SUBJECT
Resolution authorizing the San Bernardino City Fire Department to apply for and administer
the FY 2009 Staffing for Adequate Fire and Emergency Response (S.A.F.E.R.) grant
submitted to the Department of Homeland Security Federal Emergency Management Agency.
BACKGROUND
The Department of Homeland Security (DHS) has announced the availability of grant funding
for Fiscal Year 2009 Staffing for Adequate Fire and Emergency Response (SAFER) Grant
Program. The application period opened on November 16, 2009 and is scheduled to close on
December 18,2009. DHS estimates that the grants will be awarded sometime in the late Summer
of2010.
SAFER grants provide financial assistance to help fire departments increase their cadre of
frontline firefighters, or to rehire firefighters that have been laid off. The goal is to assist fire
departments with staffing and deployment capabilities so that they may effectively respond to
fires and fire related emergencies. This is the third time the City has applied for the highly
competitive SAFER grant. The city was not awarded during these previous application attempts.
Priority for SAFER grant applications is given to those Fire Departments who are seeking grant
funding to achieve compliance with National Fire Protection Association (NFPA) 1710 industry
standards of having a minimum of four-personnel staffing for the first arriving engine on a fire
scene. Due to budget constraints, the City eliminated twelve firefighter positions over the last
calendar year. This reduced staffing levels on four of Fire's engine companies from four-person
to three. If awarded, the criteria for this year's the SAFER grant will allow us to rehire positions
that were eliminated, or given notice to be eliminated, between January 1, 2008 and October 31,
2009. The twelve positions that the City eliminated fall within this timeframe.
Significant changes in the SAFER grant requirements for 2009 makes the grant more practical
for the department's needs and the City's available funding resources. The grant will now pay for
100% of all wages and benefits for a period of two years with no matching requirement. DHS
has also waived the requirement to retain personnel hired through the grant for additional years
beyond the period that the grant will fund. Therefore, the only significant cost associated with
accepting the grant would be for overtime to backfill leave time for each position hired through
the grant. This equates to approximately $283,557 over the two-year term of the grant.
The SAFER grant requires that all positions hired through the grant remain employed by the
grantee for the entire two-year term of the grant. Furthermore, the grant requires grantees to
maintain their current emergency staffing levels as declared at the time of application, plus the
new firefighter positions, throughout the two-year performance period. Therefore, the City may
not reduce safety positions in the fire department for the two-year term of the grant if the grant is
accepted.

The Fire Department is requesting authorization to submit an application to rehire twelve (12)
positions through the SAFER grant. The performance period for the grant will start when the
grant is awarded and will end two years after the performance period begins.
FINANCIAL IMPACT
The Federal share of salaries/benefits for twelve (12) positions is estimated be $2,769,602 over
the two-year grant performance period. The City will be obligated to pay the costs for backfill at
time and a half of each employee's base pay rate when employees in these positions use elective
leave time or injury time per the firefighter's MOU. This cost is estimated to be $283,557 over
the two year term of the grant.
The total estimated amount needed to fund all twelve firefighter positions for the two-year
period, including both the City's overtime obligation and the Department of Homeland
Security's grant contribution is detailed below:

These figures include step raises that will occur during the newly hired employee's first two
years of employment, and an estimated 4% increase annually for charter section 186 salary
tncreases.

SECTION 1. The Mayor and Common Council hereby authorize the City
Manager or his designee to submit the on-line grant application to the Department of
Homeland Security for the 2009 Staffing for Adequate Fire and Emergency Response
Grant in the amount of $2,769,602. A copy of the grant application is attached as
Attachment "A", and incorporated herein by reference.
SECTION 2. The Mayor and Common Council hereby authorize the City
Manager or his designee to administer the grant.

The city has been awarded the 2008 and 2009 Urban Area Security Initiative. Though these grants commenced in 2009, we are
scheduled to complete the projects in 2010. The 2008 UASI grant was awarded in the amount of $340,000 for an interoperable
communication mobile command vehicle. And, the 2009 UASI was awarded in the amount of $270,000 for the purchase of

CERT trailers, equipment, CERT training, program management expenses, and the equipment caches.
Also, the 2008 Metropolitan Medical Response grant in the amount of $321 ,221 for the purchase of shelters, communication,
defibrillators and medical equipment and the 2008 Emergency Operation Center grant in the amount of $9,602 for computers
have a conditional hold per the OES Grants Unit. The conditional hold on the 2008 grants per CaLEMA is expected to be
removed in 2009 for we can complete our programs.

Active Firefighter An individual having the legal authority and responsibility to engage in fire suppression; being

Hiring or Rehiring of Firefighters:
There is a two-year period of performance for grants awarded under both the hiring of new firefighters and the rehiring of laid-off
firefighters activities. There is an additional requirement for grantees awarded under the hiring of new firefighters activity that they
commit to retaining the SAFER-funded firefighters for one full year after the end of the period of performance with 100 percent
local funding. In previous program years, the grantee was required to provide a cost-share that was equal or greater than 10
percent in the first year, 20 percent in the second year, 50 percent in the third year, 70 percent in the fourth year, and 100 percent
in the fifth year. For this program year, there is no prescribed cost share, and per-position salary limits have been eliminated.
Grantees are free to draw any amount of Federal funds to cover actual salary and benefit costs - up to their budgeted and
awarded funding limit - as long as there is Federai funding available. Should the actual saiary and benefits costs requested for
reimbursement exceed awarded Federal funds, the grantee would be obligated to pay 100 percent of those costs.
Regardless of the actual costs incurred, the annuai costs will be limited to the actual costs or the budgeted amount, which ever is
less.

