The City Clerk has caused to be posted the order of adjournment of said meeting held on Monday, June 21, 2010, and has on file in the office of the City Clerk an affidavit of said posting together with a copy of said order which was posted at 10:30 a.m., Tuesday, June 22, 2010, on the City Hall breezeway bulletin board. The joint adjourned regular meeting of the Mayor and Common Council and Community Development Commission of the City of San Bernardino was called to order by Mayor/Chairman Morris at 5:09 p.m., Wednesday, June 23, 2010, in the Economic Development Agency Boardroom, 201 North "E" Street, San Bernardino, California. 06/2312010 Roll Call Present: Mayor/Chairman Morris; Council Members/Commissioners Marquez, Brinker, Shorett, Kelley, Johnson, McCammack; Senior Assistant City Attorney Wilson; City Manager McNeely; City Clerk Clark. Absent: Council Member/Commissioner Desjardins. Council Member/Commissioner Desjardins arrived at 5:20 p.m. 1. Closed Session Pursuant to Government Code Section(s): A. Conference with legal counsel - existing litigation - pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel - anticipated litigation - significant exposure to litigation - pursuant to subdivision (b) (1), (2), (3) (A-F) of Government Code Section 54956.9. C. Conference with legal counsel - anticipated litigation - initiation of litigation - pursuant to subdivision (c) of Government Code Section 54956.9. D. Closed Session - personnel - pursuant to Government Code Section 54957. E. Closed session with Chief of Police on matters posing a threat to the security of public buildings or threat to the public's right of access to public services or public facilities - pursuant to Government Code Section 54957. F. Conference with labor negotiator - pursuant to Government Code Section 54957.6. G. Conference with real property negotiator - pursuant to Government Code Section 54956.8. Note: The Mayor and Common Council did not consider closed session items at this meeting. 2 06/23/2010 2. Budget Workshop and Deliberations - Fiscal Year 2010/11 - City, Capital Improvement Program, and EDA Budgets The City Attorney's office requested that the SBET A presentation be cancelled and that it be handled in a different format. Budget presentations were made by representatives from the following departments: Parks, Recreation and Community Services; Library; Finance; Human Resources; Civil Service; and Information Technology. The following individuals spoke in support of maintaining current funding levels for the Parks, Recreation & Community Services Department and its programs, activities, and special events: Jim Stoffer, Friends of the CID board member/past president, Patton, CA; John Hunsaker, Highland Little League, Highland, CA; Mitch Assumma, Parks employee, San Bernardino, CA; Tim Sipchen, Friends of the CID board member, San Bernardino, CA; Abe Majadi, President and CEO of the Boys & Girls Club, San Bernardino, CA; Ron Haliburton, Senior Companion Program volunteer, San Bernardino, CA; Ethel Dillard, Senior Companion Program volunteer, San Bernardino, CA; Jessie Munoz, Senior Companion Program volunteer, San Bernardino, CA; Alex Aldasoro, San Bernardino, CA; Ron Bennett, San Bernardino, CA, spoke in opposition to the development taking place near Highland Little League; Juan Bell spoke regarding the CID Program; Clarissa Vandyke spoke regarding the CID Program; John Khacherian spoke regarding the CID Program; Anita Whitmore, San Bernardino, CA, spoke regarding the Highland, Fifth Street, and Perris Hill Senior Centers; Estrella Barroga, San Bernardino, CA, spoke regarding the CID Program; Don Stubbs, Parks employee, San Bernardino, CA; Marilyn Patterson, past member of the Parks and Recreation Commission; Kim Burgett, Parks employee, San Bernardino, CA; Sandy Bonilla, Director of an urban conservation corps with the National Forest Association, San Bernardino, CA; Heather Guhl, Registered Nurse, Banning, CA, spoke regarding the CID Program; Jesse Sandoval, Parks employee, Fontana, CA; Jim Gondos, Parks employee, Highland, CA; Jim Smith, Native Sons of the Golden West, San Bernardino, CA; Cheryl Brown, President of the NAACP, San Bernardino, CA; Ken Joswiak, CID Manager, San Bernardino, CA. 3 06/23/2010 The following individuals spoke in support of maintaining current funding levels for the City Library and its programs, activities, and special events: Cheryl Brown, President of the NAACP, San Bernardino, CA; Ed Erjavek, Library employee, Highland, CA; Thomas Jarvis, San Bernardino, CA; Dr. Milton Clark, President of the Library Board of Trustees, San Bernardino, CA; Marion Vassilakos, Library board member, Highland, CA; Carolyn Tillman, Library board member, San Bernardino, CA. NB1. RES. 2010-215 - Resolution of the Mayor and Common Council of the City of San Bernardino authorizing the execution of a renewal agreement between the City of San Bernardino and Progressive Solutions, Inc. for revenue recovery and software license agreement for software and revenue recovery services. (Continued from June 21, 2010) Council Member/Commissioner McCammack made a motion, seconded by Council Member/Commissioner Brinker, that full reading be waived; and that said resolution be adopted. Resolution No. 2010-215 was adopted with Desjardins absent. 3. Public Comments Bob Goss, President of the Mid-Management bargaining unit, Highland, CA, stated that he is concerned about where the City is headed in the next few years and also in the long term. The City Manager and the Mayor and Common Council asked for and received numerous suggestions on how to reduce costs and increase revenues from residents, businesses and employees. Some are still being considered, such as property transfer taxes, increased business fees, and maintenance assessment fees for streets, curbs, etc. He stated that asking residents to agree to pay higher taxes at this time may pose financial hardships; however, it's something that needs to be addressed. He stated that as a resident he is in favor of paying the maintenance assessment, but that money, if collected, needs to be used for that purpose only. He added that the City Council did not vote to move on the police impound yard and parking meters. Mr. Goss stated that he does not understand the different concession amounts the bargaining groups and the City agreed to. The City asked for ten percent from all bargaining groups; however, the end results varied. Employees have been asked by the City Manager to share the pain equally, but that hasn't happened. The mid-managers have stepped up to the plate and continue to support what the City needs. Times are tough and everyone needs to step up to the plate. He asked the Mayor and Council to remain focused on the welfare of the City as a whole. 4 06/23/2010 4. Adjournment At 9 p.m., the meeting adjourned to 5 p.m., Wednesday, June 30, 2010, in the Economic Development Agency Boardroom, 201 North "E" Street, San Bernardino, California, to consider the Fiscal Year 2010/11 City and Economic Development Agency budgets. The next joint regular meeting of the Mayor and Common Council/Community Development Commission is scheduled for 1:30 p.m., Tuesday, July 6, 2010. RACHEL G.
