RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AUTHORIZING A FIRST AMENDMENT TO THE
SERVICES AGREEMENT WITH TRANSTECH ENGINEERS INC. AND PURCHASE
ORDER NO. 303285 FOR THE DESIGN OF THE VERDEMONT COMMUNITY
CENTER PER CAPITAL IMPROVEMENT PROGRAM PROJECT PR04-28.
WHEREAS, on March 1, 2010, Mayor and Common Council approved Resolution
2010-34 approving an agreement for services with Transtech Engineers, Inc. for design of the
community center at Al Guhin Park (the Agreement); and,
WHEREAS, the Mayor and Council wishes to expand the scope of work specified in
the Agreement; and,
WHEREAS, Transtech Engineers Inc. will provide expanded park design and federal
funding application writing services to the City.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The City Manager of the City of San Bernardino is hereby authorized to
execute on behalf of said City a First Amendment to the Agreement, a copy of which is
attached hereto, marked as Exhibit "A", and incorporated herein by this reference as fully as
though set forth at length.
SECTION 2. That pursuant to this determination the Director of Finance or her
designee is hereby authorized to issue a change order to Purchase Order No. 303285 from
$36,400 to $86,660, for Transtech Engineers Inc. for the design of the Verdemont Community
Center per capital improvement program project PR04-28.

FIRST AMENDMENT TO AGREEMENT
FOR SERVICES FOR DESIGN OF
THE COMMUNITY CENTER SITE AT AL GUHIN PARK
THIS FIRST AMENDMENT AGREEMENT is made and entered into this 1st
day of November , 2010 ("Effective Date"), by and between the CITY OF SAN
BERNARDINO, a charter city ("City"), and TRANS TECH ENGINEERS, INe.
("Consultant") .
WITNESSETH:
A. WHEREAS, on March 1, 2010, City and Consultant entered into an Agreement for
Services For Design of the Community Center Site at Al Guhin Park (the
"Agreement"); and,
B. WHEREAS, City proposes to expand the scope of the Agreement to include the
design of an amphitheater, basketball court, parking lot and security lighting; and,
e. WHEREAS, City wishes the additional services of Consultant to perform work to
apply for and obtain $500,000 in earmark funds from the Department of Housing
and Urban Development, including completing the mandatory National
Environmental Policy Act study.
NOW, THEREFORE, for and in consideration of the mutual covenants and
conditions contained herein, the parties hereby agree to amend the Agreement to add the
following provisions:
SECTION 1.
The following sections are amended as follows:
1.0. SERVICES PROVIDED BY CONSULTANT
1.1.1 In addition, Consultant shall provide the services as set forth in Consultant's
letter of October 15, 2010, Re: Project PR 04-28, Verdemont Community Center Design
Services Contract - Change Order #1, a copy of which is attached hereto as Attachment "D"
and incorporated herein.
2.0. COMPENSATION AND BILLING
2.1. Compensation. Over the term of this Agreement, Consultant shall be paid for
such services in accordance with the revised fee proposal, contained in Attachment "D," in
an amount not to exceed $86,660.
3.0. TIME OF PERFORMANCE
3.1. Commencement and Completion of Work. The obligation to perform the
professional services to be performed pursuant to this Agreement shall commence within five

(5) days from the Effective Date of this Agreement. Said services shall be performed in strict
compliance with the Revised Verdemont Community Cwenter Project Schedule set forth in
Exhibit "D." Failure to commence work in a timely manner and/or diligently pursue work to
completion may be grounds for termination of this Agreement.
4.0 TIME OF PERFORMANCE
4.1 The term of this Agreement is extended through June 30, 2011.
SECTION 2.
All other terms and provisions of the Agreement shall remain unchanged.
IN WITNESS WHEREOF, the parties hereto have caused this First Amendment to
Agreement to be executed by and through their respective authorized officers, as of the date
first above written.

Verdemont Community Center Design Services Contract - Change Order #1
Gentlemen:
As requested, we have prepared a request for a change order to our current professional services
contract for the Verdemont Community Center Project located within the 5th Ward of the City of San
Bernardino.
HISTORY
The City of San Bernardino seeks to locate the Verdemont Community Center and outdoor stage at AI
Guhin Park. The community center will be constructed of several modular units combined to form a
single building with a floor area of between 3000 and 4000 square feet. The community center will be
located in the southern end of the park. Mapco will provide engineering services for the design of the
building site, overall design of the outdoor stage, modification of the existing irrigation system, and
design of the related parking area, driveways, walkways, sewer, domestic and fire water, dry utilities,
and appurtenances. The City of San Bernardino will provide the modular units and a disabled accessible
ramp. After the purchase of the modular units and ramp, approximately $200,000 of the $300,000
budget will remain for the design and construction of the project. Our office was involved with the
survey, design and development of the adjacent Blast Soccer Complex, proposed 43 acre retail center
immediately east of the soccer complex and various infrastructure related matters pertaining to the
frontage road and Little League Drive. This familiar insight to this area of the city will aide in the process
of developing a workable and practical plan for the proposed civic development.
The Notice To Proceed (NTP) was authorized on March 8, 2010. Subsequent to the NTP, the 'project
design team' has performed services and held meetings with respect to the activities outlined in the
approved scope of services. The original schedule of activities anticipated a completion for this project
no later than October 14, 2010. The revised schedule indicates the Notice of Completion of February 21,
2011. This is approximately a 50% increase in project/program management time. The revised project
schedule is included for reference.

CURRENT CIRCUMSTANCES
As a result of collaboration with city staff and project design team there have been a number of
communications/meetings addressing the project budget, conceptual design site characteristics,
maintenance considerations, and overall completion timing of the project. It became evident, as a
result of efforts put forth to date, that the ability to create a community oriented project with the
proper level of design amenities, public safety components, and application of a practical degree of
design considerations that this goal could be achieved with the availability of additional project funds.
Funding for this project is via the City's 2008-2009 / 2012-2013 CIP (Capital Improvement Program)
budget. Project PR 04-28, Verdemont Community Center, is funded through the use of Verdemont
Infrastructure Fee (VIF) Fund. These funds are collected via the development process of private

construction projects and developments in that area of the 5th Ward. Recently the City has applied for
additional funds for this project with HUD (the 'Department of Housing and Urban Development'). The
additional funding (a $500,000.00 grant) would increase the total project budget from $300,000.00 to
$800,000.00. This increase will result in enhancements and additions to the project scope of work,
design requirements, project/program management requirements, improvements, and amenities.
CONCLUSION
In summary, the overall project scope is being modified to reflect a revised budget and project schedule
that will result in enhancing the community center facility for the use by the local community.
The following outline of the scope of work and associated task/fee's represent's the adjustments
necessary to be incorporated into the project. A majority of the additional services, outside of the
design features and final site plan for the project, will include enhancing the role of 'Program Manager'
for the project and assisting the City in areas of responsibility necessary to complete all phases of this
project including however not limited to assisting with the enhanced funding and project administrative
needs and responsibilities. The chart below outlines the original budget costs per line item and the
revised budget total's per each individual line item.
We appreciate the opportunity to be a continued contributor to this worthy community project. We
look forward to providing our services in support of the staff's efforts to date and in conjunction with
the entire project team.
