The City Manager is hereby authorized and directed to execute the 9 attached Amendment No. 4 to the Agreement for Professional Services with TY Lin 10 International in the amount of $36,849.00 to provide additional services for preparation 11 12 13 14 15 16 17 18 19 III of a Project Study Report (PSR) for the University Parkway/Interstate 215 interchange loop entrance ramp project (SS04-19), said Amendment being attached hereto as Exhibit "A" and made a part hereof. SECTION 2. The Director of Finance is hereby authorized and directed to issue a Purchase Order for this work to TY Lin International in the total amount of$531,815.00. SECTION 3. WHEREAS, on December 6, 2004, the Mayor and Common Council adopted Resolution No. 2004-383 approving Agreement for Professional Services in the amount of $249,050.00 with Consultant to provide a Project Study Report/Project Report and the supporting studies and documents for the University Parkway/Interstate 215 Interchange Southbound Loop entrance ramp project hereinafter referred to as "Project"; and B. WHEREAS, on July 16, 2007, the Mayor and Common Council adopted Resolution No. 2007-257 approving Amendment No. I to Agreement for Professional Services with Consultant to provide additional design, environmental and traffic engineering services for the Project; and C. WHEREAS, on February 19, 2008, the Mayor and Common Council adopted Resolution No. 2008-60 approving Amendment No.2 to the original Agreement for Professional Services with TY Lin International to provide PSR/PR documents for the University ParkwaylInterstate 215 Interchange Southbound Loop entrance ramp project (SS04-19). D. WHEREAS, on May 19,2008, the Mayor and Common council adopted Resolution No. 2008-152 approving Amendment No.3 to the original Agreement for Professional Services with TY Lin International to provide PSR/PR documents for the University ParkwaylInterstate 215 Interchange Southbound Loop entrance ramp project (SS04-19); and E. WHEREAS, Amendment No.3 extended the term of said Agreement for Professional Services to July 16, 2009; and F. WHEREAS, changes to the scope of services have occurred that were beyond the control of Consultant and the City and will require Consultant to perform additional work and incur additional costs not anticipated at the time of execution of the original Agreement for Professional Services; and G. WHEREAS, changes to the scope of services will result in a continuing need for the services of the Consultant beyond the current expiration date; and -1- 2009-199 Amendment No.4 to Agreement for Professional Services with TY Lin international. H. WHEREAS, staff concurs that the work for which additional compensation is requested was not included in the original Agreement for Professional Services as amended; NOW THEREFORE, the parties hereto agree as follows: I. Section I "Scope of Services" of said Agreement for Professional Services IS amended to add the following: A. Consultant shall complete a Project Study Report (PSR) for the Project and process through Caltrans and the Federal Highway Administration (FHW A) in accordance with letter proposal from Consultant dated May 21, 2009, attached hereto and incorporated herein as Attachment" I ". B. Methodology for the PSR shall conform to the latest guidelines from Caltrans' Project Development Procedures Manual (PDPM). 2. Section 2 of said Agreement for Professional Services is amended to add the following: "The term of this Agreement for Professional Services is hereby extended to June 30, 2010, unless terminated earlier as provided in the original Agreement for Professional Services." 3. Section 5 "Compensation" of said Agreement for Professional Services is amended to add the following: AI. The City shall compensate the Consultant for actual costs (including labor costs, employee benefits, overhead, profit, other direct and indirect costs) incurred by the Consultant in the performance of work authorized by Amendment No.4 for an additional cost not-to-exceed $36,849.00 as indicated in said Attachment 1. Lin International (TYU) is pleased to submit this proposal to provide engineering services to complete a Caltrans Project Study Report (PSR) for the above referenced project. Background: The initial contract was to prepare a combined Project Study Report/Project Report (PSR/PR) which was completed in a draft format. After Caltrans reviewed it, they concluded that due to policy revisions and FHW A' s new requirements, the project did not qualify for a combined PSR/ PR anymore. The city was then directed to start over and prepare a PSR according to the latest guidelines from Caltrans' Project Development Procedures Manual (PDPM). Un International will provide overall execution and financial management of the project, including City of San Bernardino and Caltrans coordination, tracking progress of the work, preparing monthly invoices, biweekly project status reports and conducting project meetings. TYLI will prepare monthly status reports to update the City on the progress to date; work to be accomplished in the next period; and potential problems of a technical nature or forecasted budget/schedule requirement. TYLI