STAFF REPORT
The attached resolution will authorize the City Engineer to sign a Memorandum of
Understanding with Caltrans regarding the proposed Waterman onloff ramps on
westbound 1-10. The Redevelopment committee is recommending that the
Director of Public Works be authorized to sign the Memorandum of Understanding and
issue an RFP for the design of the ramps.
BACKGROUND
On July 21, 1986 the Commission adopted Resolution 4907 approving an agreement for
the construction of regional improvements for the Southeast Industrial Park and
Tri-City areas. The agreement, among other things, provided for new on and
off-ramps for Waterman at Interstate 10.
While not a party to the agreement, Caltrans will fund construction of the on-ramp
(RDA is funding the off-ramp). The developer is providing nearly all the
right-of-way for both ramps. Caltrans will do all the contract administration and
the Agency will provide the design engineering. The acquisition from Pinky Brier
is a part of the on-ramp to be provided by Caltrans. Approximate costs and values

We have now received the attached draft of a Memorandum of Understanding (MOU)
from Caltrans regarding the new onloff ramps. There have been significant delays
by Caltrans in obtaining approval from Sacramento for the MOU, but we expect to
receive an approved final copy shortly.
These delays have made RANCON very eager to proceed and the Redevelopment
Committee has recommended this item for this agenda. The MOU must be executed
before we can issue an RFP for the engineering and final design of the ramps. We
wish to issue the RFP as soon as possible because the selection process is long
and involved due to federal requirements regarding Minority Owned Businesses,
Women Owned Businesses, and other fair practices standards.
At the time the agreement was signed with Rancon, staff reported to the Commission
that the Agency's obligations were as follows:
Commit to funding of the design engineering of the new onloff ramp from
Interstate 10. Also commit to the funds to construct the off-ramp portion.
Caltrans staff has stated they will pay for the contract administration on
both the on and off-ramp as well as fund the on-ramp construction. Estimated
Agency costs are:

STAFF REPORT
These estimates have not been changed. We also reported that usable tax increment
would be $350,000 from the Rancon Development in Tri-City. This is only the part
of the Rancon's development that was pledged in the agreement. The balance of
their development will bring the total over $1,000,000 per year in five yeras.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
EXECUTION OF A MEMORANDUM OF UNDERSTANDING WITH THE CALIFORNIA
DEPARTMENT OF TRANSPORTATION CONCERNING INTERSTATE FREEWAY 1-10
ON AND OFF RAMPS AT WATERMAN AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
6 SECTION 1. The Director of Public Works/City Engineer is
7 hereby authorized to execute for and on behalf of the City of San
8 Bernardino a Memorandum of Understanding with the California
9 Department of Transportation concerning Interstate Freeway 1-10
10 on and off ramps at Waterman Avenue, in form substantially
11 similar to that which is dated October 14, 1986, and presented to
12 the Mayor and Common Council for consideration. The Director of
13 Public Works/City Engineer may approve a revised Memorandum
14 substantially like that provided, but which may also include
15 provisions for an additional twelve feet of freeway right-of-way
16 on the north side of the 1-10 freeway, between Tippecanoe and
17 Waterman Avenue, provided that such can be provided at no
18 additional cost to the City. If any substantive changes are made
19 in the draft Memorandum of Understanding, other than as noted
20 herein, the Director of Public Works/City Engineer shall bring
21 the revision back before the Mayor and Common Council for
22 consideration.

This is a "Memorandum of Understanding" between the State of ROUTECOpvL
California, Department of Transportation (Ca1trans) and the City
of San Bernardino (City), covering the project development and
construction phases of the new entry and exit ramps at the
Waterman Avenue Interchange on Interstate Route 10. The
improvements desired for this location are exit and entry ramps
from Interstate Route 10 to Hospitality Lane at the intersection
of Carnegie Road. The new westbound off-ramp construction
includes an auxiliary lane along RQ.ute 10 extending from the
westbound on-ramp of the Tippecanoe Avenue Interchange and removal
of the existing westbound off-ramp to Waterman Avenue. The new
westbound on-ramp from Hospitality Lane to Route 10, immediately
adjacent and to the west of the new off-ramp, includes widening
the Waterman Avenue Overcrossing to accommodate the westbound on-
ramp alignment and a crossing of the San Timoteo Creek Channel.
This "Memorandum of Understanding" constitutes solely a guide to
the respective Obligations, intentions, and policies of the
parties involved. It is not intended to authorize funding nor is
it a legally binding contract. Funding commitments providing for
The deposit of funds or specific work phases or project effort
committing machine or personnel time will be covered by one or
more separate cooperative agreements as may be outlined herein.
The fOllowing responsibilities have been identified and are
proposed to be agreed to by both parties:
1. City will fund 100% of all costs to construct the westbound
off-ramp from Route 10 to Hospitality Lane, removal of the
existing off-ramp, and construction of the aUXiliary lane on

