TO FUND THE RESTORATION OF UP TO 22 SWORN POLICE OFFICER
POSITIONS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNOL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Gty Manager or his designee is hereby authorized to obligate and
expend the allocated Justice Assistance Grant monies in the amount of $1,005,287 from the u.s.
Department of Justice, Bureau of Justice Assistance, for law enforcement support expenditures as
outlined in the attached Expenditure Plan, marked Exhibit "A", submitted by the Ollef of Police.
SECTION 2. The Mayor and Common Council of the Gty of San Bernardino hereby
authorize the Gty Manager, Gty Attorney and Gty Clerk to execute the JAG grant Interlocal
Agreement between the Gty of San Bernardino and County of San Bernardino in the form
attached hereto, marked "Exhibit B" and by the reference made in part hereof.
SECTION 3. Authorization to execute the Interlocal Agreement is rescinded if both
parties fail to sign the Agreement within 120 days.

2. Authorize the Law and Justice Group to electronically submit an application, in the amount of

BACKGROUND INFORMATION
The U.S. Department of Justice, Office of Justice Programs, Bureau of Justice Assistance
recently announced the availability of grant funds to state and local units of government through
the American Recovery and Reinvestment Act of 2009 Edward Byrne Memorial Justice
Assistance Grant (JAG) Program. The stated purposes of the Recovery Act are: to preserve and
create jobs and promote economic recovery; to assist those most impacted by the recession; to
provide investments needed to increase economic efficiency by spurring technological advances
in science and health; to invest in transportation, environmental protection, and other
infrastructure that will provide long-term economic benefits, and; to stabilize State and local
government budgets in oider to minimize and avoid ieductions in essential services and
counterproductive State and local tax increases. Specifically. under the JAG program, federal
criminal justice funding is provided to state and local jurisdictions to prevent or reduce crime and
violence. JAG funds support all components 0 the criminal justice system, from multijurisdictional
drug and gang task forces to crime prevention and domestic violence programs, courts.
corrections, treatment, and justice information sharing initiatives. This program allows state and
local governments to address crime through the provision of services directly to individuals and/or

communities and by improving the effectiveness and efficiency of criminal justice systems,
processes, and procedures.
The funding distribution, calculated by the Bureau of Justice Statistics, is based on each state's
crime expenditures and total violent crime reported by local jurisdictions within the state. Units of
government must meet a minimum threshold amount of $10,000 to receive a JAG award.
Jurisdictions certified as disparate must submit a joint application for the aggregate of funds
allocated. A disparate allocation occurs when the allocation to one city is more than 150% of the
County's allocation, or when the total of all cities combined exceeds 400% of the County's
allocation. According to this definition, the County of San Bernardino, the Town of Apple Valley,
and the Cities of Adelanto, Barstow, Big Bear Lake, Chino, Chino Hills, Colton, Fontana, Grand
Terrace, Hesperia, Highland, Loma Linda, Montclair, Needles, Ontario, Rancho Cucamonga,
Redlands, Rialto, San Bernardino, Twentynine Palms, Upland, Victorville, Yucaipa, and Yucca
Valley are disparate jurisdictions. JAG requires disparate jurisdictions to enter into a
memorandum of understanding (MOU) that identifies a fiscal agent that will submit a joint
application for the total eligible allocation by May 18, 2009. If not, the application will not be
accepted and the funds will be disbursed elsewhere. On February 17, 2009, President Obama
signed into law the American Recovery and Reinvestment Act of 2009. Notification of this grant
application was received on March 9, 2009, and requirements of this application list the grant
period beginning on October 1, 2008.
The proposed MOU meets the JAG requirement and provides for the County of San Bernardino
Law and Justice Group (County) to serve as the applicant/fiscal agent and administer the grant.
A five percent (5%) administrative fee will be retained by the County. Specifically, the County will
be responsible for the grant application, tracking performance measures, preparation and
submittal of quarterly financial and progress reports, budget review, evaluation of expenditure
plans, and the coordination of all pass-through amounts. The County will release grant allocations
from the JAG award within sixty (60) days upon receipt of funds, less the five percent (5%)
administrative fee, as reflected in the chart below:

The JAG application contains an expenditure plan that outlines how the jurisdictions above will
use the funds. JAG funds may be used for state and local initiatives, technical assistance,
training, personnel, equipment, supplies, contractual support, information systems for criminal
justice and criminal justice-related research and evaluation activities within the grant's seven
purpose areas: 1) law enforcement programs; 2) prosecution and court programs; 3) prevention
and education programs; 4) corrections and community corrections programs; 5) drug treatment
and enforcement programs; 6) planning, evaluation and technology improvement programs; and
7) crime victim and witness programs (other than compensation). The County's Law and Justice
Agencies (Sheriff, District Attorney, Public Defender, Probation, and Superior Court) propose to
use the County's $514,764 as follows: Victorville Juvenile Drug Court ($75,894); San Bernardino
Juvenile Drug Court ($37,714); security system at the Sheriffs Colorado River station ($170,000);
Probation Case Management System programming and enhancements ($27,856); Probation
Gateway program ($50,000); Probation Thinking for a Change program ($50,000); District
Attorney computer equipment and training ($50.000) and the Public Defender's imaging project
($53,300).
FINANCIAL IMPACT
Overall grant revenue expected to result from this application is $4,677,019, of which $514,764
will be used for County projects. The MOU provides for an additional administrative fee of
$233,851, which will be used to offset costs within the Law and Justice Group Administration
budget unit (AAA-LNJ), within the four-year grant period. The Department will return to the Board
to accept the grant and request appropriations and revenue adjustments when the grant is
awarded.

CONCERNING DISTRIBUTION OF THE
2009 AMERICAN RECOVERY AND REINVESTMENT ACT AWARD
This Agreement is made and entered into this 12th day of May , 2009, by and
between THE COUNTY OF SAN BERNARDINO, acting by and through its governing body,
the Board of Supervisors (hereinafter referred to as "COUNTY"), and the aforernentioned
TOWN (hereinafter referred to as "TOWN") and named CITIES (hereinafter referred to as
"CITIES"), acting by and through their respective governing bodies, the Town Council and City
Councils, all of whom are situated within the County of San Bernardino County, State of
California, as follows:
WHEREAS, each governing body, in performing governmental functions or in paying for
the performance of governmental functions hereunder, shall make that performance or those
payments from current revenues legally available to that party; and
WHEREAS, each governing body finds that the performance of this Agreement is in the
best interests of all parties, that the undertaking will benefit the public, and that the division of
costs fairly cornpensates the performing party for the services or functions under this
Agreernent; and
WHEREAS, the COUNTY agrees to release to TOWN and CITIES their respective
grant allocation from the JAG Award within sixty (60) days upon receipt of funds, less five
percent (5%) for administrative fees, as reflected on Appendix 1 here attached and hereby
incorporated by reference as part of this agreernent; and COUNTY agrees to use the five
percent (5%) of JAG award funds received from TOWN and CITIES under this agreement for
administrative fees toward the administration of TOWN's and CITIES' prograrns during the
entire perrnissible duration of said prograrns; and TOWN and CITIES agree to deposit their
JAG award funds into a separate trust account in accordance with JAG guidelines; and TOWN
and CITIES each agree to the five percent (5%) reduction of their respective grant allocation
from the JAG award, as reflected on Appendix 1 for adrninistrative fees toward the
adrninistration of this program; and additionally the TOWN and CITIES each agree that it is
their responsibility to ensure these funds are expended in accordance with JAG guidelines,
and that the interest generated from such funds shall be solely applied and expended in
accordance with these sarne JAG guidelines; and
WHEREAS, the CITY and COUNTY believe it to be in their best interests to reallocate
the JAG funds,

NOW THEREFORE, the COUNTY and TOWN and CITIES agree as follows:
Section 1.
COUNTY agrees to release to TOWN and CITIES their respective grant allocation from the
JAG Award within sixty (60) days upon receipt of funds, less five percent (5%) for
administrative fees, as reflected in Appendix 1 here attached and hereby incorporated by
reference as part of this Agreement; and COUNTY agrees to use the five percent (5%) of JAG
award funds received from TOWN and CITIES under this agreement, for administrative fees
toward the administration of the TOWN's and CITIES' programs during the entire permissible
duration of said programs.
Section 2.
TOWN and CITIES agree to deposit their JAG award funds into a separate trust account in
accordance with the JAG guidelines; and TOWN and CITIES agree to the five percent (5%)
reduction of their respective grant allocation from the JAG award, as reflected in Appendix 1
for administrative fees toward the administration of this program; and additionaliy, TOWN and
CITIES each agree that it is their responsibility to ensure these funds are expended in
accordance with JAG guidelines; and that all interest generated from such funds shall be solely
applied and expended in accordance with these same JAG guidelines.
Section 3.
TOWN and CITIES agree to provide COUNTY with sufficient timely information.on request as
necessary for COUNTY to meet JAG requirements for quarterly and annual financial and
performance reports.
Section 4.
Nothing in the performance of this Agreement shall impose any liability for claims or actions
against COUNTY other than what is authorized by law.
Section 5.
Nothing in the performance of this Agreement shall impose any liability for claims or actions
against TOWN and/or CITIES other than what is authorized by law.
Section 6.
Each party to this Agreement will be responSible for its own actions in providing services under
this Agreement and shall not be liable for any civil liability that may arise from the furnishing of
the services by any other party.

The parties to this Agreement do not intend for any third party to obtain a right by virtue of this
Agreement.
Section 8.
By entering into this Agreement, the parties do not intend to create any obligations, either

rights in any party not a signatory hereto.