funds are to be used. Because the application will time out after a period of inactivity, it is recommended that applicants type their
narrative offline using any word processing software. Once the narrative is complete. copy-and-paste it from the word processing

The Narrative Statement (project description) for the Hiring or Rehiring Firefighters Activity rnust include the

. A statement that describes what the applicant needs the grant funds for, I.e., how the newly hired or rehired firefighters will
be used within the department and a description of the specific benefit these firefighters will provide for the fire department
and community. Your description should include whether you are seeking to comply with the applicabie sections of NFPA
1710 (Section 5.2.4.2) or 1720 (Section 4.3) as identified in the current SAFER Program Guidance. Volunteer and mostly-
volunteer combination departments should also discuss any additional roles the SAFER-funded firefighters will be expected
to perform, such as chief officer, training officer, fire marshal, fire inspector, healthlsafety officer, or fire prevention/public
education officer.
. A statement regarding the impact of current staffing levels and proposed staffing levels on the department's daily
operations. This statement should explain how the community and current firefighters are at risk without the needed
firefighters, and to what extent that risk will be reduced if the applicant is awarded.
. An explanation of the applicant's financial need and their inability to address the need without Federal financial assistance.
. A statement relating to how the applicant will ensure, to the extent possible, that they will seek, recruit, and hire members of

Use and benefits of newly hired firefighters:
Firefighters hired through the grant will increase staffing ieveis on four (4) first response fire apparatus from three personnel to
four. This increase in staffing will improve the initial and sustained attack capabilities on fire responses. and improve efficiency
on EMS calls for service.
Both of these improvements will have a direct, positive effect on the health and safety of the community by decreasing fire loss
rates and mortality rates. Additionally, increased staffing levels on engine and truck companies will help the department comply
with NFPA 1710 standards.
Impact of current and proposed staffing levels on daily operations:
The recent reduction of staffing in the department has resulted in fewer engine companies staffed at appropriate levels as
identified by NFPA 1710. Fewer personnel on these engine and truck companies equates to delays in attacking structure fires,
resulting in increased dollar loss rates and the potential for increased mortality rates due to fire.
Furthermore, the City of San Bernardino is located in one of the most active wildlandlinterface zones in the country, with a
history of devastating wildland fires that have burned hundreds of homes. By increasing staffing through this grant, the fire
department's ability to launch effective, early attacks on these fires will reduce the chances that they will grow beyond our
capability to control.
Financial need and inability to address without Fed Assistance:
The City eliminated twelve (12) firefighter positions by mayor and council action prior to October 31,2009; ten (10) positions are
currently vacant, with two (2) positions to be vacated by attrition within the next several months.

Included in the salary formula for twelve (12) firefighter positions, are the costs associated with firefighter step raises and an
approximate 3% annual pay increase payable on August 1st, per City Charter Section 186 requirements.
As a result of significant economic downturn, The City of San Bernardino has faced budget shortfalls in the millions of dollars
over the last two years. Perpetuating this problem is a continued trend of tax revenue losses, local business closures, and a local
unemployment rate that now exceeds 14%.
To maintain operations, employees of the city of San Bernardino have had to make pay and benefit concessions. and the City
government has been forced to eliminate 120 positions city-wide, 13 of which have been fire department emergency personnel.
These actions, although necessary. have decreased the margin of safety that a well staffed fire department can provide.
Without Federal assistance in correcting these fire department staffing deficiencies, this margin could widen, increasing the risks
to the community members and the firefighters who serve them.
How we will seek. recruit, and hire members of ethnic minority, etc:
The San Bernardino City Fire Department makes special efforts to attract prospective hires from local resources such as high
schools, local community colleges, and vocational education programs. We have partnered with a local charter school that
specializes in public safety training to support efforts in developing potential candidates from as young as the 9th grade.
Additional recruitment efforts include participation in job fairs, recruitment fiyers, and broad advertisement of position openings
and applications procedures. The Fire Department ensures that testing and selection processes for these positions meet Federai
EEOC validation requirements for employee selection procedures. Our efforts to improve the ethnic, racial, and gender diversity
in the fire department have increased the number of minorities hired over the last six years. Although we are still challenged to
expand this trend, our current representation of ethnic minorities within our ranks is higher than the State average per the United
States Census Bureau.
Long-term plan to retain employees
It is the desire of the City of San Bernardino to maintain strong. effective fire services for the community, which includes a
commitment to appropriate staffing levels. We believe that this grant will create the momentum necessary to bring staffing levels
back to pre-recession levels years sooner than if the City has to find the funding through current revenues.
The San Bernardino City Fire Department is currently developing programs for cost recovery and expanded services that will
increase revenue generation. This revenue generation, along with a positive prognosis for economic recovery over the next three
years should put the city in a position to retain the positions hired through this grant.
Ensure against discrimination for volunteering:
The City of San Bernardino does not prohibit engaging in volunteer firefighting activities in other jurisdictions during off-duty
hours. The Fire Department has policy that provides for such activity, as long as the activity does not conflict with the employee's
duties with the City.

As required by the Drug-Free Workplace Act of 1988, and implemented at 44 CFR Part 17, Subpart F, for grantees, as defined at
44 CFR part 17, Sections 17.615 and 17.620:
(A) The applicant certifies that it will continue to provide a drug-free workplace by:
(a) Publishing a statement notifying employees that the unlawful manufacture, distribution,
dispensing, possession, or use of a controlled substance is prohibited in the grantee's workplace and
specifying the actions that will be taken against employees for violation of such prohibition;
(b) Establishing an on-going drug free awareness program to inform employees about:
(1) The dangers of drug abuse in the workplace;
(2) The grantee's policy of maintaining a drug-free workplace;
