I wish to appeal the Planning Commission's approval of
Tentative Tract No. 13473 on the basis that the site is not
physically suitable for the type of development which is
being proposed and that the method of ownership is not in the
City's best interest.
I have reviewed the facts concerning the Planning
Commission's approval and still believe that the subdivision
of the land having a multitude of ownerships could create
some serious enforcement problems for the City in the future.
It is my opinion that the ownership should remain under one
party in order to insure compatibility with the adjacent
properties.

At the meeting of the Planning Commission on December 2,
1986, the following action was taken:
The application for Tentative Tract No. 13473, to establish
an 84 unit, 22 lot subdivision in the R-3-3000 Multiple
Family Residential zone on approximately 6.7 acres located at
the southwest corner of 48th Street and Little Mountain
Drive, was approved based upon findings of fact contained in
the staff report dated November 4, 1986 and subject to the
conditions and standard requirements listed therein, with the
following additional conditions:

and 18, 1986. The first continuance was in order to resolve the issue of
maintenance of both common and private areas and to conduct a meeting between
the developer and the surrounding residents. The second continuance was made
at the request of the residents since the spokesman for the Homeowner's Asso-
ciation was out of town at The Planning Commission meeting of November 5,
1986.
On November 13, 1986, a meeting was held between the developer, residents,
and staff. Although some progress was made relative to issues concerning
central maintenance, vehicular circulation and fencing, the primary concern
of the residents relative to the concept of separate lot ownership of the
22 lots, as proposed, versus a single lot development was not resolved. The
residents also indicated concern for improvement of the existing grade cross-
ing over the flood control channel on 48th Street.

Based upon the issue of maintenance for both common and private area and
the residents concern for traffic on Little Mountain and the need for fenc-
ing to restrict street parkin~ staff recommends that the following conditions
Nos. 6, 7, and 8 be added to the original staff report dated November 4,
1986.
6. The Covenants, Conditions and Restrictions (CC & R's) shall include
provision for perpetual maintenance and upkeep of both common and
private open space, recreation area, open parking spaceS, private
roads, and the exterior of all buildings within each lot by a central
management association.

No lot in the development shall be sold unless a corporation, asso-
ciation, property owner's group, or similar entity has been formed
with the right to assess all properties individually owned or jointly
owned; such assessment power to be sufficient to meet the expenses of
such entity, and with authority to control, and the duty to main-
tain, all of said available features of the development. Such entity
shall operate under recorded CC & R's which shall include compul-
sory membership of all owners of lots and flexibility of assess-
ments to meet changing costs of maintenance, repairs, and services.

Recorded CC & R's shall permit enforcement by the City of pro-
visions required by the City as conditions of approval. The
developer shall submit evidence of compliance with this require-
ment to, and receive approval of, the Commission prior to making

1. The request is to establish a 22 lot subdivision in the
R-3-3000, Multiple-Family Residential zone. The site
consists of approximately 6.7 acres located at the
southwest corner of 48th Street and Little Mountain

2. The existing R-3-3000 zone is consistent with the San

3. The proposed subdivision indicates 21 buildable lots
which are intended for the purpose of developing a four-
plex unit on each. Lot 22 would be a common, jointly
owned lot for recreational purposes for the benefit of
Lots 1- 21. The propossd lots would meet the minimum
subdivision requirements of the R-3-3000 zone relative
to lot area, width and depth. The actual construction
plans have been submitted for review under the
Administrative Development Review process (file number
Review of Plans 86-91).
4. All vehicular access would be taken from two proposed
dedicated cul-de-sacs via a network of shared private
interior drives. The use of shared drive aisles
provides sufficient vehicular access to each unit and
eliminates the potential for a series of independent
drives onto 48th Street and Little Mountain Drive.
5. The applicant has indicated that each four-plex and lot
would be owned by separate investors and managed by a
central management group which would be responsible for
the maintenance and upkeep of the building and grounds
and would also manage tenant leasing and rent
collection.

The site is located adjacent to the Devils Canyon Flood
Control Channel. The San Bernardino County Flood
Control District in their correspondence dated September
24, 1986, indicates that Devils Creek is an interim
earth graded channel with rail and wire bank protection.
The County Flood Control District further indicates that
although flows in the channel are controlled, additional
amounts of local flows generated by area development are
likely to cause increased bank erosion during major
storms (see attached letter). In ~ight of these
comments, the County Flood Control District recommends
that a 25-fodt building setback be established from the

A condition has been included to that effect.
7. A traffic study was prepared at the request of the City
Traffic Engineer and the Environmental Review Committee
to determine the need for signalization of the
intersection of 48th and Kendall and appropriate left
turn movement including the adequacy of the proposed

traffic report was reviewed by the Engineering Division
(see memo from Engineering, dated October 17, 1986) and
determined to be adequate. The submitted traffic study
concluded that a signal was not warranted at this time
for the intersection of 48th and Little Mountain Drive
and that the proposed cul-de-sac design was adequate to
handle the anticipated traffic.

