Synopsis of Previous Council action:
This property was first cited October 16,1981, for construction violations.
Problems have continued. The Board of Building Commissioners first heard this
matter on September 6, 1985, at which time abatement was ordered. The matter
was appealed to the Mayor and Common Council in November and continued to
January, then to March, then referred back to the Board of Building Commissioners
wi th a report to Councili n June, 1986. At the June meeti ng the matter was con-
tinued to the first meeting in September, 1986. At the September 8 meeting the
ma tter was conti nued to October 6, 1986. At the October meeti ng the Council
granted the owner 90 days to comply with all requirements.
Recommended motion:
That the findings and decision of the Board of Building Commissioners to vacate
the property and demolish the new construction, dated September 6, 1985, be
upheld provided that the project is not completed by a qualified contractor by
February 28, 1987. ---

1-12-87 Field inspection of property showed that owner is adding onto house again,
enclosing garage, creating new and more building code violations. The owner
still has not submitted plans or taken our permits or ca,lled for inspections.
Council gave owner 90 days to comply with all requirements (1-6-87)

This property is in an R-l zone, which allows a maximum coverage of 35%. This
lot is 7,560 square feet, 35% = 2,646 maximum, house is 3,150 square feet,
building exceeds maximum area by 504 square feet.
The garage was enclosed and no new garage was added.
The building was added onto and built too close to property line on the east
and north sides.
Floors are uneven, walls built without proper bottom plates, plumbing and
electrical and mechanical items are in unsafe condition. The owner has had
conversations with both Spanish speaking persons in this department about the
problems at this property. The owner still has not made any corrections.
10-23-85 Between 9-6-85 and 9-27-85 owner had 2 contractors of his choice come in and
they said the same thing that the Board of Building Commissioners ordered. The
building needs to be demolished to make repairs and major changes.

2 page correction letter to owner and noted no inspections called for. Owner
called and spoke to Mr. Fraga about letter
4-26-82 Letter to owner about zoning, R-l zone
10-16-81 6 page correction notice left. Inspector told owner he would have to make major
changes and indicating no inspections made or called for. This correction
letter was sent by Greg Fraga who was Plan Check Engineer for the Dept. of
Building & Safety and he spoke fluent Spanish. Mr. Fraga had had conversations
with the owner on what needed to be done.

This matter has continued since 1979 without owner complying with zoning or
building code requirements.
Alternative:
If work is not completed by a qualified contractor by February 28, 1987, the
decision of the Board of Building Commissioners would be 1n immediate effect.
