Dear Mayor and Council:
Central City Company has succeeded in attracting a major new
restaurant to the downtown area. King's Table has agreed to take
approximately 10,500 sq. ft. on the upper level of Central City Mall
near the main arcade entrance. I know that this is something that the
City has been interested in for sometime, i.e., the addition of
restaurants in the downtown area that would be open at night and
increase evening activity downtown. King's Table is an excellent
buffet style restaurant that has a national reputation. It should be
a major addition to the Mall and to the downtown area, particularly in
its draw for dinner traffic in the evening.
King's Table has indicated an interest in improving the facade
treatment on its south elevation as it faces the City parking lot.
The facade would provide mainly decorative features that would enhance
the appearance of the Mall and the appearance of the restaurant. The
facade treatment requires a minor encroachment onto the sidewalk area
for a decorative column and planter treatment, framing the windows and
doors of the restaurant. There will also be an encroachment into air
space for the entrance canopy and a decorative awning above the
windows and doors. The specific details of the encroachment are shown
on the enclosed plan. I have personally examined the plan and the
area of encroachment and see no interference whatsoever with Mall
traffic and no restriction of pedestrian traffic or deliveries along
the sidewalk.
I think that this will be a good aesthetic improvement to the Mall as
well as a draw for evening trade. Of course, Central City Company and
King's Table will agree to maintain the structures that encroach upon
the City/Agency areas for the life of the structures and would further
agree to assume the liability for said encroachments as we have done
in the past. We would also agree to pay the City's cost of processing
this encroachment permit.

Time is very important in this matter and I am hopeful that you will
approve this permit at the next Council meeting as King's Table is
anxious to begin construction. I am sure that as our partner in this

excitement in the downtown area, activity in the evening and

2-18-86 -- Resolution No. 86-59 adopted, authorizing execution of a License
Agreement between the City's Redevelopment Agency, and Central City
Company, authorizing the encroachment of tenant stores into a portion
of the interior mall walkways.

That the request by the Central City Company for an
encorachment permit, to allow construction of an improved
facade on the south side of the Central City Mall, west of
the main entrance, for the King's Table Restaurant, be
approved in principle, and the City Attorney directed to
prepare the necessary License Agreement to authorize the
requested encroachments.

STAFF REPORT
A request was received from the Central City Company, by letter
dated 1-22-87, for an encroachment permit for an improved facade for the
proposed King's Table Restaurant. This facade will consist of frames around
the windows, and decorative columns and planters. The frames will extend
1 foot into the public sidewalk area, and the columns and planters will extend
2 feet. About 6 feet of clear sidewalk area will remain after these encroach-
ments are installed, which is considered adequate for the volume of pedestrian
traffic.
It is also proposed to install a canopy that will extend 6 feet over
the sidewalk. However, this canopy will be about 9.5 feet above the sidewalk,
which will not impair pedestrian access.
The plan shows a 500 gallon grease interceptor to be installed under
the sidewalk. We recommend that this facility be relocated within the
building, due to the continuing maintenance required.
The Central City Mall Company has agreed to assume responsibility for
maintenance and liability of the encroachments. A provision to this effect
will be included in the License Agreement.
Approval of a License Agreement is normally predicated upon payment
of an administrative fee, of at least $500, to cover the City's cost of pre-
paring and processing the necessary documents.
We have reviewed this request and feel that it will enhance the
appearance of the outside of the Mall, without creating a restriction to
pedestrian traffic or deliveries. Therefore, we recommend that the request
be approved.
The only change that we would recommend is to restrict the canopy
to 3 feet, as we feel this would be sufficient to accentuate the doorway.
