Synopsis of Previous Council action: Previous Planning Commission action:
At the meeting of the Planning Commission on January 6, 1987, the
following recommendation was made:
The application for Change of Zone No. 86-24 was unanimously
recommended for approval. The Negative Declaration for environmental
impact was also recommended for approval.
The Planning Commission further recommended that the Mayor and Council
instruct the Planning Department staff to initiate a study of the area
on both sides of "F" Street for a distance yet to be determined both
north and south of this subject site for a mass change of zone from
C-4 Central Business District to R-3 Multiple Family Residential.
Recommended motion:
To approve the responses to comments and to adopt the Negative
Declaration for environmental impact which has been reviewed and
considered.
To approve, modify or reject the findings and the recommendation
of the Planning Commission and to direct the City Attorney to
prepare the necessary amendments to the zoning Code.

The applicant is requesting approval to change the zone
on a .45 acre parcel of land on the east side of "F"
street approximately 640 feet north of Tenth street,
from C-4, Central Business District to R-3-2000,
Multiple-Family Residential.
The General Plan designation is for Multiple-Family, 15-
24 dwelling units per acre. The purpose of the request
is to bring the zoning into conformance with the General
Plan.
North and south of the site the uses are primarily
multiple-family residential, with two small shops (a
locksmith and a cake bakery) being the exceptions.
These uses are in converted residential structures; the
zoning designation is C-4. Across "F" street, to the
west, the zoning is C-3, but the land use is a mix of
single-family and multiple-family residential units. To
the east, lots fronting on Acacia from Tenth street
north of Orange street are zoned R-3-l200, and each lot
is occupied by a residential use.

The feasibility of successful commercial development of
this area is not only unlikely, but also undesirable.
Investment by a commercial developer in the area would
not be economically justified, given the distance of the
intersection of 11th and "F" streets from the other
focal points of the Central Business District and other
developing business centers, such as the Hospitality
Lane area.

This portion of "F" Street would better serve the
objectives of the City's General Plan with a residential
zone, considering the existing residential land uses and
the General Plan designation of medium density
residential. with the existing zoning, all the
residential uses fronting on "P" Street are non-
conforming uses, and property owners may not maintain
structures beyond their useful life. A non-conforming
use will often deteriorate to a blight condition.

A similar request by a property owner in the immediate
area (seven parcels south) was submitted to the Planning
Commission in December, 1983. The application was
recommended for approval with an additional recommen-
dation to study and rezone the entire block. That
request was continued pending completion of the Uptown

Redevelopment Project. The application, Change of Zone
No. 83-28, was continued repeatedly until January 18,
1985, when due to the delays, the applicant finally
withdrew the request.
7. Although this particular block is not a part of the
Uptown Redevelopment Project, it is on the periphery of
the project area and recommendations in that report
included surrounding areas. Two alternative zoning
proposals were made for the subject site and block.
Both recommendations were for R-3, MUltiple-Family
zoning.
8. At their regularly scheduled meeting of December 4,
1986, the Environmental Review Committee recommended a
negative declaration be adopted for Change of Zone No.
86-24.
RECOMMENDATION
Staff recommends approval of Change of Zone No. 86-24 based
on the observations contained herein. Staff further
recommends the Planning Commission to recommend to the Mayor
and Common Council that staff initiate a study of the area
for a mass change of zone on both sides of "F" Street for a
distance yet to be determined both north and south of this
subject site, from C-4, Central Business District to R-3,
Multiple-Family Residential.
