CERTIFICATION OF NORTHWEST REDEVELOPMENT PROJECT AREA COMMITTEE
ELECTION RESULTS OF OCTOBER 15,2009
BACKGROUND:
Mayor and Common Council Resolution No. 84-221 and Community Development Commission
Resolution No. 4630 (said Resolutions together with the Judgment on Stipulation for Entry of Judgment
shall collectively be referred to as the "Settlement Documents")together with the Amended Bylaws of the
Northwest Project Area Committee ("NWPAC") require the NWPAC to conduct an election every two
years to elect ten or 11 of the 21 members of the NWPAC at each biennial election.
On June 12, 2008, the NWPAC held its biennial election where ten new board members were appointed
for a four-year term ending November, 2011.
On July 21, 2008, the Mayor and Common Council approved the amended NWPAC Operating Bylaws
and accepted the biennial election results of the election as conducted on June 12, 2008.
CURRENT ISSUE:
The NWPAC consists of 21 elected members representing the following five (5) categories: 1) Eligible
Organization, 2) Business Person/Property Owner, 3) Resident Owner Occupant 4) Residential Tenants,
and 5) at-large representatives comprised from categories 1 through 4. At the NWPAC Committee
meeting held on August 11, 2009, 11 members were notified that their terms would be expiring in
November. The 11 members were also notified via U.S. mail on September 14, 2009.
With regard to the election, a total of nine candidates representing eligible organizations, business
persons, property owners, and resident owner/tenants submitted applications for candidacy. Only five of
the 11 members whose terms were set to expire chose to run for re-election. On October 15, 2009, the
NWPAC conducted its election. The polling place was located at Community Hospital Office Building,
1800 Western Avenue, Solarium Room, from the hours of 3:00 p.m. to 7:00 p.m., with absentee voting
available as provided in the Operating Bylaws. Voters were instructed to vote for two candidates in their
eligible category and three candidates in the At-Large category for a total of five votes. A total of 32
voters cast ballots in this election. Of the nine candidates only seven received votes and the seven will
serve for a single, four-year term beginning November 10, 2009, and ending in early November, 2013.

In order to fill the remaining vacant spots, Section 3 of the NWPAC Bylaws, states that vacant
memberships shall be replaced by the person having obtained the next highest number of votes or if all
names have been exhausted, then vacated memberships shall be filled by nomination from the
representatives from categories 1 through 4 noted earlier.
The NWPAC will consider the matter of filling the vacated memberships at their next regular meeting.
ENVIRONMENTAL IMPACT:
This item does not meet the definition of a"project" under Section 15378 of the California Environmental
Quality Act(CEQA) and therefore there is no environmental impact.

6 WHEREAS, the Northwest Redevelopment Project Area Committee ("NWPAC") was duly
7 formed pursuant to the Mayor and Common Council of the City of San Bernardino ("Council')
8 Resolution No. 84-221, as adopted on June 18, 1984, and Resolution No. 4630 as adopted by the
9 Redevelopment Agency of the City of San Bernardino (the "Agency") on June 18, 1984; and
10 WHEREAS, said Resolutions of both the Council and Agency, together with the Judgment
11 on Stipulation for Entry of Judgment, are sometimes referred to collectively as the "Settlement
12 Documents" and serve as the basis for the continuation and administration of certain aspects of the
13 NWPAC as delegated to the NWPAC; and
ld WHEREAS, the NWPAC has conducted its biennial election for eleven (11) seats on the
15 NWPAC which election was conducted on October 15, 2009, and the election results of such
16 biennial election are attached hereto as Exhibit "A" and included in the Staff Report as submitted to
17 the Council upon adoption of this Resolution; and
18 WHEREAS, the Operating Bylaws require this Council to accept or reject the biennial
19 election results within thirty (30) days after such election results have been presented to the Council;
20 and
21 WHEREAS, the NWPAC is unique from all other project area committees ("PACs")
22 previously formed for the adoption of other redevelopment project areas, and has continued in
23 existence for twenty-four (24) years since inception whereas other PACs have terminated their
24 existence soon after the adoption of the applicable redevelopment project area; and
15 WHEREAS, it is appropriate for this Council to make certain findings and determinations
26 regarding the biennial NWPAC election as conducted on October 15, 2009.

1 NOW, THEREFORE, BE IT RESOLVED, DETERMINED AND ORDERED BY THE
2 MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO,AS FOLLOWS:
3 Section 1. The recitals as set forth above are accurate and correct in all respects.
4 Section 2. This Council hereby accepts the election results as set forth in Exhibit"A"to this
5 Resolution and directs the NWPAC to seat such recently elected members at the next monthly
6 meeting of the NWPAC for the duration of the elected terms.
7 Section 3. This Resolution shall take effect from and after the date as required by the City
8 Charter of the City of San Bernardino.
