SUBJECT: Mineral Resource Zones
DATE: December 2, 1985
Background: In 1975, the State Legislature adopted the Surface Mining and
Reclamation Act (SMARA). The Legislature recognized that areas with important
mineral resources, primarily sand and gravel, were being lost to urban develop-
ment. Sand and gravel resources are especially important to continued develop-
ment.
SMARA requires the State Mining and Geology Board to map and classify all of
the mineral resources in the State into Mineral Resource Zones. If the Board
determines that those resources are of statewide or regional significance, the
Board shall then designate those resources as such. Upon final determination,
each lead agency must amend its General Plan to show the specific sectors so
designated and develop and adopt policies for the management of mineral resources.
The City is required to submit its mineral resource management policies for review
by the Board prior to final adoption after designation. If the City proposes a
use that is incompatible with mineral extraction in or near the designated sectors,
it must make findings why the mineral resource is not being protected. The specific
findings may include a detailed evaluation or a focused EIR. The results of said
evaluation must then be submitted to the State Geologist and the State Mining and
Geology Board for review and comment. The Board can cause a project to be delayed
or tabled.
The Planning Department staff has attended Mineral Resource Zone meetings with
the County of San Bernardino and the affected cities in the Claremont-Upland and
San Bernardino Production Consumption Regions to coordinate efforts as a region
and where designations overlap jurisdictional boundaries. Staff has also met with
representatives of the Board to express concerns of the City. On November 15, 1985,
staff made a presentation before the State Mining and Geology Board to formally
submit the City's comments on the designatien of sectors within our jurisdiction.
All of the affected cities were present and submitted letters or resolutions
stating their positions.
The Board has recognized some of our previous recommendations, but there are still
several areas of concern. The attached 'resolution and Exhibits "A" and liB" show
where the sectors are located and the City's recommendation for each.
Reco~nendation: To adopt the attached resolution, No. 85-
"B" and instruct staff to submit the information to the State
Board.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN BER~ARDINO STATING
ITS POSITION ON THE DESIG~<ATION, BY THE STATE ~lINING .\J.'lD GEOLOGY BOARD, OF
CERTArN AREAS AS MINERAL RESOURCE ZONES \-lITHIN THE CITY LIMITS.
W1-IEREAS, the State :'[ining and Geology Board is in the process of
classifying and designating areas of regionally significant mineral resources
pursuant to the Surface :!ining and Reclamation Act of 1975: and
i<HEREAS, the California Surface Mining and Reclamation Act, Environmen-
tal Impact Report No. 5 identifies those areas with significant mineral
resources in the Claremont-Upland, San Bernardino Production-Consumption
Reg~ons; and
WHEREAS, the City of San Bernardino supports the concept and intent
of the Surface Mining and Reclamation Act; and
WHEREAS, the City has a commitment to support the extraction of
~ineral resources within specified areas as evidenced by currently active
mineral extraction operations; and
WHEREAS. the City or San Bernardino is required, upon final
designation of areas of regionally significant resource within its
jurisuiction to:
1. Recognize and include in~ts general plan, the designated areas
of statewide, or regionally significant aggregate resource; and
2. Develop and adopt policies for the management of land use areas
classified or designated by the State Mining and Geology Board,
and to protect those areas from development incompatible with
mining; and
3. Empha~ize the conservation and development of mineral deposits
designated by the State ~'lining and Geology Board, to be of
statewide or regional significance.

WHEREAS, the City of San Bernardino recognizes the need to
preserve aggregate resource; and
WHEREAS, the City finds that there are existing and anticipated
land use conflicts within some of the sectors selected for designation;
and;
WHEREAS, the City finds that portions of the proposed designation
sectors as illustrated in Exhibits "A" and "B" are not suitable for
mining because said use would have an adverse effect on existing
and proposed land uses; and
\iHEREAS, the City finds that portions of the proposed designation
sectors are not suitable for mining due to their size, location and
limited access as described in Exhibits "A" and "B"; and
WHEREAS, the City finds that the deletion of portions of the
sectors proposed for designation would leave substantial resources
available for future mining.
NOW, THEREFORE, BE IT RESOLVED, that the City of San Bernardino
adopts the findings set forth in Exhibits "A" and "B"; and
BE IT FURTHER RESOLVED, that the City of San Bernardino hereby
expresses its intent to adopt into ~s General Plan those areas as
mineral resource zones which are determined to be compatible with
existing and proposed land uses as shown in Exhibits "IIAI! and HBn 1
and to administer its planning process in a manner consistent therewith.

The Ci ty requests that all of the "C" sub sectors be deleted from con-
sideration because they are located in an area experiencing a growth rate
in excess of 25%, the highest in the City. As part of the Verdemont Area
Plan, a biological survey was performed (Pacific Southwest Biological
Services, Inc. July 31, 1985) that identified a rare and endangered plant
species located in portions of Sectors C-4 and C-8. Further information
indicates that the survey was incomplete and that the habitat for the plant
extends over a greater area than previously identified. Traffic and safety
concerns make these sectors unsuitable for designation.

League Drive has the Western
Regional Little League Head-
quarters on it. Adjacent to
the baseball park on the east
is a site under consideration
for a Junior High School.
North of the sub sector and
east of Little League Orive
the San Bernardino City Uni-
fied School District has
purchased property to build
an Elementary School. In the
section west of Little League
Drive are two approved Tenta-
tive Tracts, one of Which
extends northwest of the
easement into the third sec-
tion of Sector C-4. The re-
mainder of C-4 is unsuitable
for designation because the
frontage road does not go
through to the northwest. As
a result, all traffic must
travel through residential
areas to the freeway on/off
ramp at Palm Avenue.
The City's portion is part of
a Redevelopment Project Area
and the Ci ty Enterpri se Zone
and is also under considera-
tion for a State designated
Enterprise Zone.

The Ci ty woul d li ke to see the majori ty of the "F" subsectors removed from
consideration because of their location in highly urbanized areas. They do
not have direct freeway access and, therefore, would create safety, traf-
fic, fugitive dust, and noise problems. Although some of the sub sectors
are vacant, the surrounding land uses are such that incompatibility of uses
would be a major concern. Because the area is urbanized, the City could
not provide a buffer between the existing uses and any proposed mining.