Route 10 from the Tippecanoe Avenue Interchange. Costs shall
include, but not be limited to, design engineering cost,
right-of-way cost, and right-of-way utility cost. Caltrans,
at State expense, will pay for construction engineering,
review and coordination costs, and advertising and award
costs.
2. Caltrans will advise, direct, and review the City's planning,
environmental, right-of-way, and engineering efforts to
assure conformance to all applicable State and Federal
policies and procedures.
3. For the new westbound on-ramp the City will "protect" or
otherwise reserve sufficient right-of-way of the Tri-City
Corporate Center to allow construction of the on-ramp. All
required right-of-way must be deeded to Caltrans prior to
construction of the ramps and auxiliary lane. The City, at
City expense, will design the new on-ramp in conjunction with
the new off-ramp design.
4. Caltrans will, at State cost, construct the new on-ramp.
Caltrans will negotiate with any owner other than Tri-City
Corporate Center for right-of-way, at the Waterman Avenue
Interchange, required to construct the on-ramp. Should an
unanticipated right-of-way need be identified, the City will
be responsible for all right-of-way activities except utility
relocation. Caltrans, at State expense, will do the
construction inspection and contract administration for the
total project.
5. In the event the City is unable to secure services of an
agency or consultant certified in right-of-way procedures,
Caltrans will perform these activities and City will
reimburse Caltrans for cost of said services.
6. Caltrans will be the "Lead Agency" and City will be the
"Responsible Agency" for the preparation of the Environmental
Document (ED). City will prepare the ED to meet the
requirements of CEQA and NEPA. City will provide all data
for and prepare the Project Report (PR) and Project Approval
Report (PAR). Caltrans will review and process the reports
and request approval of the project and ED by the Federal
Highway Administration (FHWA). City will be responsible for
the public hearing process.

7. City and Caltrans concur that the proposal 1s a Category 3 as
defined in the Caltrans' Project Development Manual, on the
basis that the freeway agreement will require revision, and
that new right of way will be required.
8. City will submit the draft environmental documents to
Caltrans for review, comment, and approval. City will obtain
Caltrans approval before circulating the Draft.
9. City will be responsible for the preparation of Design Plans,
Specifications and Estimate (PS&E) for the project and the
obtaining of any necessary permits. At the State's cost,
Caltrans will prepare contract documents and advertise,
award, and administer the construction contract for the
proposed project.
10. Caltrans will review, monitor, and approve all project
development and environmental reports, studies and plans, and
provide all necessary implementation activities through
advertising of the project and will obtain all Caltrans and
FHWA approvals.
11. Caltrans will be responsible for all utility relocations.
City will reimburse Caltrans for cost of utility relocation
services.
12. City will discuss and obtain Caltrans approval of
consultant(s) selected for this project.
13. Caltrans will prepare cooperative agreements, defining more
specifically the responsibilities and costs of both parties
for each phase of work requiring expenditure of funds of
staff services by Caltrans.
14. Caltrans will actively pursue the required California
Transportation Commission (CTC) approval of all improvements
described above and seek the earliest possible inclusion of
this work into the State Transportation Improvement Program
(STIP) as a single construction project with the costs shared
between the City and Caltrans, as outlined above.
Caltrans will be responsible for preparation of the revised
freeway agreement and obtaining approval of the new public
road connection from the California Transportation
Commission.

15. All phases of the project, from inception through
construction~ whether done by City or Caltrans, will be
developed in accordance with all policies, procedures,
practices, and standards that Caltrans would normally
follow.
16. Note the areas of responsibility ~n the attached Project
Report Phase listing.
This MOU is a non-binding expression-of intent and may be modified
at any time with the concurrence of both agencies.
