HomeMy WebLinkAbout2010-298 1 2 3 4 5 6 7 8 9 10 11 12 13 14 RESOLUTION NO. 2010-298 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A FAIR MARKET VALUE OF $2,447,000 AND DECLARING THE INTENTION TO SELL CITY PROPERTY KNOWN AS THE CONVENTION CENTER, AND APPURTENANT PARCEL TO THE WEST, GENERALLY LOCATED WEST OF AND ADJACENT TO CITY HALL, EAST OF "E" STREET AND SOUTH OF COURT STREET, AND TO GRANT AN APPURTENANT EASEMENT TO THE SOUTH, TO THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO AND SETTING A PUBLIC HEARING FOR OCTOBER 4, 2010, TO CONSIDER SAID SALE. WHEREAS, the City of San Bernardino, a municipal corporation, is the owner of the hereinafter described parcels of real property known as the Convention Center (formerly known as Exhibit Hall) , and appurtenant parcel to the west, generally located west of and adjacent to City Hall, east of"E" Street and south of Court Street, and a portion of the area directly south of . . City Hall, known as Assessor Parcel No. ("APN") 0134-251-53 and portions of APN 0134- 251-51 and APN 0134-311-37, and more fully described in Exhibit "A" attached hereto and 15 16 hereof; and 17 18 made a part hereof and depicted on a plat, attached hereto as Exhibit "B" and made a part WHEREAS, the Redevelopment Agency of the City of San Bernardino ("RDA") desires 19 to acquire said parcels of real property for the purpose of operating the Convention Center and 20 appurtenant facilities, and an appurtenant easement lying generally southeasterly of and adjacent 21 to said Convention Center as described in said Exhibit "A" and depicted on said Exhibit "B"; 22 23 24 and WHEREAS, the Mayor and Common Council believe it is in the best interest of the City 25 that said parcels of real property be sold to the RDA for the purpose of operating the Convention 26 Center and appurtenant facilities, together with an appurtenant easement as set forth herein; and 27 28 9102/2010 2010-298 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING A FAIR MARKET VALUE OF $2,447,000" AND DECLARING THE INTENTION TO SELL CITY PROPERTY KNOWN AS THE CONVENTION CENTER, AND APPURTENANT PARCEL TO THE WEST, GENERALLY LOCATED WEST OF AND ADJACENT TO CITY HALL, EAST OF "E" STREET AND SOUTH OF COURT STREET, AND TO GRANT AN APPURTENANT EASEMENT TO THE SOUTH, TO THE REDEVELOPMENT AGENCY OF THE CITY OF SAN BERNARDINO AND SETTING A PUBLIC HEARING FOR OCTOBER 4, 2010, TO CONSIDER SAID SALE. WHEREAS, an appraisal has been prepared by Smothers Appraisal, a California general certified appraiser in the amount of $2,447,000, after adjustments; and WHEREAS, pursuant to Section 2.65.050 of the San Bernardino Municipal Code, City owned property may be sold to another public agency without the need for competitive bid. THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The public interest and convenience require the sale of City owned parcels of real property known as the Convention Center, and appurtenant parcel to the west, generally located west of and adjacent to City Hall, east of "E" Street and south of Court Street, and the granting of an appurtenant easement, more fully described in said Exhibit "A" and depicted on said Exhibit "B". SECTION 2. It is therefore the intention of the Mayor and Common Council of the 19 City of San Bernardino to sell said parcels of real property to the RDA and grant an appurtenant 20 easement as set forth herein; 21 22 SECTION 3. The Mayor and Common Council do hereby establish the Fair Market 23 Value of said parcels of real property, in the amount of TWO MILLION FOUR HUNDRED 24 FORTY-SEVEN THOUSAND DOLLARS ($2,447,000); and 25 26 27 28 SECTION 4. Notice of the public hearing shall be published in The San Bernardino County Sun, a newspaper of general circulation, at least once prior to the public hearing and shall be posted in at least 3 conspicuous places on the property at least (10) days prior to the hearing. SECTION 6. Written and oral protest to such sale may be submitted and shall be received at 0f prior to the public hearing. Written protests may also be submitted to the City Clerk's Office, City Hall, 300 N. "D" Street, San Bernardino, California, prior to the public hearing. SECTION 7. It is the intent of the Mayor and Common Council to consider and approve the sale of said parcels of real property and appurtenant easement described herein, at said public hearing.
