Previous Planning Commission action:
At the meeting of the Planning Commission on January 6, 1987, the
proposed amendment to the San Bernardino Municipal Code, Section
19.26 - C-2 Community Commercial District, was unanimously recommended
for approval of the wording attached to the memOrandum to the Planning
Commission dated January 6, 1987.
The Negative Declaration for environmental impact was also recommended
for approval.
Recommenrjed motion:
To approve the responses to comments and to adopt the Negative
Declaration for environmental impact which has been reviewed and
considered.
To approve, modify or reject the findings and the recommendation
of the Planning Commission and to waive further first reading of
the ordinance and layover for final adoption.

BACKGROUND
Currently the San Bernardino Municipal Code lists only
automobile sales agencies in the C-2, Community Commercial
district, and subsequent commercial zones. The ordinance
does not define recreational vehicles, boats, motorcycles,
and trailers under automobile sales agencies.
The attached ordinance amendment to Section 19.26.020,
Subsection B(3) further expands the sales agency definition
as well as provides some restrictions with regard to outdoor
display, repair and servicing of vehicles.
The amendment is proposed for the C-2, Community Commercial
district zone, thereby allowing the aforementioned uses in
the C-3, C-3A, and C-M zones as well. Only the C-l,
Neighborhood Commercial district would prohibit such uses.
Typically such facilities are not appropriate in these
localized commercial districts that serve primarily the
surrounding neighborhood or community.
The ordinance amendment does not include a provlslon for
camper sales agencies or lots. These uses need to be located
in the M-l, Industrial districts or within an enclosed retail
space in the C-2, C-3, C-3A and C-M zoning district.
ENVIRQNMENTAL CLEbRANCE
The City Environmental Review Committee at their meeting of
December 18, 1986, recommended that the proposed ordinance
amendment receive a negative environmental declaration.

DO ORDAIN AS FOLLOWS:

7 SECTION 1. Section 19.26.020 Subsection B Paragraph 3 of
8 the San Bernardino Municipal Code is amended to read:
9 "3. Automobile sales agency, including sale of recrea-
10 tional vehicles, boats, motorcycles and trailers, with
11 incidental service and repairs shall be permitted subject to
12 the following provisions.

a. Outdoor display areas of both new and used
14 automobiles, recreational vehicles, boats, motorcycles or
15 trailers shall be separately delineated and no vehicles shall
16 be displayed in off-street parking spaces required by Chapter
17 19.56.

b. All repair and servicing of vehicles shall be
19 conducted entirely within an enclosed building."
20 SECTION 2. section 19.28.020 Subsection B of the San
21 Bernardino Municipal Code is amended to read:
22 "B. Retail Stores.

1. Commercial greenhouses (retail only);
2. Secondhand goods sold entirely within an enclosed
25 building (no junkyards);

3. Used cars and trailer sales lots (service and
27 repair facilities conducted entirely within a building)."

The regulations set forth in this chapter shall apply to the

It 'is unlawful for any person to use a building or land, or
to erect, structurally alter, enlarge or maintain a building except
for the following purposes:
A. Uses permitted in the C-l neighborhood commercial district;
B. Retail stores.

3 A. Used cars and trailer sales lots (service and repair facili-
ties conducted entirely within a building).
C. Services.
1. Amusement arcades, subject to a conditional use permit,
conditions for which shall include:
a. All amusement arcades shall be entirely within an
enclosed building.
b. The minimum distance between amusement arcades
shall be one thousand feet.
c. The minimum distance between an amusement
arcade and a school, religious institution or public
park shall be one thousand feet.
d. On days when the public schools of the San
Bernardino City Unified School District are in full
operation, amusement arcade operators shall not
permit persons under the age of eighteen years to
enter or remain in areas within the business establish-
ment designated for amusement arcades prior to
four p.m. on such school days.
e. No amusement arcade in which coin-operated game
machines constitute the source of more than fifty
percent of the total gross revenues of the business
enterprise with which it is situated, or in which such
game machines are the sole or primary business
occupation shall be open between ten p.m. of any
one day and six a.m. of the following day, except
for Friday and Saturday of each week, when the
hours of operation may continue until twelve-thirty
a.m. of the next succeeding day. Amusement
arcades operated incidental to a bona. fide food
serving establishment shall be operated only during
the hours during which food is actually being served,
and amusement arcades operated incidental to any
other primary business shall be operated only during
the hours the primary business is carried on.
f. Adult supervision shall be provided at all times
within areas designated for amusement arcades.
g. For any amusement arcade within a shopping
center, all partitioning walls shall consist of sound-

automobile sales agencies in C-1 districts. At a recent meeting of the San Bernardino Motor
Cars Dealers AffiOCiation, the membership found the ordinance suitab1e as "what we can live
with II .
Thank you and your Legislative Review Committee for your consideration of the needs
of our business activities.
I would -3ppreciate b:=ill1g notified of a Cit:y Council meeting on this matter so that
representatives of our association can be in attendance. I will be out of the State until
Nove m ber 18, and hope that official consideration of the matter will not occur until after
