SUBJECT
Resolution of the City of San Bernardino authorizing the City Manager of San Bernardino to
execute Amendment No. 5 to the Services Agreement with the San Bernardino City Unified
School District for the operation of the School Crossing Guard Program by the Police
Department.
BACKGROUND
The City of San Bernardino and the San Bernardino Unified School District have
participated in the school crossing guard program for a number of years. Currently, the
Police Department has administrative oversight of the program and both parties contribute
fifty-percent (50%) of the financial costs of operating the program. The most recent services
agreement expired June 30`", 2009. SBCUSD cannot reimburse the City of San Bernardino
for services until a new agreement is in place. Crossing guards are vital to protect the safety
of elementary school students while walking on city streets to and from school.
FINANCIAL IMPACT
The cost of the crossing guard program for FY 2009/2010 is estimated to be approximately
$416,200. With the approval of Amendment No. 5 to the Services Agreement, the San
Bernardino City Unified School District will reimburse the City fifty-percent (50%) of these
costs or$208,100 (rounded).
The Police Department's adopted budget for FY 2009/2010 includes $422,700 for crossing
guard services (Account #001-217-5014 / Part Time Salaries).

BUSINESS SERVICES DEPARTMENT
THIS AGREEMENT is made and entered into this day of 2009, by
and between the SAN BERNARDINO CITY UNIFIED SCHOOL DISTRICT, hereinafter
referred to as the "DISTRICT" with its principal place of business at 777 North "F" Street, San
Bernardino, California 92410, and CITY OF SAN BERNARDINO — POLICE
DEPARTMENT, hereinafter referred to as "CITY" having a business address at 710 N. "D"
Street, San Bernardino, California 92401.
I. TERM OF AGREEMENT
This Agreement is effective beginning July 1, 2009, and continuing through June 30,
2010. The school year is from July 1 to June 30 of each succeeding year.
V. CITY'S FEE AND PAYMENT THEREOF
A. In accordance with negotiations with the CITY, the DISTRICT agrees to
compensate the CITY for one-half of the cost of services rendered to accomplish
the results required hereunder, in the total amount not-to-exceed $208,059.00
(two hundred eight thousand fifty nine dollars). Invoices are submitted quarterly
(every three months).
All other terms and conditions will remain the same.

13 Amendment No. 5 to the Agreement with the San Bernardino City Unified School District
14 to share the cost of the school crossing guard program, a copy of which is attached hereto as
15 Exhibit"A," and incorporated herein by this reference.

SECTION 2. The authorization to execute the above referenced Amendment is

18 rescinded if it is not executed within sixty(60) days of the passage of this Resolution.