will also prepare and update a project schedule and distribute it to all project team members. TYLI's Project Manager will provide overall coordination, and supervision of project staff to facilitate the performance of the work in accordance with the scope and requirements of the City of San Bernardino. TYLI will coordinate all project activities with the City, Caltrans, FHWA and any affected local agencies. TYLI will conduct meetings with the City to discuss progress, general project issues, obtain direction, and to exchange information. TYLI will also chair and conduct Project Development Team (PDT) meetings. TYLI will prepare project contact lists, meeting agendas, and meeting minutes. De/iverab/es: . Project Schedule . Meeting Minutes Task 2 Data Collection / Field Review The TYLI will review records, collect data regarding existing improvements, and collect information on existing utilities and right of way. Task 3 Project Study Report (PSR) Task 3.1 Draft and Final PSR TYLI will prepare a draft PSR which will follow Caltrans guidelines. The PSR will include the following sections and discussions: . Project Reviews The draft PSR will include the following attachments: . Location map . Appropriate maps (existing and proposed) . Schematic Geometric Maps . Structure Advance Planning Study The draft PSR will be submitted to the City and Caltrans for review. Upon receiving and incorporating comments, a final PSR will be prepared and submitted for approval. Task 3.2 Alternative Analvsis In consultation with City staff, TYLl will develop three alternatives for detailed consideration. Each alternative will be evaluated for impacts to right- of-way, traffic, access, sight distance, existing utilities, local and regional drainage, safety, freeway operations, constructability, and other critical issues. Once the alternatives are developed, a senior level TYLl engineer will perform a Value Engineering Analysis to identify and evaluate alternative project solutions and provide recommendations to the city. Task 3.3 Cost Estimates TYLl will prepare preliminary quantities and cost estimate for the build alternatives. The estimate will include costs for structure, roadway, traffic and signing, drainage, utility relocations, and right of way. Costs for preliminary engineering, design, environmental, right of way support and construction support will also be included. Task 3.4 Exhibits and Geometric Base maos Geometric drawings will be prepared for each build alternative. The geometric drawings will include plan, profile, and typical cross sections in llx17 formats, depicted on an aerial photograph and/or topography map. Task 3.5 Riaht of Wav Data Sheets I Utilitv Assessment Right of Way data sheets will be prepared for the build alternatives using Caltrans requirements. The data sheets will include the right of way requirements and assessments of the cost of acquisitions. The TYLl will identify utility companies involved in the project. Utility needs will be assessed based on the geometric drawings of build alternatives. The information and cost related to the utility needs will be documented in the Right of Way Data Sheet. This TMP will identify construction staging and traffic handling issues to a degree sufficient to verify constructability and feasibility of traffic handling for the preferred alternative. Task 3.7 Preliminary Structures Advance Plannina Studv lAPS) Preliminary Structure Advance Planning Study (APS) will be prepared for the proposed alternatives in accordance with the requirements in Caltrans' Bridge Memo to Designers 1-8. This effort will be used to establish final alignment and profile, support locations, bridge depth, and other key characteristics of the structure. Utilizing Caltrans' Bridge Advance Planning Studies Guide, square foot cost factors will be used to develop cost estimates for the structure. A technical memorandum will also be prepared to accompany the drawing, and will discuss key issues affecting design or construction of the proposed structure. Task 3.8 Storm Water Data Reoort ISWDR) TYLI will prepare a SWDR for inclusion in the PSR. The preparation of the SWDR will follow Caltrans Storm Water Quality Handbooks Project Planning and Design Guide (May 2007). De/iverab/es: . Draft Project Study Report (PSR) . Mandatory Design Exception Fact Sheet Task S Life Cycle Cost Analysis for Pavements (LCCA) Life-Cycle Cost Analysis for pavements shall be performed and documented for all projects which include pavement work on the State Highway System, regardless of funding source. TYLI will prepare a LCCA using RealCost V2.2 per Caltrans requirements and its findings will be incorporated in the PSR. Deliverab/es: . Budgets, schedules and project progress will be closely monitored and controlled through TYLI's internal system. Deliverables: . Quality Control Statement Assumptionsl Exclusions . A maximum of ten meetings are assumed . Three alternatives will be studied . Traffic study will be completed by the city . No Environmental work is required (Previously completed Environmental Documents are to be included in this PSR) . No MAR (Modified Access Report) is required during this phase .
