Recommended motion: 1. That the incidental costs relative to said proceedings for the improvement of abandoned driveways be absorbed by the City. 2 - - - - - - CI-Q OF SAN BERNARDC>> - REQUQT FOR COUNCIL Ae.:AON STAFF REPORT Pursuant to Chapter 12.92 of the Municipal Code and the intentions of the MAC Force, this will be the first project to be processed. A survey has been made relative to abandoned driveway approaches and the necessity of in-filling same on the streets within the City. The attached list was prepared and has been checked relative to qualifying under the provisions of Chapter 27 and Chapter 12.92, and we recommend that the necessary improvements be made. The list as compiled affects 201 parcels of land needing improvements of driveway approach removal, curb depression removal, construction of curb, curb/gutter, sidewalks or combinations thereof, and the total estimated cost is anticipated to be $139,700.00 including incidental costs. If the property owners choose not to do the work, then the construction will go to bid for an outside contract. Oue to the overa 11 cost, we recommend that the Ci ty up-front the contract cost, if necessary, and that the owners have three years in which to pay the assessment on their respective tax bills. The three year limit was determined based on the authorization given for the first phase of our regular Chapter 27 improvement assessments. This type of project is not conducive to the sale of bonds as the project is in bits and pieces spread allover the City. If bonds were saleable, the proceedings involved would be considerably more complicated and the related charges would inflate the assessments to a point which would render the project unfeasible. The present estimated average cost to each property owner is $695.00. Section 5895 of Chapter 27 allows us to collect a maximum of 7% per annum interest on the unpaid balance which will be done if you so desire, however, we can only allow annual installments on assessments which exceed $50.00. The list generally covers the major travelled streets between Highland Avenue, Mill Street, Mt. Vernon Avenue and Waterman Avenue. It is the recommendation of the MAC Force that although this action will provide the authori za ti on to proceed on a 11 of the parcel s, that actual 'otification and construction will be done in phases to be determined by them. The MAC Force a1 so suggested that the Ci ty absorb the incidental costs which are estimated at $12,700.00. If you wish to do so, use Form Motions No.1 and No.2, otherwise, use only Form Motion No.1. The estimate of $12,700.00 for incidental costs represents 10% of the total construction costs based on past experience wi th Chapter 27 type improvements. There is a tremendous amount of field and office work involved with these types of proceedings. Consequently, the incidental costs are high. Our first' Chapter 27 project ran as high as 25% of the construction costs.
