Synopsis of Previous Commission/Council action:

Agency Counsel was authorized to retain bankruptcy
counsel to handle the English Bankruptcy matter.
Recommended motion: ,Mayor and Common Counc i 1 :
A. That the City of San Bernardino establish a policy not to
license any use of the Convention Center until the entire
bankruptcy issue involving English Enterprises, Inc., has
been resolved, based upon advice of bankruptcy counsel.

B. That theuSu!,erintendent of PuBlic Buildings be instructed to commence
general maintenance of the Convention Center.

STAFF REPORT
A. William J. Simon, of the law firm of Simon and Simon, has been
retained to represent the City and the Agency in the bankruptcy
matter (reorganization in bankruptcy) of English Enterprises, Inc.,
which had a Disposition and Joint Development Agreement. with the
Agency, and a Convention Center Operating Agreement with the City.
Bankruptcy counsel met with the Hotel Ad Hoc Committee (Members
Strickler, Quiel and Estrada) on December 13, 1985, and recommended
that no use be made of the Convention Center until the entire
bankruptcy matter has been cleared up. He indicated to the
Committee that he believes the entire matter could be cleared up
within ninety (90) days, at least insofar as City and Agency
involvement is concerned, and expressed concerns about health and
safety issues, among other things, if the Convention Center is used
in the meantime.
Mr. Simon asks that the matter be taken up in Closed Ses~ion if
any member of the Council/Commission desires further information,
since this involves pending litigation in which the City and Agency
are actively involved. U.S. Bankruptcy Court Case No. SB85-03543 DN,

Mr. Simon expects to be available to meet with the members during
this' meeting.