Based upon the observations and findings of fact contained

the proposed Negative Declaration and approval of Tentative
Tract No. 13473.

The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed
and approved by the Planning Department prior to final approval of the
tract maps. The CC & R's shall include liability insurance and methods
of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings. The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.

No lot or dwelling unit in the development shall be sold unless a cor-
poration, association, property owner's group, or similar entity has
been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the
common areas and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity, and with
authority to control, and the duty to maintain, all of said mutually
avai lable features of the development. Such entity shall operate under
recorded CC&R's which shall include compulsory membership of all
owners of lots and/or dwelling units and flexibility of assessments to
meet changing costs of maintenance, repairs, and services. Recorded
CC&R's shall permit enforcement by the City of provisions required by
the City as conditions to approval. The developer shall submit evi-
dence of compliance with this requirement to, and receive approval of,
the Commission prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.

Every owner of a dwelling unit or lot shall own as an appurtenance to
such dwelling unit or lot, either (1) an undivided interest in the com-

Compliance with all recommendations of the Geology Report shall be required

Any clubhouse, swimming pool, spa, putting green, picnic areas or other

During construction the City Engineer may require a fence around all or a

Utilities:

42. Street, sewer, and drainage improvement plans for the entire
project shall be completed, sUbject to the approval of the City

Gentlemen:
8y letter dated September 17, 1986 from C.M. Engineering and your comment
sheet dated September .19, 1986, Tentative Tract Hap IJ13473 was submitted for
District review. The proposed development is located on the southwest
corner of 48th Street and Little Mountain Drive, in the northwest portion of
the City of San Bernardino.
Devil Creek abuts the southwest side of the proposed development and is an
interim earth graded channel with rail and wire bank protection. Although
flows in the channel at this location are controlled, additional amounts of
local flows generated by area development are likely to cause increased bank
erosion during major storms.
Therefore, in our opinion, although the site is reasonably free of serious
flood hazards at this time, the site may be subject to infrequent flood
hazards by reason of overflow, erosion and debris deposition in the event-of
a major storm and as increa:sed runoff into the channel is experienced.
Portions of the site may be subject to excessive street flows and accumulated
drainage from the north. It is therefore recommended that a separate report
be obtained from the City Engineer's Office with respect to local and
on-site drainage conditions.
Our recommendations are.as follows:
1. Six foot chain link fencing or other District approved barrier
shall be provided between the site and the District's Devil Creek
Channel rights-of-way.
2. A 25-foot building set back line shall be established from the
channel rights-of-way and shown on the final tract map.

3. Along 48th Street at the dip crossing of the channel, the District
will require a dedication in fee of additional right-of-way for
access to the levee service road. This additional right-of-way
will be in the form of a triangular shaped piece of land at the
northwest corner of the development with the size to be determined
upon the developer submitting adequate existing topography in the
crossing area including required road right-of-way widths and
improvements. The developer's engineer shall determine the
approximate necessary rights-of-way and the District will determine
the precise length of the legs of the triangle and prepare appropriate

of record. At the time the site is developed, a driveway approach
and a graded access road must be provided for maintenance vehicles
access from street to levee top.
4. It is noted that internal drainage is to be outletted into Devil
Creek Channel on the westerly boundary of the propo~ed development;
but prior to any activity on District right-of-way, a permit must
be obtained through the District's Field Engineering Divi s ion.
At that time the proposal will be reviewed with respect to specific
. requirements.
5. In addition to the Drainage Requirements stated herein, other
"on-si ten or "off-si te" improvements may be required which cannot
be determined from tentative plans at this time and would have to
be reviewed after more complete improvement plans and profiles
have been submitted to this office.

Because my daughter and I, who are home owners in Mountain Park Condominiums,
are unable to attend the public hearing regarding the above mentioned property,
we should like to go on record as being vehemently opposed to additional
multiple-family residences in our immediate area.
Since pur8hasing our home two years ago, there has been a steady influx of
apartment dwellers. As a result, traffic has increased in volume steadily
and is at a point now, where one questions one's safety in attempting to pull
out onto 48th. St.
The increase in the type of persons that an "ap~tment row" area attracts has
increased the vandalism in our neighborhood significantly. One hesitates to
leave the home after dark anymore.
Please consider the fact that we, as home owners, have put quite a good deal
of money into what we thought (and in fact, were told) would be an area with
homes and/or condos of equal or increased value. We understand now that our
property values have already dropped considerably. We plead with you not to
approve this additional problem for us. Perhaps, with your cooperation, we
will not lose everything we have put into our home.

(6) The existing city sewer facilities are already over-extended with additional hook-Lps
resulting in an unnecessary strain.
