SPECIAL MEETING
JULY 28, 2009

NOTICE IS HEREBY GIVEN that the Mayor and Common Council of the City of San
Bernardino have called a special meeting of the Mayor and Common Council for 4 p.m.,
Tuesday, July 28, 2009, in the Economic Development Agency Boardroom, 201 North
"E" Street, San Bernardino, California.
The purpose for which this meeting was called was: I) closed session; 2) to discuss and
adopt a resolution authorizing the City of San Bernardino to establish 2009-2010
expenditures for the month of August, 2009 only, at one-twelfth the actual levels
contained in the adopted budget for 2008-2009 fiscal year, or as needed to pay the
authorized costs incurred for the month of August, 2009 only, pending final approval of
the 2009-2010 budget; and 3) to set a budget workshop date for FY 2009/10 budget
discussions.
The special meeting of the Mayor and Common Council of the City of San Bernardino
was called to order by Mayor/Chairman Morris at 4:11 p.m., Tuesday, July 28,2009, in
the Economic Development Agency Boardroom, 201 North "E" Street, San Bernardino,
California.

Council Members/Commissioners Estrada and Brinker.
I. Closed Session
Pursuant to Government Code Section(s):
A. Conference with legal counsel - eXlstmg litigation - pursuant to
Government Code Section 54956.9(a).
B. Conference with legal counsel - anticipated litigation - significant
exposure to litigation - pursuant to subdivision (b) (1), (2), (3) (A-F) of
Government Code Section 54956.9.
C. Conference with legal counsel - anticipated litigation - initiation of
litigation - pursuant to subdivision (c) of Government Code Section
54956.9.
D. Closed Session - personnel - pursuant to Government Code Section
54957.
E. Closed session with Chief of Police on matters posing a threat to the
security of public buildings or threat to the public's right of access to
public services or public facilities - pursuant to Government Code Section
54957.
F. Conference with labor negotiator - pursuant to Government Code Section
54957.6.
G. Conference with real property negotiator - pursuant to Government Code
Section 54956.8.
Note: The Mayor and Common Council did not consider closed session items at
this meeting.

2. RES. 2009-274 - Resolution of the Mayor and Common Council of the City
of San Bernardino, California, authorizing the City of San Bernardino to
establish 2009-2010 expenditures for the month of August, 2009 only, at one-
twelfth the actual levels contained in the adopted budget for 2008-2009 fiscal
year, or as needed to pay the authorized costs incurred for the month of
August, 2009 only, pending final approval of the 2009-2010 budget.
Council Member/Commissioner Baxter made a motion, seconded by Council
Member/Commissioner Shorett, that full reading be waived; and that said
resolution be adopted. The motion carried and Resolution No. 2009-274 was
adopted unanimously with Estrada and Brinker absent.
3. Set Budget Workshop date for FY 2009/10 budget discussions
Barbara Pachon, Director of Finance, stated that the State passed their budget and
the bad news is that 8 percent of the City's property tax was taken, which equates
to $3 million, but the good news is that they did not vote to take gas tax from
local government. She stated that the State ended up taking a little more from
redevelopment agencies than what was originally anticipated, and that will impact
the City.
Emil Marzullo, Economic Development Agency Interim Executive Director,
stated that the Educational Revenue Augmentation Fund (ERAF) hit to the
Redevelopment Agency budget was projected last year and this year at $2.5
million. However, with the new numbers that came out last week, an additional
$9.5 million was projected under the Supplemental Educational Revenue
Augmentation Fund (SERAF), and those numbers have changed to $12 million,
for a total potential hit of $14.5 million to the Redevelopment Agency. He stated
that they have to take some measured steps, remain in contact with their state
lobbyist, and take a look at what is likely versus the potential worst case scenario,
and that's somewhere between $2.5 and $14 million.
Mayor/Chairman Morris stated that he heard that the legislature has routed ERAF
money in a different way, using different language, and that under Proposition
98, we will backfill the school budget using ERAF dollars.
Mr. Marzullo stated that the formula has been re-worked whereby the
Supplemental ERAF numbers would go to schools and would be based on average
daily attendance within schools, within RDA areas. He stated that that creates a
third dimension of having to interface with the school districts to figure out how
those numbers will work.
City Manager McNeely stated that he had previously suggested a possible date for
the budget workshop would be August 4, 2009. However, due to the fact that

approval of the State's budget has resulted in further significant financial impacts
to the City of San Bernardino, particularly with respect to the Redevelopment
Agency, he recommended that the budget meeting be held on August 10, 2009, at
5 p.m. in the Economic Development Agency Boardroom.
Council Member/Commissioner McCammack stated that because Council
Members/Commissioners Estrada and Brinker were not present at today's
meeting, she requested that the matter be continued to the next regular Council
meeting, at which time a specific date and time could be selected.
Council Member/Commissioner McCammack made a motion, seconded by
Council Member/Commissioner Shorett, that the matter be continued to the
Council/Commission meeting of August 3, 2009. The motion carried
unanimously with Estrada and Brinker absent.
4. Adjournment
At 4:24 p.m., the meeting was adjourned. The next joint regular meeting IS
scheduled for I :30 p.m., Monday, August 3, 2009.
