Background: On March IS, 2010, the Mayor and Council approved a motion to refer the matter of developing a policy for the naming of City Facilities to the Legislative Review Committee (LRC) for further review. The Committee met on March 16th to discuss the development of a policy. At that meeting, the Committee recommended that no action be taken to name any public park, facility, or amenity until a formal policy has been adopted by the Mayor and Common Council; the Council approved that recommendation on AprilSth. At the March 16th meeting, the LRC also directed staff to review policies from other cities and to draft a City policy for committee review. The Parks, Recreation, and Community Services Department currently have informal guidelines that were developed several years ago, but never formally adopted. The policy drafted is a hybrid of the Parks guidelines and procedures used in other cities. It is important to note that Council Committee assignments changed in March of this year. To avoid potential Brown Act violations, the matter was once again considered by the Mayor and Common Council on July 6th and referred back to The Legislative Review Committee. On September 21st, staff presented the LRC with a draft of the proposed policy. The general purpose of this Policy is to establish guidelines for the naming, or amending the name of, City owned parks, facilities, and amenities. The policy includes a process to recognize employees, elected officials, or other well deserved individuals, by naming a City owned facility in their honor. In addition, the policy also addresses the naming of parks or facilities that are built as a condition of development. The policy requires nomination criterion that includes a justification for the naming, evidence of community support, and public notification. Nomination Forms may be submitted to the City Manager's Office by community groups, individuals, City staff or Elected Officials and reviewed by appropriate City Commissions. For example, the Planning Commission may review building dedication; the Parks Commission for playgrounds/community centers; or the Fire Commission for fire stations. Recommendations made by the Commission will be referred to the Mayor and Common Council for final approval. This policy will be effective on the date it is approved by the Mayor and Common Council. However, plans for future development, currently on file in the Community Development Department with names exhibited in writing, are exempt from the provisions of this policy. FACILITIES AND AMENITIES POLICY PURPOSE: To establish guidelines and a uniform policy for naming, or amending the name of, City owned property, and property dedicated to the City for public purposes, subject to approval of the Mayor and Common Council. This policy shall apply to City owned parks, facilities, or amenities, or other recreational facilities, hereby referred to as "facility or facilities". The intent of this policy is to provide an exclusive process by which naming public facilities will be adhered to. DEFINITION OF TERMS: Facility classifications in order of significance: Park - an officially recognized parcel of land dedicated to the City or owned and managed by the City and used for public recreation purposes. Public Facility - a City owned structure within a park used for public recreation purposes. Examples include, but are not limited to: community centers, aquatic centers, or amphitheaters. Amenity - a smaller, support facility that is located within a City owned building or park or is part of a City recreation facility. Examples include but are not limited to: picnic pavilions, ball fields, playgrounds, monuments, walkways, or gardens. POLICY: 1. Recommendations may be submitted by community groups, individuals, City staff or Elected Officials by submitting a Nomination Form (Attachment A) to the City Manager's Office. 2. Recommendations shall be submitted in writing, and shall be given equal consideration without regard to the source of the nomination. 3. To show substantial community support, the recommendation shall be accompanied by a petition with a minimum of 100 signatures of support. 4. The Nomination Form shall first be considered at a publicly noticed meeting of an identified City Commission. The Commission shall refer its recommendation to the Mayor and Common Council, who shall exercise final authority in regard to the naming. 5. The naming of any City facility is intended to be an act in perpetuity. Facilities which already bear the name of an individual shall not be considered for re-naming, in order to uphold the original intent of honor and respect, unless substantial evidence supports the findings that the individual was falsely credited with the honor for which the facility was named, or that the name now tarnishes the good name of the City. Any such cause for renaming shall be referred by the City Manager's Office to the Legislative Review Committee where such evidence shall be evaluated before the request is referred to the Mayor and Common Council. Currently named facilities are listed in Attachment B. 6. As provided in City of San Bernardino Parks and Recreation Public Recreational Facility Permit - Section 18, sports leagues may, with the advanced written approval of the Director of Parks, Recreation and Community Services, place upon the premises approved signs, bill boards, banners, posters or advertising of products or services related to League's operations and needs. - 1 - SELECTION CRITERIA: The selection of a name for any City park, public facility, or amenity must meet one or more of the following criteria: 1. The name of an identifiable geographic location or a name that provides a link to City, County, State, or National heritage or development shall be used whenever possible. 2. The name of an individual may be used, living or dead, provided that individual has contributed significantly to the quality of life for San Bernardino residents through 20 years or more of community service. The individual must be identified as a City of San Bernardino resident, a member of a San Bernardino service organization, or employed within the City during his/her community or public service. 3. The name of an individual, organization or business may be used if there has been a significant contribution towards the cost of providing the facility. "Significant" is defined as providing funding for the total cost of the facility to be named, or providing funding for that portion of the total cost which would not have been available from any other source (such as federal/state loans or appropriations, bond issues, etc.). In such circumstances, the contribution and the naming of the facility may be recognized through a formal agreement approved by the Mayor and Common Council. 4. Property or open space that is dedicated to the City as a condition of development shall not be named based on payment or cost, but may be named pursuant to any other provision of this policy. 5. The name of a City employee may be used, regardless of length of City service, if performance of City service caused, or significantly contributed to the death, serious illness, or disability of said employee; or if said employee performed pioneering, breakthrough, or lifesaving measures on behalf of the City. 6. The City of San Bernardino shall not name any facility in honor of an individual or organization which promotes, supports, or produces products which may be detrimental to the public health, safety or well-being, or which are not intended for consumption or use by mmors. 7. The Mayor and Common Council shall exercise final authority in the naming of all parks, public facilities, and amenities within the City of San Bernardino. PROCESS: 1. Requests for naming facilities shall be submitted in writing to the City Manager's Office on the approved nomination form. 2. The City Manager, or his/her designee, shall verify the information on the nomination form, and use his/her discretion to refer such requests to the appropriate City Commission. The Commission shall be determined by the type of facility being named. (Example: parks, community centers and playgrounds shall be referred to the Parks Commission; City owned buildings shall be referred to the Planning Commission; a Fire Station shall be referred to the Fire Commission, etc.). City staff shall present the Nomination Forms to the Commission for consideration. 3. In accordance with the selection criteria stated in this policy, the Commission shall consider each submitted request in a public meeting prior to making a recommendation to the Mayor and Council. 4. City Staff shall prepare the necessary documents (Resolution, Staff Report, etc.) to present the recommendation to the Council for final approval. 5.
