commission was
appealed by Councilman Hernandez, in writing, to the City Clerk's office.
That appeal was heard at the December 22, 1986 meeting of the Mayor and Common
Council. At that meeting it was determined that the previous appeal was both
timely and appropriate, that the item should be reviewed by the Planning
Commission based on the merits of the proposed project, and that all property
owners within 500 feet of the project should be notified by mail of the hearing
date.
The proposed project was orginially approved by the Development Review
Convnittee based on the fact that it had met the minimum requirements of the
applicable codes in effect at the time. Since the original approval, a number
of revisions relative to appeal proceedures of the Development Review Committee
decisions and development standards of the R-3zone have become effective.
The proposed project does not correspond with the new standards of the adopted
R-3 ordinance regarding front and side setbacks, ground floor patios, required
open space and amenities, and building separations. The new ordinance also
prohibits 3-story structures on the periphery of a project.
Although the proposed project does not meet the new standards, the Planning
Commission is requested to review the project based on the applicable stan-
dards in effect at the time of the original approval.

Dear Mayor Wilcox and Members of the City Council:
The City of Colton has been made aware of the above-referenced appeal by a
local resident. I have been briefed as to the type of project which is being
considered for the area and am very much concerned. As you know. the proposed
apartments are to be located in an area adjacent to our City limits. While
I would never attempt to dictate to the City of San Bernardino what develop-
ment sho~ld be approved or denied, I believe that the two cities share common
concerns about approving proper development. Therefore, I wish to share with
you some of my concerns regarding the proposed development:
,
1. We have police and fire statistics for the area that are overwhelming.
The cost to the City to police and protect the existing apartment develop-
ment is extremely high and proportionately the highest in the City.
2. The proposed development has a density of thirty-six units per acre.
As you know, higher density projects tend to provide higher amounts
of aberrant behavior and thereby higher need for police. paramedic.
and fire services.
3. The schools in the area are already heavily impacted. I am aware of
the fees being collected to alleviate this type of situation. However.
there is a lag-time involved in providing new classrooms which will
exacerbate the impaction on our classrooms.
The City of Colton has been concerned enough regarding the above that our new
General Plan draft proposal would change all R-3 zoning in the area to R-1.
The City has also had long and numerous conversations with the apartment owners
on the northeast corner of Mill and Rancho and finally succeeded in having them
build a ten-foot high fence around their project and hire security guards.
Unfortunately, this came too late to save some of the lives of those people
murdered in the area, and it was too late to keep the businesses across the

street from leaving due to continuous robberies, thefts, and harassment of
customers.
I feel confident you will make the right and proper decision regarding this

in the areas of mutual concern as we have in the past.

The Colton Joint Unified School District is experiencing
a tremendous growth relative to student enrollment. The
District is very concerned with additional housing developm,nt
in that it will cause student impaction.
The District is well aware that the student forecast is
in an incline. However, the District is unsure whether
it can meet the housing needs of the students when the
projected housing developments are completed.
